Statement of the Matter The City Council at your meeting of March 1, 1977 directed the City Attorney to prepare the necessary documents approving Zone Change 187. The resolution approving the zone change and the ordinance adopting the zone change are attached. Exhibit Resolution No Ordinan,ce No. Recommendation If the Council desires to approve Zone Change 187 and grant the change of zone, your action is to adopt Resolution No. &OJ3L and introduce Ordinance No. Q t/j f Council Action: 3-15-77 Resolution No. 5012, announcing findings and decision re: zone change , was adopted. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION REGARDING CHANGE OF ZONE (ZC-187) FROM R-3 TO R-P-Q (RESIDENTIAL- PROFESSIONAL-QUALIFIED) ON PROPERTY GENERALLY LOCATED WITH MAJOR FRONTAGE ALONG PIO PICO, BETWEEN PINE AVENUE AND OAK AVENUE. APPLICANTS: RONALD BONAGUIDI, WAYNE LILL, ' AND BOB NEELY. . WHEREAS, on February 9, 1977, a duly advertised public hear- ing was held before the Planning Commission in the manner prescribed by law to consider a change of zone from R-3 to •» R-P-Q (Residential-Professional-Qualified) on property as shown on map marked ZC-187, Exhibit "A", attached hereto and made a part hereof;.and WHEREAS, at the conclusion of said hearing the Planning Commission of the City of Carlsbad adopted Resolution No. 1328 recommending said zone change which is herewith referred to and made a part hereof; and WHEREAS, on March 1, 1977, the City Council held a public hearing on the matter, received all recommendations and heard all persons interested in or opposed to the proposed change of zone; and WHEREAS, the Planning Director has determined that said change of zone will have a nonsignificant impact on the environ- ment, and a Negative Declaration has been prepared and filed in satisfaction of the requirements of the City of Carlsbad Environ- mental Protection Ordinance of 1972 and the California Environmen- tal Quality Act; NOW, THEREFORE, BE IT RESOLVED by the City Council of the • City of Carlsbad as follows: a _ to °° fr ^ CM isil 50 5 3 *fcc"-z \" 8 olu 2 N <(O °c - Jo > P OC >• ° o t 1 2 5 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 •"•V . That the findings of the Planning Commission contained in the aforementioned Resolution No. 1328 constitute the findings of the Carlsbad City Council. 3. That the approval of the proposed change of zone classification is necessary to carry out the general purpose of Title 21 of the Municipal Code. 4. APPLICANTS: RONALD BONAGUIDI , WAYNE LILL, AND BOB NEELY. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: Title 21 of the Carlsbad Municipal Code is amended by the amendment of the zoning map to grant a change of zone (ZC-187)- from R-3 to R-P-Q (Residential-Professional-Qualifie on property as shown on map marked ZC-187, Exhibit "A", attached hereto and made a part hereof. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after-its adoptio INTRODUCED AND FIRST READ at a meeting of the Carlsbad City Council held on the 15th day of March. , 1977, and thereafter PASSED AND ADOPTED at a meeting of said City Council held on the 5tfl day of April f 1977^ ky the following vote, to wit: AYES: Councilman Frazee, Lewis, Skotnicki, Packard and Councilwoman Casler.
