Statement of the Matter
The City Council at your meeting of April 5, 1977 directed
the City Attorney to prepare the necessary documents
approving Tentative Map (CT 76-15). In accord with Counci
direction a new finding and condition regarding sewer
availability, and a new condition regarding park fees, ham been added to those matters recommended by the Planning Commission. The Council also directed the City Attorney ti prepare the necessary documents to approve Planned Unit Development Permit (PUD-6) and Specific Plan Amendment (SP

WITH CONDITIONS TENTATIVE MAP (CT 76-15)
FOR 135 SINGLE-FAMILY DETACHED DWELLINGS
ON APPROXIMATELY 43.99 ACRES GENERALLY
LOCATED ON THE WEST SIDE OF EL CAMINO REAL
BETWEEN KELLY DRIVE AYD CHESTNUT AVENUE,

WHZREAS, on March 9, 1977 the Carlsbad City Planning
Commission adopted Resolution No.1335 recommending to the C:
Council that Tentative Map (CT 76-15) be conditionally apprc

j c WHEIEAS, the City Council of the City of Carlsbad, on
April 5, 1977 considered the recommendations of the Plannin<
Commission; and
WHEREAS I an Environmental Impact Report was certified
complete for a previously issued entitlement for this projec
and the Planning Director has found the Tentative Map (CT 7t
to be in prior compliance with the City of Carlsbad Environr
Protection 0rdinance.of 1972;
NOW, THEREFORE, be it resolved by the City Council of
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
vResolution No. 1335 constitute the findings of the City Cow
in this matter except as they relate to the public facilitie

No. 3177 is hereby amended by the deletion of those portion,
within CT 76-15, Resolution No. 5050 and PUD-6, Resolution
No. 5051 as shown on the amended Specific Plan (SP-l15(A)) 1
Exhibit "A", dated January 25, 1977, on file with the Plann.
Department and incorporated herein by reference and by the
addition of a condition as follows:
"NO building permits shall issue for any structure
within SP-l15(A) unless the City Manager determinl that sewer service is available,"
