S T A T
REQUEST:
The subject request is for a revision of an approved- Tract Map located
at the easterly terminus of Chestnut Avenue, directly east of the El
Cami no Mesa subdivision.
The original Tract Map was approved by the City Council on January 7, 1975,
for 264 lots. An extension of this map was approved by the Council on
July 6, 1976. The applicant now requests a revision of this approved
Tract Map. The revision is primarily for phasing. The original approved
Tract Map would.limit the number of units with access through Chestnut, prior
to the completion of Elm, to 69 lots. The revision is to allow 136 lots
with access through Chestnut.
In revising this Tract Map, staff /Das modified the conditions of approval to
meet the present policies' and standard conditions, especially pertaining to
Open Space dedication and maintenance. Otherwise, the revised Tract Map.
is essentially the same as originally- approved.
Planning Commission recommended approval of this revision as per staff
•report.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS
AN EXTENSION OF TENTATIVE MAP CT 74-14.
WHEREAS THE CITY COUNCIL of the City of Carlsba.d, on the
17th day of January, 1975, adopted Resolution No. 3565 approving
with conditions tentative map prx/4-14^ subject to its annexation
to the City; and
WHEREAS, said annexation was certified August 21, 1975, and
WHEREAS, the subdivider has requested a one year extension
of such map from August 21, 1976, to August 21, 1977, and
WHEREAS, the City Council has determined to extend such
map subject.to additional conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as fellows:
A. That the above recitations are true and correct.
B. That tentative map CT 74-14 is hereby extended, subject
to the execution and/or fulfillment of all the conditions of Reso-
lution No. 3565 and the following conditions:
1. Prior to any occupancy of any portion of the Specific
Plan area the applicant shall file with the Clerk of the City of
Carlsbad a petition for the formation of an Open Space Maintenance
District as provided for in Section 50590 of the California State
Government Code. The applicant shall maintain all landscaping in-
stalled in conformance with this plan until such time as an Open
Space Maintenance District is established and accepts maintenance
responsibilities as prescribed in the Open Space Maintenance Act,
or until maintenance responsibility is accepted by another entity
acceptable to the City. Should the City Council not approve such
a Maintenance District, the applicant shall form a Homeowner's
Association. The CC&R's for the Association shall contain provi-
sions guaranteeing maintenance of said landscaping and shall be
reviewed by the Planning Director.

2. Improvement•plans shall show adequate provision for a
looped water system. The design shall meet the requirements of the
Fire Department and City Engineer.
C. That said tentative map extension, together with pro-
visions for its design and improvement and subject to the above
conditions, is consistent with all applicable general and specific
plans of the City of Carlsbad.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE MAP (CT 74-14)
FOR 264 LOTS ON 83.25 ACRES ON THE EAST
SIDE OF EL CAMINO REAL BETWEEN ELM AVENUE
EXTENDED AND CHESTNUT AVENUE. APPLICANT:
INVESTOR'S DEVELOPMENT AND MORTGAGE CORP.
WHEREAS, on November 12, 1974, the Carlsbad City Planning
Commission adopted Resolution No. 1117 recommending to the City
Council that Tentative Map (CT 74-14) be conditionally approved;
and
WHEREAS, the City Council of the City of Carlsbad, on
December 17, 1974, considered the recommendation of the Planning
Commission; and
WHEREAS, an Environmental Impact Report has been prepared
and discussed at duly noticed public hearings before the Planning
Commission and the City Council, and the final report has been
certified as complete in compliance with the requirements of the
City of Carlsbad Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
. A. That the above recitations are true and correct.
B. That Tentative Map (CT 74-14) is hereby approved sub-
ject to all applicable requirements of the Carlsbad Municipal
Code and to the satisfaction of the following conditions:
1. The final map shall be submitted for approval
within one year from the final action by the City Council
on the Tentative Subdivision Map. The final map shall
be in substantial conformance with the Tentative Sub-
division Map known as Exhibit D, dated November 12, 1974,
on file in the City of Carlsbad Planning Department.
2. The development of the property described herein
shall be subject to the restrictions and limitations set
forth herein which are in addition to all the require-
ments, limitations and restrictions of all municipal
ordinances and state and federal statutes now in force,
or which hereafter may be in force,for the purpose of
preserving the residential characteristics of adjacent
properties.

