On December 16, 1975 the City Council approved the tentative map extension of Carlsbad Tract 74-21 to January 7, 1977 by REsolution No. 3803. The applicant has requested that the subject tentative map be extended for a period of one year, to January 7, 1978. The City Engineer advises that the Carlsbad Municipal Water District, Buena Sanitation District, and Planning, Building and Fire Depart- ments have been contacted to determine if they have any objections to the extension of the tentative map. Having received no objections it is recommended that the City Council approve the extension of the tentative map subject to the execution and/or fulfillment of all the conditions of Re olution No. 3566, Resolution No. 3803, and Resolution No. &f/ . APPLICANT: DONALD R. LOKER WHEREAS, on November 26, 1974, the Carlsbad City Planning Commission adopted 'Resolution 1119 recommending to the City Council that Tentative Map (CT 74-21) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 17th day of December, 1974, considered the recommendation of the Planning Commission; and WHEREAS, an Environmental Impact Report was certified as complete for a previously issued entitiement for this project, and the Planning Director has found the Tentative Map (CT 74-21) to be in prior compliance with the City of Carlsbad Environmental Protection Ordinance of 1972; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 74-21) is hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1-, The final maps shall be submitted for approval within one year from the final action by the City'Council on the Tentative Subdivj .ion Map. The final map shall be in substantial confornance on the Tentative Subdivi- sion Map known as Exhibit B, dated November 12, 1974. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are _in addition to all the requirements limitations and restrictions of all municipal ordinances and State and federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. 3. Improvement plans for water and sewer systems shall meet the requirements of the respec- tive service districts. 4. All land and/or casements required by this ordi- nance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to approval of the final map unless approved by the City Engineer. 5. All utilities shall be placed underground and/or shall be completely concealed from view. 6. Ornamental street lighting shall be provided for as required by Municipal Code. The developer shall post a bond and/or cash in the amount necessary to energize said street lights for an 18-month period after construc- tion to permit the incorporation of the subdivision into a maintenance district. This shall be done prior to approval of the final map. 7. The improvement plans shall include a report of a geological investigation and a complete grading of the entire site when required by the City Engineer. The report and plan shall be prepared by Civil Enqineers licensed by the State of California and experienced is erosion control. Said engineers shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties. 8. The CC&R’s for this development shall be submitte to the Planning Director for review and approval prior to the approval of final map. 13. The developer shall work with the Carlsbad Municipal Water:District and the City Fire Department in preparing a water master plan for the project. Minimum flow for fire and domestic purposes shall be 6,000 gallons per minute. 14. The applicant shall grant to the City a 10-foot- wide Open Space easement for pedestrian and bicycle purposes adjacent to the future C Street, which is within the piAject boundaries. The applicant shall improve the easement with asphaltic concrete to the satisfaction of the City Engineer. 15. The applicant shall submit a revised tentative map to the City Engineer which shall show the following: a. Interior lot slopes. b. Correct slopes and/or daylight lines at rear c. Palomar Airport Road shall have three median openings: one at the westerly intersection of A Street, one at future C Street and one at the easterly intersec- tion of B Street. The developer shall install traffic signals at the A and B Streets intersections as deter- mined by any future City Council policy and shall provide turn pockets and channelization for eastbound traffic on Palomar Airport Road. This is shown on Exhibit B dated November 12, 1974. 21. The Engineering Department has sent plans and profiles of the sewer to the Utilities Maintenance Depart- ment for review and comment as to depth and alignment. Dear Mr. Allen: Responding to your request of January 21, 1977, our District has the following comments with respect to the renewal request of the tentative map proceedings: 1. By letter dated October 21, 1974, to Mr. Donald A. Agatep, our District set forth specific comments and recommendations regarding the original tentative map. To date all of those comments and recommendations are still applicable. 2. By letter dated December 1, 1975, to the City of Carlsbad - Engineering Department, our District commented once more upon the tentative map and we specifically recommended that you consider modifying the approval by the Planning Commission so that it is very clear to all parties that the Carlsbad Municipal Water District will require a comprehensive engineering study for a master plan for public water service for the entire holdings of the property prior to any final approval of a final tract map of any portion thereof. At this time our basic position has not changed with respect to proposed development and we wish to re-emphasize the important need for a complete engineerinq study to develop a public water system facility master plan for the entire area.
