Chase (Chase Financial) Statement of the Matter On September 17, 1974 the City Council, by Resolution No. 3510, approved the tentative map of Carlsbad Tract 74-7. On October 21, 1975 the City Council, by Resolution No. 3762, approved the Tentative Map Extension of Carlsbad Tract 74-7. The owner has requested that the subject Tentative Map be extended for a period of one year, to September 17, 1977. The City Engineer advises that the Planning, Engineering, Fire, Building Departments, C.M.W.D. & L.C.W.D. have been contacted to determine if they have any objections to the extension of the Tentative Map. Having received no objections, it is recommended that the City Council approve the extension of the Tentative Map subject to the execution and/or fulfillment of all the conditions of Resolution No. 3510 and 3762. The national economy has prevented us from being able to obtain construction financing for our proposed plan, and, hopefully, we will be able to obtain this financing and get the project under way during this new extension herein applied for today. APPLICANT: BARRIE F. CHASE WHEREAS, on the 13th day of August, 1974, the Carlsbad City Planning Commission adopted Resolution No. 1089 recommending to the City Council that Tentative Map (CT 74-7) be conditionally approved; and • WHEREAS, the City Council of the -City of Carlsbad, on the 3rd day of September , 1974, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance witii the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 74-7} is hereby approved sub- ject to all applicable requirements of the Carlsbad Municipal Code .and to the satisfaction of the following conditions: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth'herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and state and federal_. statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. 2. The CC&R's for this development shall be submitted to the Planning Director for review and approval prior to the issuance of any building permits. 3. Park-in-lieu fees shall be granted to the City prior to City Council approval of the final map. 4. All public improvements shall be made in conform- ity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City standards to the satisfaction of the City Engineer without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respec- tive service districts. 6. All drainage and grading plans shall be submitted to the City Engineer for consideration and approval. 7. All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely .concealed from view. * C. That said Tentative Map, together .with the provisions for its design and improvement and subject to the above condi- tions, is consistent with all applicable general and specific plans of the City of Carlsbad. APPLICANT: BARRIE F. CHASE, WHEREAS, the City Council of the City of Carlsbad, on the 17th day of September, 1974, adopted Resolution No. 3510 approving, with conditions, Tentative Map (CT 74-7); and WHEREAS, the subdivider has requested a one-year exten- sion of such map from September 17, 1975 to September 17, 1976; and WHEREAS, the City Council has determined to extend such map subject to additional conditions; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 74-7) is hereby extended, subject to the execution and/or fulfillment of all the conditions of Resolution No. 3510 and the following conditions: t» ~ 1. The applicant shall submit a landscaping and irrigation plan to the City Engineer for those slope areas and landscaping areas which are adjacent to proposed public rights- of-way for his approval prior to the approval of the final sub- division grading plan. Said plan shall include a statement of installation phasing, and shall include landscaping that will satisfy erosion and fire hazard controls. 2. The applicant or his successor in interest shall maintain all landscaping to the satisfaction of the City Engineer and Parks and Recreation Director.
