Statement of the Matter
The City Council at your meeting of April 19,, 1977 directed
the City Attorney to prepare the necessary documents approving
Tentative Map (CT 77-3) and Planned Unit Development Permit
(PUD-9). The resolutions approving the Tentative Map and
granting the PUD permit are attached.

Recommendation
If the Council desires to approve Tentative Map (CT 77-3),

Manager's Note
This development is in the Leucadia County Water District
and appropriate sewer conditions have been included for
that development in that district.

RESOLUTION NO. 5072
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD, CALIFORNIA,
APPROVING WITH CONDITIONS TENTATIVE
MAP (CT 77-3) FOR A 7-LOT SUBDIVISION
GENERALLY LOCATED ON THE SOUTH SIDE OF
ALMADEN LANE BETWEEN ZAMORA WAY AND
PAMPLONA WAY. APPLICANT: ROBERT S.
PHILLIPS (TARA, LTD.)
WHEREAS, on March 23, 1977 the Carlsbad City Planning
Commission adopted Resolution No. 1343 recommending to the City
Council that Tentative Map (CT 77-3)be conditionally approved;
and
WHEREAS, the City Council of the City of Carlsbad, on
April 19, 1977 considered the recommendations of the Planning
Commission; and
WHEREAS, said Tentative Map has been declared to have a
nonsignificant impact on the environment and a Negative Declaration
•*-.has been prepared and filed in compliance with the requirements of
the City of Carlsbad Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
Resolution No. 1343 constitute the findings of the City Council
in this matter except as they relate to the public facilities
element of the General Plan regarding the availability of sewer
service.
The City Council finds that while such facilities are
available to the site as of the date of this approval, they may
not be available when applications are made for building permits.

The City Council will, by- inclusion of an appropriate condition
to this Tentative Map approval, insure that building permits will
not issue unless sewer service is available. Since the project
can not develop until sewer availability is insured, the Council
is satisfied that the requirements of the public facilities element
of the General Plan have been met insofar as they apply to this
Tentative Subdivision Map approval.
C. That said Tentative Map, together with the provisions
for its design and improvement and subject to the conditions of
this resolution, is consistent with all applicable general and
specific plans of the City of Carlsbad.
D. That Tentative Map (CT 77-3) is hereby approved
subject to all applicable requirements of the Carlsbad Municipal
Code and to the satisfaction of the following conditions:
1. The approval is granted for the land described in
the application and any attachments thereto and as -
shown on the plot plan submitted labeled Exhibit A,
dated January 31, 1977 on file in the Planning
Department and incorporated by reference herein.
2. Park-in-lieu fees shall be required to the satis-
faction of the Parks and Recreation Director prior
to approval of the final map.
3. This subdivision is approved upon the express
condition that building permits will not be issued
for the development on the subject property unless
the City Engineer determines that sewer facilities
are available at the time of application for such
permit and will continue to be available until time
of occupancy. If the City Engineer determines that
sewer facilities are not available, building permits
will not be issued until arrangements, satisfactory
to the City Council can be made to guarantee that
all necessary sewer facilities will be available
prior to occupancy. This condition shall be noted
on the final map.

A RESOLUTION OF THE C?iTY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
'A PLANNED UNIT DEVELOPMENT PERMIT (PUD-9)
FOR SIX SINGLE FAMILY DETACHED HOMES ON
APPROXIMATELY 1.66 ACRES GENERALLY LOCATED
ON THE SOUTH SIDE OF ALMADEN LANE BETWEEN
ZAMORA WAY AND PAMPLONA WAY. APPLICANT:
ROBERT S. PHILLIPS (TARA, LTD.)
WHEREAS, the Planning Commission of the City of Carlsbad
did on March 23, 1977 hold a duly noticed public hearing to
consider the application of Robert S. Phillips for a Planned Unit
Development permit for six single family detached homes on
property generally located on the south side of Almaden Lane
between Zamora Way and Pamplona Way, more particularly described
as: •
That portion of land situated in the State of
California, County of San Diego, and described
as follows - Lot 188 of La Costa.Valley Unit No. 4,
in the County of San,Diego, State of California,
according to map thereof No. 5781 filed in the office
of County Recorder of San Diego County, September 14,
1966. Assessor's Book 215, Page 231, Parcel 16 and
Book 215, Page 231, Parcel 15 and Book 215, Page 231,
Parcel 17;
and -
WHEREAS, said Planned Unit Development has been declared
to have a nonsignificant impact on the environment and a
Negative Declaration has been prepared and filed in compliance
with the requirements of the City of Carlsbad Environmental
Protection Ordinance of 1972; and
WHEREAS, at the conclusion of said hearing, the Planning
Commission of the City of Carlsbad, adopted Resolution No. 1342;
and
WHEREAS, on April 19, 1977 the City Council held a public

