Statement of the Matter
The City Council, at your meeting of January 4, 1977, directed
the City Attorney to prepare the necessary documents approving
Zone Change (ZC-184). The resolution approving and the
ordinance adopting the zone change are attached.

Recommendation
If the Council desires to approve and grant the change of zone,
your action is to adopt Resolution No. ^£ f <? and introduce

1-18-77 Resolution #4079 was adopted, announcing findings and decision,
and Ordinance #9475 was introduced for a first reading granting
a change of zone from R-l-7500 to R-P-Q.
2-1-77 Ordinance #9475 was given a second reading and adopted.

Information on the affect of zoning on site
and adjacent property values.
At the meeting on January 4, 1977 the City Council referred ZC-184
back to the Planning Commission for information concerning the
effect of the subject zone change (specifically the City request),
on property values.
The City Manager's office has checked with local appraisers and has
informed staff that the General Plan and existing land use determine
land values. Therefore, there should be no effect on the sale or
purchase prices of property involved in the zone change or on sur-
rounding property. All property involved in the zone change requests
(City and Minnich) reflect the appropriate General Plan designations
for consistency. Existing City government facilities reflect an
establishedlanduse.s
Staff, therefore, recommends that the Planning Commission return
ZC-184 to the City Council with a recommendation of approval as pre-
viously submitted.

CITY OF CARLSBAD', CALIFORNIA, ANNOUNCING
3 FINDINGS AND DECISION REGARDING CHANGE OF
ZONE (ZC-184) FROM R-l-7500 to R-P-Q
4 (RESIDENTIAL PROFESSIONAL WITH QUALIFIED
OVERLAY ZONE). APPLICANT: K. DAVID

6 WHEREAS, on December 8, 1976, a duly advertised public hearing
7 was held before the Planning Commission in the manner prescribed
8 by law to consider a change of zone from R-l-7500 to R-P-Q
9 (Residential Professional with Qualified Overlay zone) on property
10 as shown on map marked ZC-184, Exhibit "A", attached hereto and
11 made a part hereof; and
12 WHEREAS, at the conclusion of said hearing the Planning
Commission of the City of Carlsbad adopted Resolution No. 1303
'^sf 14 recommending said zone change which is herewith referred to and
t <t 15 made a part hereof; and
16 WHEREAS, on January 4, 1977, the City Council held a public
17 hearing on the matter, received all recommendations and heard
18- all persons interested in or opposed to the proposed change of
19 zone; and
20 WHEREAS, the Planning Director has determined that said
21 change of zone will have a nonsignificant impact on the environment
22 and' a Negative Declaration has been prepared and filed in satis-
23 faction of the requirements of the City of Carlsbad Environmental
24 Protection Ordinance of 1972 and the California Environmental
25 Quality Act;
26 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
27 City of Carlsbad as follows:
28 1. That the above recitations are true and correct.

2. That the findings of the Planning Commission contained
in the aforementioned Resolution No. 1303 constitute the findings
of the Carlsbad City Council.
3 . That the approval of the proposed change of zone
classification is necessary to carry out the general purpose of
Title 21 of the Municipal Code.
4. That the City Council of the City of Carlsbad intends
to adopt an ordinance to effectuate the proposed change of zone.
PASSED, APPROVED AND ADOPTED at a meeting of the City
Council on the 18th day of January , 1977,. by the following
vote, to wit:
AYES: Councilman Frazee, Lewis, Packard and Skotnicki
NOES: None

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD,' CALIFORNIA, AMENDING
TITLE 21 OF THE CARLSBAD MUNICIPAL CODE
BY AMENDING THE ZONING MAP TO GRANT A
CHANGE OF ZONE (ZC-184) FROM R-l-7500
TO R-P-Q (RESIDENTIAL PROFESSIONAL WITH
QUALIFIED OVERLAY ZONE). APPLICANT:
K. DAVID MINNICH.
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is amended
by the amendment of the zoning map to grant a change of zone (ZC-184
from R-l-7500 to R-P-Q (Residential Professional with qualified
overlay zone) on property as shown on map marked ZC-184, Exhibit "A1
attached'hereto and made a part hereof.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a meeting of the Carlsbad City
Council held on the 18th day of January , 1977, and thereafter
PASSED AND ADOPTED at a meeting of said City Council held on
the 1 st day of February 1977, by the following vote, to wit:
AYES: Councilmen Frazee, Lewis, Packard, Skotnicki and
Councilwoman Casler
NOES: None
ABSENT: None
