Subject: SPEED ZONE: CARLSBAD BOULEVARD (TIERRA DEL ORO TO MANZANO DRIVE) Statement of the Matter On the basis of an engineering and traffic survey, the Traffic Safety Commission recommended that a 45 m.p.h. speed zone be established on Carlsbad Boulevard, from Tierra del Oro to Manzano Drive, to replace the existing 35 m.p.h. Establishing a consistent speed zone on all of Carlsbad Boulevard, from the Agua Hedionda Lagoon Bridge southerly to Manzano Drive, will enable the Police Department to use radar enforcement and will not qualify the speed zone as a "speed trap" as defined by Section 40802 of the California Vehicle Code. EXHIBITS: a. Ordinance No. V,46— b. Speed zone survey (data in Engineering Department) RECOMMENDATION: That the City Council introduce Ordinance N0.3/46f' establishing a legal prima facie speed zone on the above section of Carlsbad Boulevard for first reading. Council action 12-21-76 The matter was returned to staff for findings that there are special conditions existing to justify a 35 MPH zone on the section of Carl.�uad Blvd. from Manzano Dr. north to the bridge. 1 ORDINANCE NO. 3105 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 3 10.44, SECTION 10.44.030(c) OF THE CARLSBAD MUNICIPAL CODE TO ESTABLISH A PRIMA FACIE SPEED 4 LIMIT ON A PORTION OF CARLSBAD BOULEVARD 5 6 The City Council of the City of Carlsbad does ordain as 7 follows: 8 That Title 10, Chapter 10.44, of the Carlsbad Municipal 9 Code is amended by the amendment of Section 10.44.030(c) to read 10 as follows: 11 "10.44.030 Carlsbad Boulevard (c) Upon Carlsbad Boulevard 12 between the northerly boundary of the right of way of Tierra del 13 Oro and the southerly boundary of Manzano Drive, the prima facie 14 speed limit shall be forty-five miles per hour. 15 EFFECTIVE DATE: This ordinance shall be effective thirty 16 days after its adoption, and the City Clerk shall certify to the 17 adoption of this ordinance and cause it to be published at least 18 once in the Carlsbad Journal within fifteen days after its 19 adoption. 20 INTRODUCED AND FIRST READ at a meeting of the Carlsbad 21 City Council held on the day of _ , 1976, and 22 thereafter 23 PASSED AND ADOPTED at a meeting of said City Council hold 24 on the day of , 1976 by the following vote, 25 to wit: 26 AYES: 27 NOES: 28 ABSENT: 2s ROBERT C.
