APPOINTMENT OF PLANNING COMMISSIONERS
Statement of the Matter
The City Council, at your adjourned meeting of April 12, 1977, directed the City Attorney to prepare an ordinance amending the provisions of the Municipal Code regarding the appointment of Planning Commissioners to provide that the appointment should be made by a majority vote of the City Council. An ordinance amending Section 2.24.020 of the
Municipal Code to that effect is attached. A strikeout
copy of the ordinance showing the changes is also attached.
The ordinance also adds a provision to the code, consistent
with an existing practice, to the effect that a Planning Commissioner holds office until he is reappointed or a successor
is appointed notwithstanding that his term may have expired.
- There are other changes to Chapter 2.24 regarding the Planning
Commission which might be considered by the Council such as provisions for the removal of members, their compensation, power
to adopt rules of procedure, limitation on number of terms, and other related matters. If the Council wishes to consider
any of these changes further, they could so indicate by giving further direc-tionsto the City Attorney

Recommendation
If the City Council wishes to amend the Municipal Code to
provide for the appointment of Planning Commissioners by
a majority vote of the Council, your action is to introduce Ordinance No. /A&#

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 2, CHAPTER 2.24 OF THE CARLSBAD
MUNICIPAL CODE BY THE AMENDMENT OF SECTION
2.24.020 TO PROVIDE FOR THE APPOINTMENT OF
THE CITY COUNCIL. PLANNING COMMISSIONERS BY MAJORITY VOTE OF
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: That Title 2, Chapter 2.24, of the Carlsbad
Municipal Code is amended by the amendment of Section 2.24.020
to read as follows:
"2.24.020 Composition--Appointment. The planning
commission shall consist of seven members who shall be appointed
by a majority vote of the council, and of four ex officio
members who shell be the city building inspector, the public
works director, the city attorney and the director of planning.
Of the seven members of the commission first appointed hereunder,
two shall be appointed for one year terms, two shall be appointed for three year terms: and one shall be appointed for a four year term. Their successors shall be appointed for terms of four

EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to
the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
