STATEMENT OF THE HATTER
REQUEST;
On June 23, 1976 the Planning Commission approved 'a Conditional Use
Permit for a print shop as required by the zone code. In the CUP
investigation the Planning Commission found that today's printing
shops using modern equipment had little adverse effect to the sur-
rounding properties, and therefore felt that the requirements for
the Conditional Use Permit for such use was no longer needed.
Upon instruction from the City Council, staff prepared an Ordinance
Amendment, to delete the CUP requirement. The Planning Commission
has recommended approval of this amendment.

PLANNING COMMISSION RESOLUTION NO. 1340
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS
FINDINGS RELATIVE' TO AMENDING CHAPTERS 21.26,
21.28 AND 21.42 OF TITLE 21 OF THE MUNICIPAL CODE
PERTAINING TO PRINTERS.

APPLICANT: CITY OF CARLSBAD
WHEREAS, the Planning Commission of the City of Carlsbad
did adopt Resolution of Intention No. 141 declaring its intention
to conduct a public hearing to consider a Zone Code Amendment
amending Title 21 of the Municipal Code to delete the requirement
of a Conditional Use Permit for Printers.
WHEREAS, the Planning Commission did hold a duly noticed
Public Hearing on March 9, 1977, to consider the subject
amendment; and
WHEREAS, the Planning Commission received all testimony
from those persons interested in and opposed to, if any, the
proposed Zone Code Amendment; and
WHEREAS, the Planning Commission did find the following
facts and reasons to be present which in their opinion are
necessary to carry out the general purpose of Title-21 of the
Municipal Code:
1) The zone code does not clearly differentiate between various
printing and reproduction activities.
2) Changes in technology have made certain printing activities
less objectionable than they were previously.
NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission
of the City of Carlsbad that it does recommend approval to the
City Council of an amendment to Title 21 of the Municipal Code
as set forth in Exhibit "A" dated February 4, 1977 attached hereto

ORDINANCE NO. 9480
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21, CHAPTERS 21.28 AND 21.42 OF THE
CARLSBAD MUNICIPAL CODE BY THE AMENDMENT
OF SECTIONS 21.28.010 AND 21.42.010 TO
REVISE THE PERMITTED AND CONDITIONAL USE
REGULATIONS REGARDING PRINTING, BOOKBINDING,
ENGRAVING, PHOTOCOPYING, DUPLICATING AND
SIMILAR USES.
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: That Title 21, Chapter 21.28, Section 21.28.010
of the Carlsbad Municipal Code is amended by the amendment of
subsections (5), (6) and (7) and by the addition of subsection (8)
to read as follows:
"(5) Blueprinting, photocopying, duplicating and mimeo-
graphing services;

(6) Commercial printing and photo engraving;
15
(7) Upholstering shops;
16
(8) Retail, wholesale or service businesses catering
directly to the consumer."
SECTION 2: That Title 21, Chapter 21.42, Section 21.42.010
of the Carlsbad Municipal Code is amended by the amendment of
subsection 21.42.010(4) to delete paragraph (B).
SECTION 3: That Title 21, Chapter 21.42, Section 21.42.010
of the Carlsbad Municipal Code is amended by the amendment of
subsection (6) to add paragraph (H) as follows:
"(H) Newspaper, periodical and book publishing and
printing, and bookbinding."

EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.

Council held on the 5th day of April , 1977, and there-

APPLICANT: CITY OF CARLSBAD
REQUEST: Approval of a Zone Code Amendment to delete
•the requirement of a Conditional Use Permit
for Printers.
RECOMMENDATION:
Staff recommends that ZCA-82 be APPROVED as set forth in Exhibit A,
attached, for .the following reasons:
1) The zone code does not clearly differentiate between various
printing and reproduction activities.
2) Changes in technology have made certain printing activities less
objectionable than they were previously.
BACKGROUND REPORT
History and Related Cases:
The Planning Commission approved a Conditional Use Permit allowing
operation of a print shop on June 23, 1976 (CUP-121, Reso. 1262).
Following its approval, the Planning Commission requested City Council
instruct staff to study a possible zone code amendment to delete the
CUP requirement. City Council so instructed staff July 6, 1976. The
Planning Commission adopted a Resolution of Intention to consider the
Zone Code Amendment February 9, 1977.
Environmental Impact Information:
A Negative Declaration of Nonsignificant Impact has been issued for
the following reasons:
1) The project is administrative in nature and will have a minimal
impact on the physical environment. The-land uses subject to amendment
are typical of uses allowed in commercial and industrial zones.
DrSCUSSION:
The Zone Code's limitations on Printers and related uses are the
following:

1) R-P and CLR zones (sections 21.18.020(10) and•21.25.030(15),
respectively)! '.
"Offices, business and professional, including incidental
commerci al facilities such as blueprint and photocopy shops,
business machine sales, computer and data processing centers,
news stores, dupli eating and mimeographing servi ces and tobacco
shops." (Emphasis added!.
2) C-2 zone (section 21.28.010(5):
"Photo engraving".
3) C-M zone (section 21.30.010(1):
"Any use permitted in the C zones..." (Note: in effect,
photo engraving).
4) M Zone (section 21.32.010(1):
"Any use permitted in the C-M zone.." (Note: in effect,
photo engraving).
5) R-P, Commercial and industrial Zones:

(Section 21.42.010(48): "Newspaper, printers (no printing
operations allowed in the R-P zone) "by CUP.
The amendments contained in Exhibit A "wi11 change these limitations
as follows:
1) R-P and CLR zones;
No change. Blueprinting, photocopying, duplicating and mimeo-
• graphing facilities will continue to be permitted as incidental
uses.
2) C-2 zone:
Will be changed to allow blueprinting, photocopying, duplicating,
and mimeographing services and commercial printing as well as
photo engraving.
.3). C-M zone: .
The Change to the C-2 zone will allow blueprinting, photocopying,
duplicating and mimeographing services and commercial printing in
the C-M zone as well as photo engraving.
4) M Zone: • .
The change to the C-2 zone will allow blueprinting, photocopying,
duplicating, and mimeographing services, and commercial printing
in the M Zone as well as phot'o engraving.

5) R-P, Commercial and Industrial zones:
The change to the CUP section deletes the current CUP requirement
and replaces it with a CUP requirement for Newspaper, periodical
and book publishing and printing, and bookbinding in Industrial
Zones only.
These amendments accomplish two purposes. First, they more clearly
define and differentiate between various printing and duplicating
operations. Second, they recognize the technological improvements in
the industry since the code was adopted. Processes that formerly
involved caustic, smelly chemicals, and loud, vibrating presses are now
much less obtrusive. These processes are generally found in commercial
printing stationery, envelopes, business forms, etc.
With these amendments commercial printing 'will be allowed by right
in the C-2, C-M and M Zones.
