Atty.\J DEPART14ENT: PLANNING C. Mgr. S ubj ect: APPLICATION FOR OPEN SPACE SUBVENTION PAYMENT Statement of the Matter - The Open Space Subventions Act of 1972 (Gov_. Code Sec. 16140 et seq.) provides for "replacement revenues to '10c41 government by reason of the rj(uction of the -property -tax- on.open-space lands assessed under Sections 423 and 423.5 of .he Revenue and Taxation Code (enforceable restrictions)." The process for making application for these subvention revenues is prescribed in the California Administrative Code (Section 14100 et seq.). One necessary item for the application report is "a resolution by the governing bAdy authorizing the filing of the report and designating an authorized representative." A draft resolution that meets these requirements is attached for your consideration. It should be noted that the application must De filed with the State on or before Octo- ber 31, 1976. I RESOLUTION 6a029 9 RESOLUTION OF THE•CITY COUNCIL, CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING 3 THE FI'LI'NG OF AN APPLICATION FOR THE STATE OPEN-SPM E SUBVENTION REVENUES 4 AND DESIGNATING AN AUTHORIZED REPRE- SENTATIVE. 5 6 WHEREAS, on February 17, 1976, the City Council did establish 7 an agricultural preserve on approximately 345 acres of prime agri- 8 cultural land within the City of .Qi rlsba"d; and `9 WHEREAS; on February 17, 1976; the City Council also approved 10 the execution of a Land Conservation Contract between the City and 11 the owner. of the property placed into said agricultural preserve; 12 and 13 'WHEREAS, said contract constitute§ an enforceable restriction 14 for purposes of the County Assessor when valuating the property for 15 tax purposes; and 16 WHEREAS, said restricted valuation resulted in a reduced total 17 valuation for the City, and, subsequently, reduced tax revenues to 18 the City and other affected taxing agencies; and 19 WHEREAS, the State through the Open -Space Subventions Act of 20 1972 has provided for partial replacement revenues to local govern-. 21 meet by reason of the reduction -of the property tax on open -space 22 lands assessed under an enforceable restriction; and 23 _ WHEREAS, the State has prescribed regulations to be followed 24 in applying for State payments for eligible land under enforceable 25 restrictions; and •26 WHEREAS, the City desires to make application for said payments. 27 NOW, THEREFORE, BE IT RESOLVED that the City Council of the 28 City of Carlsbad does hereby authorize the filing of an application 1 for open -space subvention revenues as prescribed by law; and 2 FURTNER BE IT RESOLVED that the City Council does hereby � 3 design the City Manager as its authorized representative in 4, the preparation and filing of said application.* 5 PASSED,APPROVED AND ADOPTED at an adjourned regular meeting 6 of the Carlsbad City Council held on the 26th day of October 1976 7 by the following vote, to wit: 8 AYES: Councilmen Frazee, ',Lewis. -Packard, Skotnicki and Councilwoman.Casler 9 NOES: alone T 10 ABSENT: None 11 ABSTAIN: None 12 13 Robert C.
