"\ ') Subject:REQUEST FOR CODE AMENDMENT REGARDING OPEN-SPACE AND RECREATIONAL VEHICLE PARKING IN PUD REGULATION-CHAPTER 21.45. Statement of the Matter Mr. Bob Ladwig of Rick Engineering has requested that provision of the PUD regulation be amended to: 1) Provide for PUD Open-Space credit in areas designated as Open-Space in a Master Plan in the P-C Zone and; 2) Permit Recreational Vehicle Storage within a Master PLan but off-site of the PUD. Staff reviewed Mr. Ladwigs suggested changes and found general agreement with Mr. Ladwigs concerns, but staff has suggested different wording to accomplish the same intent. In addition, staff has suggested changes to the Recreational Vehicle Storage section to accommodate what we preceive as possible problems. Council action 1-18-77 The Council concurred with- the changes outlined in Exhibit "A", the City Attorney was directed to prepare the necessary documents, and" the matter referred to the Planning Commission for public • hearing. MEMORANDUM December 16, 1976 TO: CITY MANAGER FROM: PLANNING DEPARTMENT RE: AMENDMENT TO PUD ORDINANCE Recently Bob Ladwig of Rick Engineering submitted a list of sug- gested amendments to the PUD Ordinance to benefit PUD developments in the P-C Zone. Basically the amendments are to provide Open- Space credit in a PUD for the Open-Space and Public Parks that are provided for in a Master Plan of the P-C Zone. Planning Staff has reviewed these suggestions and generally find them acceptable. However, any provision for credit must be in agreement with the intent of the Open-Space requirements of the P-C Zone and the Public Park Policy. Staff believes if the changes are acceptable, they be modified to insure the intent of the Open- Space requirements of the PUD and P-C Zone are met. The intent of the Open-Space in the P-C Zone, is to give an overall plan for parks, natural areas, open-space, private recreation, etc., for a Master Planned area as a whole; this includes single family residential as well as PUD. The Open-Space in the PUD is to give additional Open-Space above the minimum requirements in lieu of the relaxation of normal development requirements in the R-Zones, i.e., private yards, setbacks, public improvements, etc. Therefore, Open-Space of a P-C Zone Master Plan should be distinct from Open- Space in a PUD. However, there may be circumstances where a Master Plan sets aside Open-Space in areas adjacent or near PUD, or a PUD could be pro- posed in an area that is adjacent to Open-Space areas which has more than the normal amount of Open-Space committed to recreation. In these cases staff believes there should be a mechanism to permit existing or planned recreation areas to count in meeting the Open- Space requirement of a PUD. In addition, it is conceivable a PUD could be proposed in any zone, in an area of abandant recreation, i.e., near public parks, beach, private recreation. Therefore, staff suggest credit should be given if there is appropriate usable Open-Space nearby. Therefore, staff suggest that the amendment be broaden to include Open-Space credit in any zone provided the City Council specifically approves the request after making specific findings that it is appropriate in that particular case. These changes are contained in Exhibit A, dated December 16, 1976, attached. -1- **\ Section 1, of Exhibit "A" are staff's suggested changes to storage space requirements. These changes are designated to: 1) To exclude those large lot PUD's; that for all practical purposes are normal single family developments, at least in land use area per lot. 2) Insure that storage areas are exclusively available to the in- habitants of the PUD. 3) That storage space cannot be credited to more than one PUD. Section 2, of Exhibit "A" contains staff's suggestions on Open-Space Credit. To accommodate credit for Open-Space, staff suggested adding para- graph E & F to Subsection: 21.45.120 (9). Proposed (E) will permit the City Council to approve PUD Open-Space in a P-C Master Plan, provided that the area so' designated is in addition to the minimum 15% Open-Space required, and in addition to the Public Parks requirements. Proposed (F) permits the City Council to approve a reduction in the Open-Space required in a PUD in any zone if there is compensatory Open-Space available within a reasonable relationship to the PUD. This Open-Space being used for PUD credit must be in addition to that required by the Public Parks Policy, and if in a P-C Zone, in addition to the required 15% Open-Space. BP:ar Exhibit "A" December 16. 1976 Amendment to Chapter 21.45 Planned Unit Development (PUDT Planning Staff suggest the following changes be made to Section, 21.45.120 Development Standards: SECTION 1. STORAGE SPACE (6) Storage Space. Storage space to accommodate storage of campers, trailers, boats, etc. Shall be provided for planned unit developments containing five or more residential dwelling units, except that PUD lots that have 7500 square feet on greater in land area need not meet this requirement. The area provided for this storage space shall be at least equal to forty square feet for each dwelling unit. The storage space shall be screened from view by a view-obscuring fence, wall or landscaping. The storage space may be offsite provided the property to be used as storage is part of the application for the planned unit development permit and that no other development may occur on this property without an amendment to such permit. Furthermore, the City Council must find evidence that such offsite storage area is suitable and not detrimental to the surrounding properties of such storage area. The storage space shall be located in specifically designated areas and made available for the exclusive use of the residents of the PUD. These designated areas may serve more than one PUD provided there is sufficient space to meet the minimum requirements for each PUD sharing the area. SECTION 2. OPEN-SPACE (9) Usable Open-Space Residential. (A) Common Open-Space areas designed for rec- reational use such as swimming pool, tennis court, golf course, children's playground, picnic area, shall be provided for all res- idential developments based on the density of the project as follows: Amount of Usable Range of Dwelling Units Open-Space Area Per Gross Acre Square feet Per Dwelling Unit Less than 4 600 4 to 9.99 400 10 to 20 200 Greater than 20 100 Areas designed for active recreational uses lo- cated on roofs of buildings or structures but not involving private patios, yards parking areas or storage areas may satisfy the Open-Space re- qui rements. (B) The City Council may require the preservation of scenic natural features such as rock outcropings, creeks, wooded areas, vistas or other features deemed worthy of preservation. Credit for the usable Open-Space requirement may be given on an equal ratio up to fifty percent of the requirement. (C) Commonly owned and maintained Open-Space and recreation areas shall be readily accessible to al1 dwelling units. (D) Provision shall be made to insure that all Open-Space areas will not constitute a health, safety, fire or drainage problem. (E) In the P-C Zone an approved Master Plan may contain Open-Space areas that are specifically des- ignated for use within a PUD provided that the space is in addition to the minimum required by the P-C Zone and Chapter 20.44. (F) The City Council may approve a reduction in the required usable Open-Space requirement within a PUD in any zone if it is found that there is accessable Open-Space, either private or public, that is within the vicinity, and is in addition to the minimum public park area required pursuant to Chapter 20.44, and in the P-C Zones in additon to the recreational facilities required for a Master Plan.
