The surrounding area is in transition from Single Family Residential to Multiple Family Res- idential, and the General Plan indicates Residential Medium High Density, (10-20 Du per acre). FORM PLANNING 73 1 2 5 4 5 6 7 8 9 10 11 12 13 14 15 16 .17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 1310 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY.OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDATIONS RELATIVE TO REZONING PROPERTY FROM R-l-7500 TO RD-M ON PROPERTY LOCATED ON THE WEST SIDE OF FREEWAY 1-5 BETWEEN JEFFERSON AND MADISON STREETS CASE NO. ZC-183 APPLICANT: DAVID KOYL WHEREAS, a verified application for a certain property, as shown on the attached map, has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the "Carlsbad Municipal code;" and WHEREAS, the public hearing to consider the subject rezoning was held at the time and in the place specified in said notice on December 8, 1976, and continued to January 12, 1977; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972;" and WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments, if any, of all persons who desired to be heard, said Commission considered all factors relating to the Zone Change and found the following facts and reasons to exist: 1) The Change of Zone is consistent with the General Plan because a) The proposed residential zone (RD-M) is consistent with the site's Land Use Element designation of Residential Medium-High Density (10-20 dwellings per acre); and b) The Zone Change will have no adverse impact on any other Element of the General Plan. V 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2) The proposed Zone Change is consistent with the Carlsbad Environmental Protection Ordinance of 1972 because: a) An Environmental Impact Assessment of the project has been conducted and negative declaration made for the following reasons: 1) The project site is within an urbanized area in which the natural land forms and vegetation have been inalterably modified; and 2) The project will not significantly increase air pollution,water runoff, traffic or noise in the area. 3) The proposed Zone Change is consistent with applicable City Public Facility Policies and Ordinances because: a) All'required'facilities are currently available to the site. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That the Zone Change from R-l-7500 to RD-M is recommended for approval . January 12, 1977 TO: PLANNING COMMISSION . FROM: PLANNING DEPARTMENT CASE NO: ZC-183 APPLICANT: DAVID KOYL REQUEST: Approval of a change of zone from R-l-7500 to RD-M. Recommendation Staff recommends that ZC-183 be APPROVED because of the following findings.: 1) General Plan Consistency: The proposed zone change is con- sistent with the General Plan because: a) The proposed residential zone (RD-M) is consistent with the site's Land Use Element designation of Residential Medium- High Density (10-20 dwellings per acre). b) The zone change will have no adverse impact on any other element of the General Plan. 2) Envi ronment: The proposed zone change has complied with the requirements of the Carlsbad Environmental Protection Ordinance because: a) An environmental impact assessment of the project has been conducted and a negative declaration made for the following reasons : b) The project site is within an urbanized area in which the natural land forms and vegetation have been inalterably modified; and c) The project will not significantly increase air pollution water runoff, traffic or noise in the area. 3) Pub1i c F a c i1 iiti e s : The proposed zone change is consistent with applicable City Public Facilities Policies and Ordinances because: a) All requires public facilities are currently available to the site. * -1- BACKGROUND REPORT Location and Descri pti onof Property: The 1.38 Ac. (5585 M2) site is located on the south side of Mag- nolia Street between Madison and Jefferson. The site is flat, with a single-family dwelling and several mature trees. Existing Zoning: Subject Property: R-l-7500 North: R-2 South: RD-M East: R-l-7500 West: R-3 Existing Land Use: Sub.iect Pronertv: Single-family residence North: Duolexes South: Anriculture (future Tamarack Shores sub. ) East: Single-Family residences West: Anartment house under construction. History and RelatedCases: The Planning Commission recently aooroved a tenative subdivision map and Specific Plan Amendment for 80 units on land directly to the south (Tamarack Shores). Environmental Imapact Information: The Planning Director has issued a Negative Declaration of non-- significant Environmental Impact for the following reasons: (1) The project site is within an urbanized area in which the natural land forms and vegetation have been inalterably mod- ified; and (2) The project will not significantly increase air pollution, water runoff, tradfic or noise in the area. General Plan Information: The Land Use Element designates the site for Residential Medium- High Density use (10-20 dwelling per acre). The RD-M zone fixes density by the General Plan, assuring conformance when the site is develoned. No other Element of the General Plan is affected by the proposal. \ Public Facilities: The site is within the water and sewer service areas of the City of Carlsbad and is within the Carlsbad Unified School District. -2- Ma.jor P1 anni ng Cons 1 deratj on : . . DISCUSSION Five small' parcels to the east of the project site are also zoned R-l-7500 and designated for RMH use in the General Plan. The City's recent policy has been to initiate a rezoninq of such similar parcels. Staff has not done so in this case because those, remaininq lots are small s and individually do not lend themselves -.-, to multipie-family development. Planninq staff does not feel that rezon.inn the project site by itself would adversely affect the neighborhood. Multiple-family nrojects exist to the west, and the project site is a logical extension of that use. The remaining R-l lots could be consolidated at some future date into one or two lots suitable for multipie-fami 1y re- zoning and development.
