CALIFORNIA 81400 061-5298 - 872-1741 Greetings: We, Goldrich, Kest & Associates, are owners and developers of a project located on the corner of Jefferson Avenue and Tamarack Street. It has been brought to our attention that you intend to increase the afore- mentioned fees. Subject increase is of great concern to us in as much as it would amount to a great deal of money. The subject development has obtained discretionary approvals; that is, it has obtained Coastal Commission approval, Special Plan approval, and Tentative Subdivision Tract Map approval. At the present time, the Bureau of Engineering of the City as well as the Building Department are processing the final engineering and architectural plans. Should the subject increase be charged to our project, it would have a great economical impact on the development and could possibly jeopardize it as such. It is our understanding that under normal circumstances the new rates would become effective 30 days after the adoption of same. It is our opinion that such an early effectuation date would be unfair not just to our development, but to the many developments that are in similar situations now being processed through the City. In my discussion with the Staff of the City a possibility of "date certain'' type of effectuation has been brought up. This form of effectuation of the new rates would exert an inordinate pressure upon the various City develop- ments in as much as the developers of developments that are presently being processed or even being filed would try to push them through the process much quicker so as to meet the "date certain" deadline. + / - t - Honorable Mayor and Ci,, Council .City of Carlsbad March 9, 1977 If we may suggest, the fairest way of effectuating such a rate increase would be to apply same to developments not yet submitted for approval or, at least, to those developments not yet approved. We hope this letter will aid you in deciding on a method of effectuating the new rates. Should you have any questions, I would be more than glad to answer them. WHEREAS; the City Council of the City of Carlsbad, Cali- fornia, finds that the sewer connection fees established for the City of Carlsbad are inadequate; and WHEREAS, said Council finds that the connection fees hereafter set forth are reasonable and are required in the public interest; NOW, THEREFORE, the City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: Title 13, Chapter 13.08 of the Carlsbad .. Municipal Code is amended by the amendment of Section 13.08.080 and Section 13.08.085.to read as follows: "Section 13.08.080 Sewer Connection Fees. Except as ?ereinafterprovided, every person who connects one or more living units to the City sewer system shall pay'the City,-prior. to the issuance of a sewer connection permit, a connection fee of five hundred dollars per living unit. fees shall be placed in the joint sewer construction fund and All sewer connection shall be used to pay for capital improvements of said system. For a period of five years from June 30, 1974 the fee for a living unit or occupied mobile home space in existence and within the City limits on or before said date shall be fifty dollars, providing the connec;tion to the sewer system is completed within said period. (b) It shall be unlawful for any person to connect to the City sewer system without first obtaining a valid sewer connection permit. . (c) Every permit issued pursuant to this section shall expire by limitation and become null and void if work on the connection authorized by such permit is not commenced within sixty days from the date of issyance of such permit, or if such work is suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommenced a new permit shall be first obtained and the fee .. therefore shall be two hundred fifty dollars, provided that , such suspension or abandonment has not exceeded one year. I' EFFECTIVE DATE: This ordinance shall be effective 30 days. after adoption. The City'Clerk of the City of Carlsbad shall certify to the adoption of this ordinance and cause it to be published once in the Carlsbad Journal within Fifteen days after its adoption.
