Atty DEPARTMENT.-_ CitY_AttorneY , C* Subject: GPA-42 - AMENDMENT TO THE GENERAL PLAN LAND USE TEXT AND PLAN B tat gmen_t of the M a 11 e r The City Council at your meeting of October 5, 1976 directed the City Attorney to prepare the necessary documents approving an amendment to the General Plan (GPA-42), making certain minor revisions in the text and to change the land use designation on a 1.7 acre area of the City of Carlsbad General Plan. The resolution approving said amendments is attached. BIONDO, JRNEY • CITY OF C1200 ELM AVENUEBAD, CALIFORNIAIF "> f- a:< < u 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 , 3, RESOLUTION NO. 4026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN (GPA-42) TO MAKE CERTAIN MINOR REVISIONS IN THE TEXT AND TO CHANGE THE LAND USE DESIGNATION ON A 1.7 ACRE AREA OF THE CITY'S GENERAL PLAN. WHEREAS, the Planning Commission did "on the 8th day of September, 1976, hold a duly noticed public hearing as prescribed by law to consider amendments to the General Plan making minor amendments and additions to the Land Use Element Text and Land Use Plan; and WHEREAS, an Environmental Impact Report was certified as complete for a previously issued entitlement for this project, and the Planning Director has found General Plan Amendment (GPA-42) to be in prior compliance with the City of Carlsbad Environmental Protection Ordinance of 1972; and WHEREAS, the City Council has held a duly advertised public hearing to consider said amendments and has received the recom- mendations, objections, protests and comments of all individuals and parties who desired to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That the findings of the Planning Commission as set forth in Planning Commission Resolution No. 1270 constitute the findings of the City Council. - C. That the textual and land use elements of the General Plan are amended as follows: 1. On Page 27, Section f, Subparagraph (2) delete the present definition of "Traffic Dependent Commercial". 3. On Page 26, Section f, delete the words, "and Traffic Dependent" in the heading and the following sentence: "This classification of land use can be divided into two categories: Travel Services and Traffic Dependent Commercial". Also, delete symbol "(1)" from description of Travel Services. 4. On Page 21, under "Commercial" classification, delete the words "and Traffic Dependent" from Travel Service and Traffic Dependent Commercial. 5. A 1.7.acre area on the Land Use Plan is amended from "TS" to "RS" as outlined on Exhibit 1, dated September 8, 1976, and attached hereto and made a part hereof. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 26th day of October , 1976, by the following vote, to wit: AYES: Councilmen Frazee, Lewis, Packard, Skotnicki and CounciIwoman Casler NOES: None ABSENT: None ^/^) ROBERT C.