3. All-public improvements shall be made in conform-
ity with the City of Carlsbad Engineering Design Criteria
and standard plans, the Subdivision Ordinance and other
City standards to the satisfaction of the City Engineer
without cost to the City of Carlsbad and free of all
liens and encumbrances. Improvement plans for water
and sewer systems shall meet the requirements of the
respective service districts.
4. All land and/or easements required by this ordi-
nance shall be granted to the City of Carlsbad without
cost to the City and free of all liens and encumbrances.
No easements shall be recorded prior to approval of the
final map unless approved by the City Engineer.
5. All utilities, including provisions for cable TV,
shall be placed underground. .
6. Ornamental street lighting shall be provided for
as required by Municipal Code. The developer shall post
a bond and/or cash in the amount necessary to energize
said street lights for an 18-month period after construc-
tion to permit the incorporation of the subdivision into
.a maintenance district. This shall be done prior to
approval of the final map.
7. The improvement plans shall include a report of
a geological investigation and a complete grading plan
of the entire site when required by the City Engineer.
The report and plan shall be prepared by a civil engineer
licensed by the State of California and experienced in
erosion control. Said engineer shall certify that he
has investigated the site and prepared data with full
consideration of the consequences to the included and
neighboring properties and conform to the standards of
the Geological Safety Element of the General Plan.
8. All slopes created as a. result of this develop-
ment shall not exceed a 2:1 slope except as approved by
the City Engineer.
9. In order to provide for reasonable fire protec-
tion during the construction period the subdivider shall
maintain passable vehicular access to all buildings and
adequate fire hydrants with required fire flows, and dry-
stand pipes shall be installed prior to framing construc-
tion.
10. Park-in-lieu fees shall be granted to the City
concurrent with City Council approval of the final map.
11. Street trees when required by the City shall be
installed by the applicant at his expense. Trees shall
be of a type approved by the Parks Department and shall
be installed to their specifications. If removal of any
existing tree is required by the City, said removal shall
be at the applicant's expense. It shall be the respon-
sibility of the applicant to make all arrangements with
the Parks Department concerning the requirements of this
condition. These arrangements are to be made prior to
approval of the final map.

shall be designated in accordance with the standards
and policies.adopted by the Planning Commission on file
in the Planning Department. Said names sh'all be approved
by the Planning Director prior to approval of the final
map.

mitted to the Planning Director for review and approval
prior to the approval of the final map.
(14. Phase I, as shown, may be subdivided with singula
acce-s^s to existing Chestnut Avenue. Further subdivision
of any portion of the remainder of the approved Tentative
Map will be conditioned on the provision of a secondary
access to El Camino Real by way of the extension of Elm
Avenue. Access to Elm Avenue by extension of Templin
Road as a residential collector to Elm Avenue will meet
the requirements for secondary, access to El Camino Real.
15. The applicant shall cause to be acquired a small
offsite parcel at the northwest corner of the intersection
of Caldwell Lane and Elm Avenue for the street right-of-
way purposes. It is understood that the City will
cooperate with any attempt to purchase the subject parcel.
16. No permanent sewage pump stations will be per-
mitted in any phase of development. Temporary pump
stations may be approved by the City Engineer if the sub-
divider guarantees, by suitable cash deposit,funds necessar
for the operation and maintenance of the temporary pump
station until a permanent gravity system is constructed.
Connection to the permanent gravity sewer system shall be
made by the subdivider•at no cost to the City.
17. Provision for traffic signals shall be made in
accord with such City Council policy in that regard as
may be in effect when the final map is submitted for
approval.
18. All cul-de-sacs on the site shall have a maximum
length of 500 feet except as approved by the City Engineer

struction of Caldwell Lane and Elm Avenue as shown on the
tentative map.
20. The maximum allowable street grade through an
intersection will be 9%.

