Mgr. /s/PDB -- Septcmbxr 7, 1976 --- DATE : --_ -_-_ --- - Subject: CAR COUNTRY/FREESTANDING SIGN Statement of the 14jatter - - ' Staff has been meeting with'Mr. Robert Knauf, Attorney, representing Car Country, regarding a freestanding sign requested by the car dealers in the Paseo Del Norte area, specifically located on Lot 10 of the Dixon Ford lot. The City is building a mini-park on Lot 11 of Carlsbad Tract 72-3 adjoining Lot 10. Part of the Agreement was to allow an easement across Lot 11 to install and maintain an underground electrical conduit from the car dealer's electric meter to furnish power to the site. Mr. Knauf has agreed to draft the easement document and the City will furnish the description for the easement as well as a location map. As part of this Agreement, the Tri-City Auto Dealers' Association will pay all metered electrical charges to energize lights and timers in the City park located on Lot 11. The Parks and Recreation Director indicates there will be minimal lighting in the park. The Tri-City Auto Dealers are proposing a sign 35 feet in height with 150 square feet of sign area with the Car Country logo on the face of the sign. This includes a rectangular "next exit'' notice on the side of the pole. The diameter of the logo part of the sign is 12 feet. In addition to the agreement that staff has reached with'Mr. Knauf, it will be necessary for the Tri-City Auto Dealers' Association to obtain a coastal permit-. A condition should be attached which requires the elimination Of one of Dixon Ford's two existing signs.. Council Action - See next page I ' Page 2 of Agenda Bill #3763 September 7, 1976 I- Counci 1 Action: 9-7-76 It was moved that the Council approve the Car Country sign to be con- structed in accord with the photograph on file in the Office of the City Clerk; the total sign area not to exceed 150 square feet in- cluding the "next exit" portion; provisions for electricity and ease- ment are approved in accord with Mr. Knauf's letter of August 23, 1976; the freestanding sign advertising Ford Trucks at Dixon Ford be removed; and the existing Car Country sign be removed. The Tri-City Auto Dealers' Association (Car Country) will pay all metered electrical charges from San Diego Gas and Electric to energize the lights and timers in the city park located on Lot 11, Carlsbad Tract 72-3. The meter will be listed in the name of the Tri-City Auto Dealers' Associa- tion. Our office will draft a formal agreement. 2. In return for payment of the electrical utility charges, the City will grant an easement across Lot 11 appur- tenant to Lot 10 (Dixon's lot) to install and maintain an underground electrical conduit from the electric meter on Lot 11 to the northwest boundary of Lot 10. The City will furnish us with a legal description of the easement which will be five feet wide and generally follow the north and west boundary lines of Lot 11. A map to be attached to the easement document will also be furnished indicating the easement location. Our office will draft the grant of ease- ment document. 3. The free-standing sign as prescribed in paragraph 5 of the Specific Plan (Ordinance No. 9288) will be energized by the electricity from the easement conduit. Such sign is Mr. Bill Baldwin -2- August 23, 1976 I to be located on the northwest corner of Lot 10 and will be 35 feet high with 150 square feet of sign area with the Car Country logo on the face of the sign. This includes a rectangular "next exit" notice on each side of the pole. The diameter of the logo part of the sign is 12 feet. A picture of the rendering of the proposed sign will be furnished to you for your file within a week. If you desire further information before the formal docu- ments are drafted, please inquire. The following conditions shall apply with respect to any development after the effective date of this ordinance of the property described in Section 1 hereof. 1. That the proposed'alignment and location of a north-south road between Cannon Road and Palomar Airport Road shall be subject to approval by the City of Carlsbad. 3. That the alignment and location of the north-south road shall be set as a portion of a first phase specific plan. Any approval for the alignment of the 84' street shown on the applicant display is not implied at this time. 4. That City staff shall participate in the overall design of the 50-acre automobile center. 5. That signing shall be limited to one free-standing freeway- oriented sign, 35 feet in height, not to exceed 150 square feet; the location and sizes of on-site signs advertising the produce shall be subjectsto strict architectural review and in no case shal' they exceed requirements set forth in the City of Carlsbad Sign Ordinance No. 9224. 6. That all lighting fixtures shall be a metallic vapor and quartz variety ( no flourescent arm-type,fixtures) and subject to strict architectural control. 7.
