Hatter The original application was for a change of zone on one lot situated , on Pio Pico Drive between Oak and Pine Avenues (Parcel 30). Staff contacted other property owners of a small lot (Parcel 31) which is on the corner of Pine and Pio Pico Drive and surrounded by Parcel 30. They were agreeable to the addition of their property to the change of zone request. The original application requested a change of zone from R-3 to R-P; however, staff recommended that the Qualified Zone be placed on these properties to coordinate development between them and to better assure proper development and access design of the properties. It is recommended that the City Attorney be directed to "prepare documents approving ZC-187 as per Planning Commission Resolution No. 1328 for •a change of zone from R-3 to R-P-Q. Council Action: . 3-1-77 -The City Attorney was instructed to prepare the documents necessary for approva-1 of Zone Change (ZC-187) in conformance with Planning Commission Resolution No. 1328, as recommended by the staff. FORM PLANNING 73 1 PLANNING COMMISSION RESOLUTION NO. 1328 2 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING - 3 FORTH ITS FINDINGS AND RECOMMENDATIONS RELATIVE TO REZONING PROPERTY FROM R-3 TO 4 RESIDENTIAL-PROFLSSIONAL-QUALIFIED (Rr-P-Q) CASE NO.: ZC-187 5 APPLICANTS: RONALD BONAGUIDI, WAYNE LILL AND BOB NEELY .6 7 WHEREAS, a verified application for a certain property, 8 as shown on the attached map, has been filed with the City of 9 Carlsbad and referred to the Planning Commission; and 10 WHEREAS, said verified application constitutes a request 11 as provided by Title 21 of the "Carlsbad Municipal Code;" and 12 . . WHEREAS,the public hearing to consider the subject rezoning 13 was held at the time and in the place specified in the public 14 notice on February 9, 1977; and 15 WHEREAS, the subject application has complied with the 16 requirements of the Carlsbad Environmental Protection Act of 1972 17 because a Negative Declaration has been issued for the following 18 reasons: 1^ a) The Zone Change is necessary for conformity to the adopted General Plan;20 . b) The project area is developed; and c) Uses permitted under the new zone would be compatible 22 with freeway noise. 23 WHEREAS, at said public hearing, upon hearing and considering 24 the testimony and arguments, if any, of all persons who desired 25 to be heard, said Commission considered all factors relating 26 to the Zone Change and found the following facts and reasons to 27 exist: 28 XXXXXXXXXX ' 1 1) The proposed Zone Change Is consistent with the General Plan because: 2 a) The parcels are designated as the combination district 3 Recreational Commercial/Professional and Related Commercial (RC/0) on the General Plan Land Use Element.4 b) The Residential-Professional Zone implements the*uses 5 permitted by the "0" portion of the above General Plan combination district.6 c) The Qualified Overlay Zone will insure that future development of the subject parcels will preserve the integrity of the adjoining residential neighborhoods by orienting towards Pio Pico Drive. d) The Zone Change will have no adverse impact on any element of the General Plan.10 2) The proposed Zone Change is consistent with applicable 11 City Public Facilities Policies and Ordinances because: 12 . a) All basic public facilities exist for the site. b) Any additional public facilities may be required with approval of site development plans required by the Qualified Overlay Zone. 15 3) The Qualified Overlay Zone ("Q") is being applied to this area to assure that development of the different parcels will be comprehensively designed to pro-vide for: a) Preservation of the existing residential neighborhood to the east.18 b) Orientation of any development on these parcels towards Pio Pico Drive. 20 c) All primary access from Pio Pico Drive. d) Mutual parking and driveway access if at all possible. 22 e) Design compatibility of the different developments if they are not developed together.23 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission24 of the City of Carlsbad as follows:25 A) That the above recitations are true and correct.26 B) That the Zone Change from R-3 to R-P (Residential Profession 27 al) is recommended for denial, but a change to R-P-Q is recommendedfor approval. 28 PASSED, APPROVED AND ADOPTED at a regular meeting of the -2- o i 2 5 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 City of Carlsbad Planning Commission held on February 9, 1977, by the following vote, to wit: AYES:Commissioners Larson, Rombotis, L'Heureux, Jose, Watson and Fikes. .NOES: None. SECTION II: BACKGROUND: Location and Description of the Property the two parcels have major frontage along Pio Pico and both have access to Pine Avenue. The large parcel (Bonaguidi ' s) surrounds the smaller parcel (Lill's and Neely's) on the north and east and narrows to almost a point at Oak Avenue. There is an old single- family residence on each parcel. All of the northerly portion of Bonaguidi's parcel (along Pio Pico) is vacant. Existing Zoning: Subject Property: R-3 North: C-2 South: OS East: R-l West: N/A Existing Land Use: Subject Property: SFR and Vacant North: Office building (Rick) South: Holiday Park East: SFR's' West: I n t e r-s t a te 5 Environmental Impact Information: An Environmental Impact Assessment form has been received by staff and a Negative Declaration has been issued based on the following findings a) The zone change is necessary for conformity to the adopted General Plan. b) The project area is developed. c) Uses permitted under the new zone would be compatible with the freeway noise. General Plan Information: - . The Land Use Plan designates these parcels as the Combination District "RC/0" (Recreation Commerri al/Prof essi onal and Related Commercial.). A zone that would implement either one of these Land Use designations would be compatible with the Land Use Element. -2- W' • W .Public Facilities: Water and sewer services are provided by the City of Carlsbad. Most street improvements are existing. Half street improvements along Pine Avenue will be required concurrent with development. Past History and Related Cases: Staff is currently studying the residential area immediately to the east. The City Council directed staff to conduct such a study to determine how best to implement the "RM" (Medium Density Residential) 'designation for this area as shown on the Land Use Element. The tentative recommendation for this area will be a zone change from R-l to R-2-Q or RD-M-Q. Major Planning Considerations: Is the zone requested consistent with the General Plan? Will the permitted uses in the requested zone have a possible negative effect on surrounding properties? SECTION III: DISCUSSION: The "R-P" zone is the only zone currently available that partially implements the "RC/0" designation. During the development of the Land Use Element, all of these frontage properties along Pio Pico received special attention. It was felt that residential development in this area would not be suitable. However, because the adjoining area to the east was already estab- lished as residential, special development controls were needed to protect these existing neighborhoods. Primarily, protection in this case implied access and orientation of development in this area should be towards Pio Pico. The"Q"Zone Overlay will assure the City the right to review these development concerns. The "Q" zone will allow the review of each development plan if the parcels develop in- dependent of one another to insure coordination of such things as joint access from Pio Pico, mutual parking, and design compatibility.