Lot C concurrent with City Council approval of the final
map for Phase I.
The slope areas shown as the rear portion of
Lots 28-32, 35-40 and 43-50 shall be granted to the City
as an open space easement prior to City Council approval
of the final map for Phase I. •

All that portion of Lot "J" of Rancho Agua Hedionda
according to Partition Map No. 823 filed with the
San Diego Recorder and listed in Assessor's Book 167,

has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said application constitutes a request as provided
by the "Carlsbad Municipal Code;" and
WHEREAS, the public hearing to consider the subject request
was held on March 9, 1977, at the time and in the place specified
in the public hearing notice, pursuant to the provisions of the
Carlsbad Municipal Code; and
WHEREAS, at said public hearing, upon hearing and considering
the testimony and arguments, if any, of all persons who desired
to be heard, said Commission considered all factors relating
to the Tentative Tract Map request (CT 74-14(A)) and found the
following facts and reasons to exist:

not likely to cause serious public health problems because:
a) Conditions of approval will insure adequate public health
provisions.
6) The design of the subdivision and the type of improvements will
not conflict with easements required by the public at Targe
for access through or use of property within the proposed
subdivision because:
a) All necessary easements will be maintained or provided
for within new public rights-of-way.
7) This subdivision will not prohibit reasonable access to public
waterways,Drivers, streams, lakes, reservoirs, coastlines or
shorelines because:

of the Parks and Recreation Director prior to City Council

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Carlsbad as follows:
A) That the above recitations are. true and correct.
B) That in view of the findings heretofore made and considering
the applicable law, the decision of the Planning Commission
is to approve CT 74-14(A), subject to the following conditions:
1) The approval is granted for the land described in the
application and any attachments thereto and as shown on
the tentative tract map submitted labeled Exhibit A,
dated February 4, 1977. The location of all roadways,
lots, and other facilities or features shall be located
substantially as shown on the plot plan, Exhibit A, except
or unless indicated otherwise herein.
A and B concurrent with recordation of the final map for
Phase One.15
4) The slope areas shown as the rear portions of Lots 27-35
and 40-45 shall be granted to the City as an open space
easement concurrent with City Council approval of the
final map for Phase One.
The slope areas shown as the rear portions of Lots 231-
244 shall be granted to the City as an open space ease-
ment concurrent with City Council approval of the final
map for Phase Three.20
5) The applicant shall provide the following within the open
space lots and easements prior to final map approval:
22 a) Landscaping and a sprinkler system acceptable to the
Parks and Recreation Director.23
b) A 10-foot wide, maximum 7-percent grade asphaltic
concrete path extending from the southerly boundary
and joining the path on CT 74-4 at their mutual boun-
dary to the north (only applies to Lots A and B).
6} The applicant shall include in the Covenants, Conditions
and Restrictions, a provision that each lot owner, a
portion of whose lot is included in the open space ease-
ment, shall be responsible for maintaining that open space
The CC&R's shall provide that the slopes shall be main-
tained in a state comparative to the natural surroundings.

