Statement of 'the' Ma.tter
Chapter 11.08 of the Municipal Code authorizes the formation of
Underground Utility Districts for the purpose of removing over-
head utilities and placing them underground.
The City has processed five Underground Utility Districts in the
past seven (7) years. These Districts were formed in accordancc
with Chapter 11.08 of the Municipal Code after recommendations
were made by the Carlsbad Downtown Businessmen's Action Committc
This organization has been disbanded and no Advisory Committee
exists to make recommendations to the City Council on future underground utility districts.
The League of California Cities and the Utility Companies have advocated that an Underground Utility Advisory Committee should be composed of the following representatives:

UNDERGROUND UTILITY ADVISORY CObIIMiTTEE
Kormally, agencies consult with utilities (as re-
quired by Rule 3l.A) through the vehicle of an Undergrjund Utility Advisory Committee. The Formatim of the Comrfittee is stmngly advocated by the League of California Cities and
utility companies.
The Committee is normally established by the City Council or BDard of Supervis3rs and is an advisory board ix
that body. Membership nay be composed .of the Director 3f Public WDrks (Chairman), Director of Planning, City Manager, and representatives from electric and communication utilities.
S9me agencies include Director gf Parks & PecreatiDn; :elected Dfficials and representatives of sewer and water agencies.
Appendix A is a model resolution to form the Committee.
To select projects, the Committee should survey
the area to deternine which overhead lines meet the criteria
of the rule. A rzting system should then be employed t3
evaluate the projects. FactDrs that should be included are traffic count, property 3wner participation (Rule 31.B),
contiguous to existing undergnund syqtem, street improve-
ment project, sceni-c 3r recreation area, etc.
Note: Streets that have n5t been improved to ul-
timate width should not be included to anid future expen-
sive relocation of: .underground electric facilities. The cDst of this work w3ul.d nDrmally be paid fQr by the abutting Dm- perty owner when hie developes his prDperty and cDnstructs the ultimte improvements which would add an unusually large cost
burden.

is used in the preparation of a multi-year program which is sent to the governing body for approval.
Committee preparation of individual underground dis tricts should start about one year prior to c2mmencing con- struction.' The conversion flow chart (Appendix B) should be
followed to ensure tinely c3mpletiDn of the project. There

MEMORANDUM

SUBJECT: Underground Utility Advisory Committee
On October 17, 1967, the California State Public Utilities
Commission issued Decision No. 73195 which sets forth General Order 128 of the Public Utilities Commission regulations. This
order requires the Electric Utility Company to set aside 2% of
its revenues for the express purpose of converting overhead
facilities to underground.. The conversion funds are allocated to City and County Governments by a formula dependent largely on the number of meters within the jurisdiction.
The electric utility will proceed with the conversion at its
own expense provided that:
1. The governing body of the City after consultation with the utility and after holding public hearings on the subject has determined that the undergrounding
is in the general public interest.
2. Adopted resolutions establishing an underground dictrict.
On August 20, 1968, the City Council passed Ordinance No. 7037 establishing regulations and procedures for the removal of overhead utility facilities and the installation of underground
facilities in Underground Utility Districts. This ordinance is now Chapter 11.08 of the Municipal Code.
Although Chapter 11.08 of the Municipal Code does not require an advisory committee, the technical and legal aspects of a conversio district requires that the council be properly advised prior to establishing a conversion district. All cities in the State of California which have an active conversion program follow the League of California Cities and Utility Company recommended
committee makeup.
