DEWHURST AND TONY HOWARD-JONES Statement of the Matter The City Council at your meeting of April 19, 1977, directed the City Attorney to prepare the necessary documents approv- ing Zone Change 188. The resolution approving the zone change and the ordinance adopting the zone change are are attached. Exhibits Resolution No. *$~& 7/ Ordinance No. Recommendation If the Council desires to approve Zone Change 188 and grant the change of zone, your action is to adopt Resolution No. SfOfl and introduce Ordinance No . Manager ' s Note The City Council should consider each zone change which comes before you to determine if it conforms to the General Plan Public Facilities requirement. The staff feels that this zone change will not add any requirement for sewer capacity and should therefore, be approved. APPLICANT: D. K. DEWHURST AND TONY HOWARD-JONES . WHEREAS, on October'13, 1976, a duly advertised public hearing was held before the Planning Commission in the manner prescribed by law to consider a change of zone from R-P (Residentia Professional) to C-2 (General Commercial) on property as shown on map marked ZC-188, Exhibit A, attached hereto and made a part hereof; and WHEREAS, at the conclusion of said hearing the Planning Commission of the City of Carlsbad adopted Resolution No. 1345 recommending said zone change which is herewith referred to and 'made a part hereof; and WHEREAS, oh April 19, 1977, the City Council held a public hearing on the matter, received all recommendations and heard all persons interested in or opposed to the proposed change of zone; and WHEREAS, the Planning Director has determined that said change of zone will have a nonsignificant impact on the environ- ment, and a Negative Declaration has been prepared and filed in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972 and the California Environmental Quality Act; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 0 0 zujo 1 2 3 4 5 6 7 8 9 10 11 12 I 13 i 14 § 15 d 16 b K * 5 u 17 18 19 20 21 22 23 24 25 26 27 28 1. That the above recitations-are true and correct. 2. That the City Council of the City of Carlsbad intends to adopt an ordinance to effectuate the proposed change of zone. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: Title 21 of the Carlsbad Muncipal Code is amended by the amendment of the zoning map to grant a change of zone (ZC-188) from R-P (Residential Professional) to C-2 (General Commercial) on property as shown on map marked ZC-188, Exhibit A, attached hereto and made a part hereof. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption INTRODUCED AND FIRST READ at a meeting of the, Carlsbad City Council held on the 3rd day of May , 1977, and thereafter PASSED AND ADOPTED at a meeting of said City Council held on the 17thday of May , 1977 by the following vote, to wit: AYES: Councilmen Frazee, Lewis, Packard and CounciIwoman Casler NOES: None ABSENT: Councilman Skotni.cki.