The exact language defining the ma-intenance responsibility
shall be approved by the Parks and Recreation Director.
7) The CC&R's for this development shall be submitted to
the Planning Director for review and approval prior to
the approval of the final map.
8) All land and/or easements-; required by this Ordinance
shall be granted to the City of Carlsbad without cost
to the City and free of all liens and encumbrances. No
easements shall be recorded prior to approval of the final
map unless approved by the City Engineer.
9) All slopes created as a result of this development shall
not exceed a 2:1 slope except as approved by the City
Engineer.
10) If slope rights are obtained from the adjoining^ property
.owner to the south prior to April 19, 1977, the applicant
shall offer either Lot 207 or Lot 208 for street purposes
to provide a secondary access to the adjacent southerly
parcel. The offer shall be rejected by the City until
the southerly parcel is developed. Lot dimensions may
.be altered in this area to accommodate any special widths
and grades for this lot.
11) Provision for traffic signals shall be made in accord
with such City Council policy in that regard as may be
in effect when the final map is submitted for approval.
12) All cul-de-sacs on the site shall have a maximum length of
500 feet except as approved by the City Engineer.
13) The maximum allowable street grade through the inter-
sections of Chestnut Avenue and Oxford Avenue, and
Chestnut Avenue and Ames Place shall be 9 percent.
14) Ornamental street lighting shall be provided for as
required by Municipal Code. The developer shall post a
bond and/or cash in the amount necessary to energize
said street lights for an 18-month period after construc-
tion to permit the incorporation of the subdivision into
a maintenance district. This shall be done prior to
approval of the final map.

15) No final map shall be approved until provisions are
made to connect the proposed sewer to an offsite public
gravity sewer system approved by the City Engineer;
that is: an offsite system either existing or having
sections to be constructed, for which plans are approved
and fees, bonds and easements are received.
. 16) Elm Avenue shall be extended to the .proposed Santa Clara
Way in Carlsbad Tract No. 76-2 on the basis of a minimum
44-foot graded roadway wi.th 28 feet of paving, designed ac-
cording to City of Carlsbad standards for a secondary

21 of the Carlsbad Municipal Code."
7 18) "The proposed temporary deep sewer in Victoria Avenue
8 serving Unit No. 3 is conceptually approved. The specific
design shall be approved by the City Engineer on the
9 improvement plans. A gravity sewer shall be installed
and capped off to permit the abandonment of the deep
10 sewer should an alternate route be established by develop-
ment of adjacent property."
19) Prior to approval of the Final Map of Unit No. 3, the
12 applicant shall dedicate, acquire offsite easements for
and improve the following:

arterial prior to or concurrent with the Final Map
approval of Unit No. 1. Bonding for these improvements
to be completed within two years of final map recorda-
tion of Unit No. 1 'shall meet this requirement
17) "Prior to Final Map approval of Unit No. 3, the applicant
shall either cause to be acquired the offsite parcel
formed by the offsite extension of Victoria Avenue and Elm
Avenue and consolidate the parcel with proposed lots
241 through 244 by adjustment plat; or alter the boundary
of proposed lot 244 to satisfy the requirements of Title
section, from the northerly subdivision boundary to
the proposed intersection of Victoria Avenue. Dedi-
cation of Elm Avenue along this section shall include
a waiver of direct access rights from all lots shown
on the final map as abutting thereon.
b) Victoria Avenue, on the basis of a 60-foot street
section from the subdivision boundary to the proposed
intersection of Elm Avenue.
c) Elm Avenue, on the basis of a 44-foot graded roadway
with 28 feet of paving, designed according to City -
of Carlsbad standards for a secondary arterial,
from the northerly subdivision boundary to the existing
Elm Avenue Extension.
Prior to review of the final map and improvement plans
for Unit No. 3, an amended tentative map shall be submitted
to the Planning Director and City Engineer and approved by
the City Engineer as to the alignment, cross section and
grade of Elm Avenue. The map or its attachments shall
show the location of mature trees and alternate means of
installing the street to preserve these trees.
20) The units shall be constructed in numerical order. Prior
to or concurrent with the recordation of the Final Map for
Unit No. 2, the right-of-way shall be dedicated and a sec-
ured agreement shall- be executed for complete improve-
ment of Victoria Avenue across Unit No. 3 to the easterly
subdivision boundary, to provide for the connection to

Elm Avenue if it is extended past or to the subdivision .
by another party.
21) Physical access to Elm Avenue shall be provided prior to
or concurrent with the recordation of the Fi.nal Map for
Unit No. 2. The offsite extension of that street called
"Pontiac Drive" on Exhibit A as a residential collector
to Elm Avenue to the north will satisfy this require-
ment.
22) The applicant shall comply with all of the rules and
regulations of the Carlsbad Municipal Water District.
Special problems, such as the need for offsite water
mains, may exist in this area and the applicant is
encouraged to work closely with the District.
23) The City Council resolution approving this revised
tentative map shall amend Council Resolutions Nos.
3565 and 3942, to include the new conditions and the new
map.

