Mgr•-4Subject:REQUEST TO PURCHASE CITY OWNED PROPERTY/ELM' AVENUE Statement of the Matter Council will recall negotiations between the City and David Ellsworth in connection with the parcel owned by the City which adjoins the Ellsworth property. The Ellsworth property was sold to another developer who wishes to negotiate the purchase of the same City owned parcel. The developer feels that the shape of his parcel does not lend itself to the best development without the City parcel requested. An appraisal made in July, 1974 for this parcel was $17,500. The size of the parcel is approximately 4,940 sq. ft. Staff is of the opinion that the present market value would be around $19,000 and would recommend a sale at this figure if Council wishes to declare this parcel surplus. Council action 11-16-76"" The Council declared the property as surplus and referred the matter to staff for processing, requesting an updated appraisal of the property. Kern &Herold Inc. NO. 312625 September 20, 1976 Mr. Paul Bussey City Manager City of Carlsbad 1200 Elm Avenue Carlsbad, CA 92008 Dear Paul: It is our intent to initiate the first phase of development of our Carlsbad Professional Center to be located on Elm Avenue on the property previously owned by Mr. David Ellsworth. As we continue to evaluate the physical features of our development as it affects the frontage on Elm Avenue and the property to the West, it becomes very evident that the physical shape of our property hinders the efficient development of the project and leads us to believe that appropriate steps now may eliminate potential design problems to be faced on the City owned property to the West. Therefore, we have concluded that an appropriate approach to the solution of this situation would be the acquisition of that 50' X 100' parcel of land located at the Northwesterly corner of our property from the City. We under- stand from Mr. Ellsworth that discussions and negotiations were commenced with the City regarding the acquisition or lease of that property by him. We would appreciate being able to resurrect those negotiations so that the ultimate sale or lease of this property may be obtained by us at the earliest possible time. Please accept this correspondence as our official request to you for the reinstatement of those negotiations. I would appreciate your advising me of the procedure required to consummate this transaction, and would be delighted to meet with you or the City Council at your convenience to discuss the matter further.