hearing on the matter and received all recommendations and heard
all persons interested in or oppo^bd to the approval of Planned
Unit Development Permit (PUD-9);
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That findings 1 through 3 as outlined in Planning
Commission Resolution No. 1342 constitute the findings of the
City Council with the addition of finding No. 4 as follows:
"4. The project meets design criteria as required
by PUD regulations because:
a) The PUD is comprehensively planned to provide
a usable area for recreation and visitor
parking that could not be developed if
lots were individually subdivided.
b) The PUD addresses the problem of grading
and access that could not adequately be
solved with a public road as access.
c) This,PUD is similar in character to the
adjacent condominium development tb the west.
d) The PUD provides an efficient private drive
that by its smaller size and design does
not dominate the development.
e) The design of the buildings are of high
quality and will be compatible with the
neighborhood and community."
C. That the Planned Unit Development Permit is granted
for the reasons set out in this resolution and subject to all
applicable requirements of the Carlsbad Municipal Code and to
the satisfaction of the following conditions:
1. The approval is granted for the land described
in the application and any attachments thereto, and
as shown on the Plot Plan submitted labeled Exhibit A
(10 sheets), dated January 31, 1977 on file in the
Planning Department and incorporated by reference

landscaping and other facilities or features shall
be located substantially as shown on Exhibit A unless
otherwise provided herein.
2. All conditions shall be appropriately completed
and the project commenced within 18 months from final
City action.
3. All setbacks and building locations shall adhere
to the dimensions shown on Exhibit A, sheet No. 2,
titled "Technical Site Plan".
4. Prior to the issuance of grading permits, the
City Engineer shall approve a plan submitted by the
applicant for interim erosion control on all man-
made slopes in excess of five feet within the boundari
of this subdivision. Prior to this issuance of
grading permits, the applicant shall post bonds and
agreements ensuring the installation and maintenance
of the erosion control system until permanent land-
scaping is installed and maintained.
5. Prior to the issuance of any building permits,
the applicant shall submit a permanent landscaping
and irrigation plan to the Parks and Recreation
Director for his approval. The plan shall include
all artificial slopes. These slopes shall:
a) Utilize fire-retardant, drought-resistant
landscaping which includes trees and shrubs
which reach a variety of sizes at jnaturity;
and
b) Utilize an irrigation system appropriate,
for common maintenance of the required
landscaping in conformance with Conditions
5 and 6. ..
6. The final PUD plan and landscaping plan shall
be submitted to and approved by the Fire Marshal,
to insure adequate turning radii, prior to issuance
of building permits.
7. Permanent landscaping and irrigation shall be
installed on all lots identified in Conditions before
any of those lots are occupied. If residential
construction occurs in units, this condition shall
be met on a unit-by-unit basis.
8. A fire hydrant with required fire flows shall
be in service and accessible prior to combustibles
on site to the satisfaction of the Fire Marshal.
9. Pursuant to the Carlsbad Municipal Water
District's water service policies, individual service!
and water meters will be required to each of the
dwelling units. In addition, extension of the

public water system within the private easement area
to accommodate- water— service requirements and fire
service requirements will be a requirement of the
. subdivision development in the event such determinatioi
is made by the Fire Department and the District.
10. The development will be required to conform to
all applicable policies and ordinances of the District
with respect to the public water service.
11. The final PUD plan shall reflect all applicable
conditions herein, and shall be submitted to the
Planning Director for review and the City Clerk
for filing prior to building permit issuance.
12. The private entrance drive shall have a minimum
width of 24 feet and indicated as such on Final PUD
Plan.
13. The swimming pool shall be heated by solar
energy. Plans with calculations as to the effective-
ness of the system shall be submitted to the Building
Director prior to any building permits on the site.
The heating system shall be shown on the final PUD
Plan.
14. The project may be constructed in phases. The
entrance drive and the pool with solar heating
system, along with all other common amenities for
Phase 1, shall be constructed in conjunction with
Phase 1.

Carlsbad City Council held on the 3rd day of May / 1977