PROVIDE A 244 DWELLING UNIT, 246 LOT SUBDIVISION
ON APPROXIMATELY 83.3 ACRES.

SECTION I: RECOMMENDATION:
Staff recommends that CT 74-14(A) be APPROVED based on the following
findings and subject to the following conditions:
FINDINGS:
1) The proposed map is consistent with the General Plan because:
a) The Land Use Element designates this area for residential
land .use at 0-4 dwelling units per gross acre. The map
provides approximately 2.9 units per acre.
b) The Open Space and Conservation Elements designate an open
space corridor along the westerly boundary of the tract. The
map provides that corridor.
c) With proper phasing, the polices and guidelines of the
Circulation Element will be adhered to.
d) The other elements of the General Plan will not be adversely
affected by this project.
2) An environmental impact report has been previously certified for
this project in compliance with the requirements of the City of
Carlsbad Environmental Protection Ordinance of 1972.
3) Adequate provisions have been made with the different serving
agencies to assure that all necessary services and facilities
will be available concurrent with need.
4) The site is physically suitable for this tyoe of development
because the lots have been zoned, and will mavntain a minimum
square footage per lot that is compatible with the terrain.
5) The design of the subdivision and the type.of improvements are not
likely to cause serious public health 'problems because conditions
of approval will insure adequate public health provisions.
6) The design of the subdivision and the type of improvements will
not conflict with easements required by the public at large for
access through or use of property within the proposed subdivision
because all necessary easements will be maintained or provided
for within new public right-of-ways..
7) This subdivision will not prohibit reasonable access to public
waterways because no such waterway exists in the vicinity of this
project.
• CONDITIONS:
1) The approval is granted for the land described in the application
and any attachments thereto and as shown on the tentative tract
map submitted labeled Exhibit A, dated February 4, 1977. The
location of all roadways, lots, and other facilities or features
shall be located substantially as shown on the plot plan, Exhibit
A, except or unless indicated otherwise herein.
2) Park-in-lieu fees shall be required to the satisfaction of the
Parks and Recreation Director prior to City Council approval of
the final map. A credit of 25% will be allowed against the
computed park-'n-lieu fees because of the open space corridor
pro.vided along the westerly boundary of the tract.
3) The applicant shall dedicate in fee title to the City Lots A and
B concurrent with recordation of the final map for phase one.
4) The slope areas shown as the rear portions of Lots 27-35 and 40-45
shall be granted to the City as an open space easement concurrent
with City Council approval of the final map for phase one.
The slope areas shown as the rear portions of Lots 231-244 shall be
granted to the City as an open space easement- concurrent with
City Council approval of the final map for phase three.
5) The applicant shall provide the following within the open space
lots and easements prior to final map approval:
a) Landscaping and a sprinkler system acceptable to the Parks
and Recreation Director;
b) A 10-foot wide, maximum 7% grade asphaltic concrete path
extending from the southerly boundary and joining the path
on CT 74-4 at their mutual boundary to the north (only applies
to Lots A & B).
6) The applicant shall include in the Covenants, Conditions and
Restrictions, a provision that each lot owner, a portion of
whose lot is included in the open space easement, shall be res-
ponsible for maintaining that open space. The CC & R's shall
provide that the slopes shall be maintained in a state compar-
ative to the natural surroundings. The exact language defining
the maintenance responsibility shall be approved by the Parks
and Recreation Director.

