Statement' of the Matter
On November 22, 1976, the Planning Commission recommended apDroval of sub,ject 211 lot subdivision map, which is situated east of Rancho San Road, between La Costa Avenue extension and Olivenhain Road.
The Planning Commission approval contained the conditions as listed i attached staff report with the followinq chanqes:
Amend Condition 5(a) to include additonal lots for maintenance.
Combine Condition 7 and 8 into one amended Condition (Number 7 of Res permits a variety of methods to be used for maintenance of slopes.
Amend Condition (Number 17 of Reso) to Dermit more time for applicant school district to work on agreements for the High School site.
Add a Condition (Number 31 of Reso) that requires the applicant to in permanent landscaping and irriqation on slopes situated on the High S
site and its maintenance.

Staff recommends that CT 75-9 be APPROVED because of the followin< findings and subject to the following conditions:

The fina? map shall be submitted for approval within ei- months from the date of final action by the City Council, and sh in substantial conformance with the tentative subdivision map, E "A" .

(2) ‘Street names shall be designated in accordance with City Council Policy 20 and shall be a.pproved by the Planning Director prior to approval of the final map.
(3) Concurrent with final map approval, the applicant shall grant an open space easement for maintenance and improvement purposes over
those portions of those lots described in Condition 5 below.
(4) Prior to the issuance of grading permits, the City Engineer shall
. approve a plai? submitted by the applicant for interim erosion con1 on all man-made slopes in excess of five feet created by ’chis sub-
division, Prior to this issuance of grading permits, the applicar shall post bonds and a.greements ensuring the installation and mair tenance of the erosion control system until permanent landscaping is installed and maintained.
(5) Prior to the issuance of any building permits, the applicant shal’
submit a permanent landscaping and irrigation p?an to the Parks and Recreation Director for his approval. The plan shall:
(a) Cover those slopes at the rear of lots 2-19, 44-48, 169-174, and the sides of lots 44, 58, 74, 121-122, 154, 160, 174-175 18.5, 198, and 211;

DISCUSSION
Park Site:
The La Costa Master Plan has designated an area across Mission Estancia from the proposed subdivision for a 283- acre conimunity park site. The parks agreement between the applicant and the City requires the dedica
of a 12.5 acre portion of that park site with this subdivision. (Note Exhibit "A" as printed shows a 5.5 acre site). Staff has inspected th 12.5 acre portion proposed for dedicat-ion at this time and believes it
acceptable. The site includes the old adobe remains of the stage coac stop, a stand of larger trees and some flat areas for active recreatio
High School Site:
The San Dieguito Union High School District, in the attached letter of November 12,- 1976, has requested the inclusion of the high school site this tract map.
The Public Facilities Element of the General Plan requires that public facilities, including schools, be available to developing areas concur with need. The affected High School District, through its letter, has
indicated its need for the site with this subdivision. Planning Staff therefore recGmmends the inclusion of the site in the subdivision at t time.
The State Map Act allows local government to require the dedication of
elementary school sites as required by Boards of Education (Section 66 et seq.). The Act does not include High School sites in this section, however. In the absence of specific state enabling legislation, staff worded Condition 18 to reflect the same time constraints as the Map Ac
puts upon elementary school sites.
Should the High Schocl District not reach an agreement with the applic
within 30 days of final council action on the tentative map, then the map would not need include the High School site. The site would remai
cornmiLted to ultimate High School use through the General Plan Land Us Element and La Costa's Master Plan.
Slope Maintenance:
The proposed subdivision will require a fairly substantial amount of grading (approximately 3,200 cubic yards per residential lot). This grading wiil result in manUfdCtUred slopes adjacent public rights-of- way, and adjacent a future open space (lots 171-174).
