CONSULTANTS AGREEMENT FOR CONSTRUCTION STAKING
Statement of the Matter
The subject contract was awarded to Asphalt Service Co. of
Oceanside, California on August 3, 1976. Construction will start by September 1, 1976.
Due to the size of the project, considerable field surveying
is required to establish line and grade for the construction.
The Engineering Department is not presently staffed to field a survey crew for the length of time required by this contract.
Three local private engineering firms were contacted and asked to submit proposals for the work.
As outlined in AB 3611, Supplement #2, funds are available in
the project budget to cover this work.

Our fee for providlng the services as outlined in your letter dated July 12,
1976. would be $6,030.
Currently, we have three two-man survey crews. The avalla biiity of these
crews would be on twenty-four hour previous notice and would lnclude the

Pertaining to the procedure of providing line and grade for storm draln and

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT BE-
TWEEN THE CITY OF CARLSBAD AND RICK ENGINEERING
COMPANY FOR FIELD ENGINEERING SERVICES ON ELM
AVENUE CONSTRUCTION AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Carlsbad, California does
hereby resolve as follows:
1) That certain Agreement between the City of Carlsbad and
Rick Engineering Company for field engineering services on the
construction of Elm Avenue, a copy of which is attached hereto
marked Exhibit "A" and incorporated herein by reference, is hereby
approved.
2) That the Mayor of the City of Carlsbad is hereby authorize
and directed to execute said agreement for and on behalf of the
City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City
Council of the City of Carlsbad, California, held on the 17th
day of August , 1976, by the following vote, to wit:

AGREEMENT

TO PROVIDE FIELD ENGINEERING SERVICES FOR THE CONSTRUCTION OF
ELM AVENUE FROM VALLEY STREET TO DONNA DRIVE
This agreement is made and entered into this 17th day of
August , 1976, by and between Rick Engineerinq Company
hereinafter referred to as "Engineer", and the City of Carlsbad,
hereinafter referred to as "City".
RECITALS
City proposes to construct certain street improvements on Elm
Avenue from Valley Street to Donna Drive, as shown on City
Drawing No. 132-4D.
Engineer has submitted a proposal to perform construction engi-
neering services in connection with this project to include
one set of stakes for each of the following:
I
1) Establish construction and perrnaoent street centerTine.
2) Provide rough and final grade stakes for centerline,
quarterpoint, and cut and fill slopes.
3) Provide final grade stakes for curb line.
4) Provide line and grade stakes at street grade for
sanitary sewer, storm drain, and water line reconstruc-
tion.
Any additional staking required by the contractor shall be billed
to the contractor by the Engineer at the rates indicated on the
fee schedule attached as Exhibit "A". ---
AGREEMENT
1) City engages the Engineer to furnish the services hereinafter
mentioned at and for the compensation herein stipulated and
the Engineer accepts said engagement upon terms hereinafter
set forth.
2) Engineer shall:
a) Establish the construction cernterline within 30 days
b) Furnish grade stakes as required by the contractor upon (3) three days advance notice.
c) Furnish ties for permanent well monuments for the contractor's use in setting monuments and for the City's records.
after execution of this agreement.
3) City shall provide Engineer with:
a) Existing field survey data.
b) Consultation as needed.
c) Advance notice for field work.
4) City reserves the right to term-inate the agreement at any
time by written notice to the Engineer. In the event the
City terminates this agreement, it shall reimburse the
Engineer a portion of his fee based on actual costs and
percentage of work done as determined by the City Engineer.
5) In consideration of the performance of the above described
engineering services, City agrees to pay the Engineer a
fee of $6,030, payable as follows: 1/3 upon Go-mpletion of
grade staking; 1/3 upon completion of utility staking; and
1/3 upon completion of final monuments.
In witness whereof, the parties have executed this Agreement
as of this day and year first hereinabove written.