7) The CC & i 3 for this development shall be submitted to the
Planning Director for review and approval prior to the approval
of the final map.
8) All land and/or easements required by this ordinance shall be
granted to the City of Carlsbad without cost to the City and
free of all liens and encumbrances.' No easements shall be
recorded prior to approval of the final map unless-approved by
the City Engineer.
9) All slopes created as a result of this development shall not
exceed a 2:1 slope except as approved by the City Engineer.
10) If slope rights are obtained from the adjoining property owner
to the south prior to April 19, 1977, the applicant shall offer
either lot 207 or 208 for street purposes to provide a secondary
access to the adjacent southerly parcel. The offer shall be
rejected by the City until the southerly parcel is developed.
Lot dimensions may be altered in this area to accommodate any
special widths and grades for this lot.
11) Provision for traffic signals shall be made in accord with such
City Council policy in that regard as may be in effect when the
final map is submitted for approval.
12) All cul-de-sacs on the site shall have a maximum length of 500
feet except as approved by the City Engineer.
13) The maximum allowable street grade through the intersections
of Chestnut Avenue and Oxford Avenue, and Chestnut Avenue and
Ames Place shall be 9%.
14) Ornamental street lighting shall be provided for as required
by Municipal Code. The developer shall post a bond and/or cash
in the amount necessary to energize said street lights for an
18 month period after consturction to permit the incorporation
of the subdivision into a maintenance district. This shall be
done prior to approval of the final map.
15) No final map shall be approved until provisions are made to
connect the proposed sewer to an offsite public gravity sewer
system approved by the City Engineer; that its, an offsite
system either existing or having sections to be constructed,
-for which plans are approved and fees, bonds, and easements
are receieved.,
16) Elm Avenue shall be extended to proposed Santa Clara Way in
Carlsbad Tract 76-2 on the basis of a minimum 44' graded road-
way with 28' of paving, designed according to City of Carlsbad
Standards for a secondary arterial prior to or concurrent with
the Final Map Approval of Unit #1. Bonding for these impro-
vements to be completed within 2 years of final map recordation
of Unit #1 shall meet this requirement.

17) "Prior to final map approval of Unit #3 the applicant shall
either cause to be acquired the offsite parcel formed by the
offsite extension of Victoria Avenue and Elm Avenue and con-
solidate the parcel with proposed lots 241 through 244 by
adjustment plat; or alter the boundary of proposed lot 244
to satsify the requirements of Title 21 of the Carlsbad
Municipal Code."
18) "The proposed temporary deep sewer in Victoria Avenue serving
Unit #3 is -conceptually approved. The specific design shall
be approved by the City Engineer on the improvement plans. A
gravity sewer shall be installed and capped off to permit the
abandonment of the deep sewer should an alternate route be
established by development of adjacent property."
19) Prior to approval of the final map of Unit #3, the applicant
shall dedicate, acquire offsite easements for, and improve
the following:
a) Elm Avenue, on the basis of a 42 foot half street section,
from the northerly subdivision boundary to the proposed
intersection of Victoria Avenue. Dedication of Elm Avenue
along this section shall include a waiver of direct access
rights from all lots shown on the final map as abutting thereon

b) Victoria Avenue, on the basis of a 60 foot street section
from the subdivision boundary to the proposed intersection of
Elm Avenue.
c) Elm Avenue, on the basis of a 48' graded roadway with 28'
of paving, designed according to City of Carlsbad Standards
for a secondary arterial, from the northerly subdivision
boundary to the existing Elm Avenue Extension.
Prior to review of the final map and improvement plans for Unit #3,
an amended tentative map shall be submitted to the Planning
Director and City Engineer and approved by the City Engineer as
to the alignment, cross section and grade of Elm Avenue. The
map or its attachments shall show the location of mature trees
and alternate means of installing the street to preserve these
trees.
20) The units shall be constructed in numerical order. Prior to
or concurrent with, the recordation of the final map for Unit #2,
the right of way shall be dedicated and a secured agreement
shall be executed for complete improvement of Victoria Avenue
across Unit #3 to the easterly subdivision boundary, to provide
for the connection to Elm Avenue if it is extended past or to
the subdivision by another party.
21) Physical access to Elm Avenue shall be provided prior to or
concurrent with the recordation of the final map for Unit #2.
The off-site extension of that street called "Pontiac Drive" on
Exhibit A as a residential collector to Elm Avenue to the
north will satisfy this requirement.

