Statement of the Matter On September 3, 1975 the City Council approved the tentative map of Carlsbad Tract 74^25 by .Resolution No. 3706. The subdivider has requested that the subject tentative map be extended for a period of one year to .March 3, 1978. The City Engineer advises that the Engineering, Planning, Building, and Fire Departments have reviewed the request. Having received no objection, it is recommended that the City Council approve the extension of the tentative map subject to the execution and/or fulfillment of all the conditions of Resolution No. 3706 and • Resolution No. EXHIBITS 1. The only revision is a minor one, caused by the realignment of Elm Avenue, in accordance with the City's re- quirement. We desire the project area (known as Phase II) to be separated into 4 phases. Attached is a phasing plan separating the remaining portion of the unrecorded portion into 4 phases. It is felt that the phasing plan will allow for the project development to be more consistent with the market demand. Please be assured that we shall comply with Items B-5, B-8 and B-9 of Planning Commission Resolution No. 1271, and Items B-2, B-3 and B-10 of Planning Commission Resolution No. 1272 prior to the map recordation of the next incremental phase. APPLICANT: -LARWIN 9 10 11 12 14 15 1G 17 18 19 20 23 24 25 26 27 28 WHEREAS, on July 9, 1975, the Carlsbad City Planning Commission adopted Resolution No. 1161 recommending to the City Council that Tentative Map (CT 74-25) be conditionally appro vea: and WHEREAS, the City Council of the City of Carlsbad, on July 15} 1975, considered the recommendation of the Planninc Commission; and . WHEREAS, an Environmental Impact Report was certified as complete for a previously issued entitlement for this project; and the Planning Director has found t-Jie Tentative Map (CT 74-25; to be in prior compliance with the 'City of Carlsbad Environments Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of thc- City of Carlsbad as follows: A. That the above recitations are true and correct. B. That said Tentative Map, together with the provisions for its design and improvement and subject to the conditions of this resolution, is consistent with all applicable general end specific plans of the City of Carlsbad. C. That the findings of the Planning Commission, in Resolution No. 1161, constitute the findings of the City Council inthismatter. The Final Map shall be submitted for approval within eighteen months from the final action by the City Council on the tentative subdivision map. The Final Map shall be in substantial conformance with the tentative subdivision, map, marked Exhibit A, dated February 3, 1975, on file with the City Clerk and incorporated by refereence herein. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances, and State and Federal statutes. 3. All public improvements shall be made in conformity with the City of Carlsbad Standard and the Subdivision Ordinance to the satisfaction of the City Engineer, without cost to the City of Carlsbad and free of all liens and encumbrances. 4. All land and/or easements required for this subdivision shall be granted to the City of Carlsbad without cost tc the City and free of all liens^and encumbrances. 5. The improvement and grading plans shall include a report of a geological investigation and a complete grading plan of the entire site, if required by the City Engineer. The report and plan shall be prepared by a civil engineer licensed by the State of California, and experienced in erosion control, who shall be acceptable to the City Engineer. He shall certify that he has investigated the site and prepared data with full con- sideration of the consequences to the included and neighboring prooerties and in conformance with the Geologic., and Seismic Safety Element of the General Plan. 6. Dedications of public streets shall include a waiver of direct access rights from lots shown on the final m as abutting thereon, except at locations approved by t City Engineer. 7. In order to provide for reasonable fire protection during the construction period, the subdivider shall triai tain passable vehicular access to all buildings and ade- quate fire hydrants with required fire flows and dry-sta pipes shall be installed prior to framing construction. 8. A realigned perpendicular intersection shall be con- structed at Appian Way and Elm Avenue. Appian Way shall be dedicated and improved based on a 60 feet full width within the tentative map boundary and improved based on a 28 foot minimum street section south of the tentative map boundary to a point where it conforms with the exist- ing alignment and grade of Appian Way. The proposed realignment and improvment shall be subject to the appro v a1 : of the City Engineer. « 18. The developer or his successor in interest shall enter into a secured agreement guaranteeing payment of 1/4 of \ the cost of future traffic signals which will be required ', at the intersection of Elm Avenue and El Cam i no Real, and ; 100% of the cost of the future traffic signals at Marron Road and Avenida de Anita. VICINITY AVAP 1 2 3 4 5 6 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 5088 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN EXTENSION OF TENTATIVE MAP FOR 215 LOTS ON A DEVELOPMENT LOCATED ON THE EAST SIDE OF EL CAMINO REAL BETWEEN ELM AVENUE AND MARRON ROAD APPLICANT: LARWIN-SAN DIEGO INC. WHEREAS, the City Council of the City of Carlsbad, on the 3rd day of September 1975 adopted Resolution No. 3706 approving with conditions tentative map CT 74-25; and WHEREAS, the findings of the Planning Commission in Reso- lution No. 1161 constitute the findings of the City Council in this matter except as they relate to the public facilities element of the General Plan regarding the availability of sewer service. The City Council finds that sewer service is not available for this development as of the date of this approval. However, sewer service may be available in the future. The City Council will, by inclusion of an appropriate-condition to this Tentative Subdivision Map approval, insure that the final map will not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the City Council will add a condition that a note be placed on the final map providing that building permits may not be issued for lots in the subdivision unless the City Engineer determines that sewer service is available. Since the final map cannot be approved unless sewer service is available, and building cannot occur within the subdivision unless sewer service remains available, the City Council is satis- fied that the requirements of the public facilities element of the General Plan have been met insofar as they apply to this Tentative Subdivision Map approval WHEREAS, the subdivider has requested a one-year extension of such map, from March 3, 1977 to March 3, 1978; and WHEREAS, the City Council has determined to extend such map; NOW, THEREFORE, BE IT RESOLVED by the City Council of the 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map CT 74-25 is hereby extended, subject to the execution and/or fulfillment of all the conditions of Reso- lution No. 3706 and the following conditions: 1. Conditions No. 12 and 13 of City Council Resolution No. 3706 should be revised as follows: a. Prior to the issuance of any building permits, the applicant shall submit a permanent landscaping and irrigation plan to the Parks and Recreation Director for his approval. The plan shall include all artificial slopes. These slopes shall be landscaped by the standards set forth in the City Council Open Space Maintenance Policy No. 23; b. Landscaping and irrigation shall be installed prior to final occupancy. If residential construction occurs in units, this condition shall be met on a unit-by-unit basis with the exception of those lots with slopes adjacent to Elm Avenue (extended) and facing El Camino Real. Final landscaping and irrigation shall be completed on those slopes adjacent to Elm Avenue and facing El Camino Real prior to issuance of final occupancy for the first homes in the first unit. 2. This subdivision is approved upon the express con- dition that the final map shall not be approved unless the City Council finds, as of the time of such approval, that sewer service is available to serve the subdivision. This subdivision is approved upon the express condition that building permits will not be issued for development on the subject property unless the City Engineer determines that sewer facilities are available at the time of appli- cation for such permit and will continue to be available until time of occupancy. If the City Engineer determines that sewer facilities are not available, building permits will not be issued until arrangements satisfactory to the City Council can be made to -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 guarantee that all necessary sewer facilities will be available prior to occupancy. This condition shall be noted on the final map This Tentative Subdivision Map shall be subject to any further approvals as may be necessary in connection with such plan for the allocation of sewer service among competing uses as the City Council may adopt. If an allocation plan is adopted prior to final map approval, the applicant shall satisfy the requirements of such plan as a further condition of this Tentative Subdivision Map approval. C. That said Tentative Map extension, together with the provisions for its design and improvement, is consistent with all applicable General and Specific Plans of the City of Carlsbad.
