PERMISSION TO TEST BOATS
. AGUA HEDIONDA LAGOON
Statement of the Matter • ^ •

At the Council meeting of August 19, 1975, permission was
granted to the operators of the Ski Hut (Fred and Lee Lathrop)
as well as Litchfield Custom Boats for boat testing on Agua
Hedionda Lagoon on Tuesdays or -Wednesdays between the hours of
10: 00AM and 12:'00 Noon for a period of one year, with the
provision that the Police Department be notified prior to any
testing. This permission has now expired.
Councilman Lewis has requested that Council give consideration
to .extending approval for another year.' Mr. and Mrs. Lathrop
have also written a letter requesting renewal on b.ehalf of
Ski Hut and Litchfield Custom Boars.
During the past year complaints have been minimal relative to
the noise created in the testing of these boats, which are
primarily new craft or modified speed boats.
The City of Carlsbad's present ordinance states that no person
shall operate a boat in excess of 45 miles per hour except
with a special operations permit issued by the Chief of Police
and authorized by the City Council (Ordinance 3098, Title 11,
Chapter 11.24, Section 11.24.022.)

Recommendation
If Council concurs and grants the request, it should be with
the understanding that the Police Department be notified prior
to any testing.
Council Action.
8-24-76 It was moved that Council authorize the oermit renewal to the Snug
Harbor Ski Hut and Litchfield Bros, for the purpose of testing boats
on the Aqua Hedionda Lagoon with the same conditions as prior permits.
Councilman Skotnicki then requested the staff reveiw the question
of the legality of the boat testing .with reciard to the San Diego Gas
& Electric Co. lease, which stipulates the use of the Lagoon as
strictly for recreational purposes.
