TRP.NS10i.'i'rTION, FOR THE RELOCATION OF WATER FACILITIES IN ELM AVENUE
Statement of the Matter
When Routa 5 was widened in 1971, a drainage problem was created
at the west freeway ramps in Elm Avenue. The new grade of Elm
Avenue was too flat to efficiently handle surface runoff of storm
and nuisance water. Ponding is evident 'at the westerly ramps and
adjacent areas.
The City Staff has planned for years to extend a permanent storm
drain system from the proposed State Street storm drain easterly
to Route 5. CalTrans has agreed to install approximately 800 ling.
ft. of the storm drain and appurtenant structures to correct the
Y immediate problem of ponding of water at the Route 5 ramps (See
Exhibit 1).. ,The drainage would be discharged in the gutter lines
immediately west of Harding Street where the grade ci Elm Avenue
is much steeper. Tha engineer's estimate for the storm drain
construction is $75,000. Our City water mains conflict with the
proposed storm drain in three locations. The estir.:,ted cost to
lower our waterlines is $6,710. The State of Califo:nia, Department
of Transportation, will pay for the storm drain construction and
the relocation of our waterline•facilities. An agreement between
the City and the State of California Derartinent of Transportation
for relocation of waterline facilities will be required before
work can commence.

RESOLUTION NO. 5055
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE A UTILITIES AGREEKENT FOR THE RELOCATION
OF WATER FACILITIES IN ELM AVENUE.
The City Council of the City of Carlsbad does hereby

resolve as follows:
1. That the Mayor of the City of Carlsbad is hereby
authorized and directed to execute, on behalf of the City of
Carlsbad, that certain Utilities Agreement with the State of
California, Department of Transportation, for the relocation of
water facilities in Elm Avenue, a copy of which is attached
hereto and by this reference incorporated herein.
PASSED, APPROVED AND ADOPTED at a regular meeting of thb
City Council of the City of Carlsbad, California, held April 19,

FIRST PARTY: State of California, acting by and through its Department of Transportation, hereinafter
called STATE.
SECOND PARTY: CITY-. OF...CARLSBAD
hereinafter called OWNER.
Relocation is required of certain utility facilities of OWNER, cost of which is to be borne by STATE because:
the existing facilities are lawfully maintained in their present
location and qualify for relocation at STATE expense under the
provisions of Section 703 of the Streets and Highways Code.
I. WORK TO BE DONE:
Install, remove and/or rearrange water facilities to accommodate
freeway construction on Road 11-SD-5 drainage improvement at
Elm Avenue in Carlsbad as follows:
BY OWNER:
1. Lower 6" water main in Elm Avenue west of Harding St.
2. Lower 6" water main at the intersection of Elm Avenue
and Harding Street.
3. Lower 8" water main in Elm Avenue near Route 5 southbound
ramps.
All work shall be performed substantially in accordance with
OWNER'S estimate dated 12/14/76, a copy of which is on file in
the District Office of the Department of Transportation,
2829 Juan Street, San Diego, California.

OWNER agrees to perform the herein described work with its own
forces and to provide and furnish all necessary labor, materials,
tools and equipment required therefor, and to prosecute said
work diligently to completion.
Minor deviations from the above described relocation may be made and
incidential work performed by the OWNER or the STATE, when mutually
acceptable to both parties and upon approval by the State Engineer.
II. PAYMENT:
The STATE shall pay its share of the actual cost of said relocation within
90 days after receipt of an itemized bill in quintuplicate, signed by a
responsible official of OWNER'S organization, compiled on the basis of
the actual cost and expense. The OW14ER shall maintain records of the
actual costs incurred and charged or allocated to the project in accordancE
with recognized accounting principles.
Detailed records from which the billing is compiled shall be retained
by the OWNER for a period of four yaars from the date of the final bill
and will be available for verification by STATE and Federal auditors.