22) The applican,. shall comply with all of u,,e rules and regulations
of the Carlsbad Municpal Water District. Special problems,
such as the need for off-site water mains, may exist in this area
and the applicant is encouraged to work closely with the District-

supercede Council Resolutions No. 3565 and No. 3942.
SECTION II: BACKGROUND:
Location and Description of Property:
The tentative map includes-all that portion of lot "J" of Rancho
Agua Hedionda according to Partition Map No. 823 filed with the San
Diego County Recorder.
The 83.3 acre site is located at the easterly terminus of Chestnut
Avenue, directly east of the El Camino Mesa subdivision.
The property is characterized by rolling topography with a number of
natural drainage areas.
A San Diego Gas and Electric transmission easement runs along the
westerly boundary of the property.

Past History and Related Cases:
A tentative map for this area (CT 74-14) was approved by the City
Council on January 7, 1975 (Reso. No. 3565) for 264 lots. An extension
of this map was approved by the Council on July 6, 1976 (Reso. -No.3942).
That map will be valid until August 21, 1977, with the potential of one
more 1-Year extension. An EIR for the project (EIR-262) was certified by
the Council on December 17, 1974.
An extension for an approved subdivision to the north (Quail Ridge-
CT 74-14) was approved by the Council on February 15, 1977.
A Master Plan (MP-150) was approved on January 11, 1974, for a 808
acre planned community to the east.
General Plan Information:
The Land Use Element designation for this property is primarily "RLM"
(0-4 dwelling units per gross acre). The project density proposed is

2.9 units per acre. The westerly portion of the site is designated
as Open Space (OS). The proposed dedication in this area conforms
to this designation. There is also a designation for an elementary
school site in the vicinity of this project. There is no provision
for a school site in this project.
Environmental Impact Information:
Environmental Impact Report No. 262 was certifed at the time of
approval of pre-annexational Zone Change No. ZC-145.
Public Facilities:
The site is within the Carlsbad Municipal Water District service area
and sewer service.will be provided by the City of Carlsbad.
The Carlsbad Unified School District provides school facilities for
the area.

SECTION III: DISCUSSION:
The first two questions have been thoroughly analyzed by staff. Staff
feels the proposed conditions will adequately resolve these concerns.
The question of the school site is more subjective. The Land Use
Element text states that proposed school-s sites are "to be confirmed
by the respective school districts at time of development." Staff has
discussed this matter with the Superintendent of the Carlsbad Unified
School District and he assures us that a school site is not desired
in this location. The District is currently preparing a District-wide

tions for school facilities. We, therefore, cannot at this time
provide you with information that the district can provide school

district could provide school facilities -for the above-referenced
development.
Since the letter was written, ve have, found that we v?ere in error
in our assumption that the ownership had been changed in regard to this
project. In addition, from the information you gave us'on the phone,
we find that the project .is essentially the same as the one originally
submitted as CT 74-14 with the exception that there have been SOTUC pro-
visions providing more open space, resulting in a change from 270 units
to 243 units. Therefore, it would be appreciated if you will disregard
our letter of February 16, 1977.

We wrote to you on February 18, 1977 concerning 'the above-referenced
development advising you that the letter from the school district
addressed to the Planning Commission dated September 10, 19.74 was still
in effect. Since we sent you the letter, it has come to our attention
that the Planning Department is concerned as to whether or not there
should be an elementary school site located within the referenced
subdivision.
The District Superintendent and I have reviewed the district's
master'plan as related to the Templin Heights subdivision and have come
to the following conclusion. It is our belief that an elementary school
site would best serve the district if it were located northerly from Elm
Avenue extension or possibly southerly on the ridge from the Templin
Heights tract.
Therefore, you may be assured at this, time that the district does
not wish to locate an elementary school site within the Templin Heights
subdivision.
