APPROVAL OF FIVE (5) MINOR AMENDMENTS TO THE LAND USE ELEMENT PLAN OF
THE CITY OF CARLSBAD GENERAL PLAN (GPA-43)

On February 9, 1977, the Planning Commission held a duly noticed public hearing and rec-
ommended approval of five minor amendments to the Land Use Element as outlined in the
attached Staff Report. The only questions or comments on these amendments dealt with
Areas #3 and #4.
On Area #3, it should be noted that the original offer of dedication was for park purposes.
However, that condition was removed upon final dedication. There is presently no deed
restriction on this property. It is proposed as Open Space ("OS") designation on the Land
Use Element in response to City Council direction.
On Area #4, there was a question from SDG&E as to what effect the "TS" designation would
have on the property. Staff has discussed this with their representative, pointing out
that the existing zoning is C-2 and has a current Specific Plan on the property for dev-
elopment of a service station. Also, the property, is located within the pending boundaries
of the "Agua Hedionda Specific Plan." After this discussion, they appeared to be satisfied
with the "TS" designation.

Recommendation:

RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CARLSBAD RECOMMENDING
TO THE CITY COUNCIL APPROVAL OF AN
AMENDMENT TO THE LAND USE ELEMENT OF
THE GENERAL PLAN.

WHEREAS, a verified application for certain property, as shown on the
attached map, has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request as provided
by Title 21 of the "Carlsbad Municipal Code;" and
WHEREAS, the public hearing was held at the time and in the place
specified in the public notice on February 9, 1977; and
WHEREAS, the applicant has complied with the requirements of the City
of Carlsbad's Environmental Protection Ordinance of 1972 because:
a) A Negative Declaration of Nonsignificant Environmental Impact has been
issued for the following reason:
1) Boundary adjustments are needed to remain consistent with the
General Plan Text.
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard,
said Commission considered all factors relating to the General Plan
Amendment and found the following facts and reasons to exist:
1) The limits of the "Special Treatment Area" designation
around the Agua Hedionda Lagoon have been enlarged to
encompass the planning area boundaries of the Agua Hedionda
Specific Plan; and
2) This Land Use Amendment is basically administrative and will- have
an insignificant impact on the environment.
3) The changes in GPA-43(1) are already included in the text of the
Land Use Element and being included for the sake of clarity
and consistency.

City of Carlsbad as follows:
A) That the above recitations are true and correct.
B) That in view of the findings heretofore made and considering the
applicable law, the decision of the Planning Commission is to approve
