Statement of the Matter The City Council at your meeting of September 7, 1976, directed the City Attorney to prepare the necessary documents denying approval of the requested change of zone from R-l to R-2 on property located on the north side of Chestnut Avenue between Adams Street and Eureka Place (Case No. ZC-181). The resolution denying approval is attached. "4014 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A * REQUESTED CHANGE OF ZONE FROM R-l TO R-2 FOR PROPERTY LOCATED ON THE NORTH SIDE OF CHESTNUT AVENUE BETWEEN ADAMS STREET AND EUREKA STREET (ZC-181). APPLICANT: JAMES B. MAGUIRE, JR. WHEREAS, on August 11, 1976, the Carlsbad Planning Commission adopted Resolution No. 1266 recommending that ZC-181 be approved; and WHEREAS, the City Council on September 7, 1976, held a public hearing on the proposal; and WHEREAS, a negative declaration has been filed on the proposal which has complied with the Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That ZC-181 is denied for the reason that the City Council finds it inappropriate to consider the rezoning of one lot to R-2 when it is surrounded on all sides by R-l property. C. That said denial is without prejudice in the event the proposed rezoning can be presented together with an application for similar rezonings of the surrounding properties.
