ZONE CHANGE FROM L-C TO P-M STATEMENT OF THE MATTER REQUEST; The subject property is situated on the south side of Palomar Airport Road, on both sides of Yarrow Drive. This property came into the ownership of Cabot, Cabot & Forbes1 in a property trade with the County. The unusual sha'pe of the property is due to the alignment of Palomar Airport Road, in relation to the existing property boundaries. This remnant piece of property was included.in the Cabot, Cabot & Forbes1 subdivision. Therefore, lots 1 and 13 of this subdivision contain dual zones of P-M and L-C. Zone Change 190 is a request to clean- up this small zoning inconsistency. The Planning Commission has rec~ ommended approval of this request. ', EXHIBITS; . FORM PLANNING 73 1 PLANNING COMMISSION RESOLUTION NO. 1347 2 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING 3 FORTH ITS FINDINGS AND RECOMMENDATIONS RELATIVE TO REZONING PROPERTY FROM L-C 4 TO P-M ON PROPERTY LOCATED ON THE SOUTH SIDE OF PALOMAR AIRPORT'ROAD, BOTH SIDES 5 OF YARROW DRIVE. CASE NO.: ZC-190 6 APPLICANT: CABOT, CABOT & FORBES (PALOMAR PROPERTIES, INC.) 7 o WHEREAS, a verified application for a certain property 9 as shown on the attached map, has been filed with the City of 10 Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request 12 as provided by Title 21 of the "Carlsbad Municipal Code"; and. 13 WHEREAS, the public hearing to consider the subject rezoning 14 - •was held at the time and in the place specified in said notice 15 on March 23, 1977; and WHEREAS, the subject application has complied with the 17 requirements of the"City of Carlsbad "Environmental Protection 18 Ordinance of 1972"; and . 19 WHEREAS, at said public hearing, upon hearing and con- 20 sidering the testimony and arguments, if any of all persons 21 who desired to be heard, said Commission considered all factors 22 relating to the Zone Change and found the following facts and "23 reasons to exist: 24 1) General Plan: The proposed zone change is consistent with the 25 General Plan because: 2Q ' a) The Land Use Element designates this area as "PI" '(Planned Industrial). 27 b) The Zone Change will have no adverse effect on any element .gQ- of the General Plan. • • 1 2 3 4 5 6 - 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o 2) Environment: The Zone Change is consistent with the Carlsbad Environmental Protection Ordinance of 1972 because: a) A Negative Declaration has been issued for the following reasons: (1) The proposal is consistent with the General Plan. (2) The project area is small in scale. 3) Public Facilities: The proposed zone change is consistent with applicable City Public Facility Policies and Ordinances because a) The project area is a portion- of an approved subdivision and all public facilities are presently available. 'NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That the Zone Change from L-C to P-M is recommended for approval. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of 'Carlsbad Planning Commission held on March 23, 1977 by the following vote, to wit: AYES: Commissioners Larson, Rombotis, Nelson, Fikes, Jose and L'Heureux NOES: None ABSENT: Commissioner Watson ABSTAIN: None ERIC LARSON, CHAIRMAN ATTEST: RALPH (£. SECTION I; RECOMMENDATION Staff recommends ZC-190 be APPROVED for the following reasons: 1. General Plan: The proposed zone change is consistent with the General Plan because: a) The Land Use Element designates this area as "PI" (Planned Indus- , .'trial). b) The Zone Change will have no adverse effect on any element of the General PI an. 2. SECTION II: BACKGROUND REPORT Location and Description of Property: South side of Palomar Airport Road, both sides of Yarrow Drive. Portions of the 1.76 acre property have been landscaped and the rest only graded. The property is split by improved Yarrow Drive. It was annexed to the City after the large industrial park annexation that surrounds it. It was not part of the prezoning for the park. Therefore, it was automatically zoned L-C. All of the subject property is within the recorded subdivision for the Industrial Park. The lines of the zone change do not follow the lot lines.
