Subject: AMENDMENT TO PUBLIC EMPLOYEES' RETIREMENT SYSTEM CONTRACT
Statement of the Matter
Insofar as the City Council adopted Resolution No. 3954, dated
July 6, 1976, accepting a Memorandum of Understanding with the
Carlsbad Miscellaneous Employees' Association, Article 10 of
which would call for an amendment to the present contract with the
Public Employees' Retirement System, the attached rOpolution of
intent to amend wouad provide "service credit at retire_-ment for
unused sick leave."

RESOLUTION NO. 5084
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, OF INTENTION
TO APPROVE AN AMENDMENT TO CONTRACT BE-
TWEEN THE BOARD OF ADMINISTRATION OF THE
PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND
THE CITY COUNCIL OF THE CITY OF CARLSBAD.
WHEREAS, the Public Employees' Retirement Law permits the
participation of public agencies and their employees in the
Public Employees' Retirement System by the execution of a
contract, and sets forth the procedure by which said public
agencies may elect to subject themselves and their employees
to amendments to said law; and
WHEREAS, one of the steps in the procedure to amend this,
contract is the adoption by the City Council of the City of
Carlsbad of a resolution giving notice of its intention to approve)
an amendment to said contract, which resolution shall contain
a summary of the change proposed in said contract; and
WHEREAS', the following is a statement of the proposed
changes:
5.d. Section 20862.8 (providing service credit
at retirement for unused sick leave).
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Carlsbad does hereby give notice of intention to
approve an amendment to the contract between the City of Carlsbad
and the Board of Administration of the Public Employees'
Retirement System, a copy of said amendment being attached
hereto as EXHIBIT A, and by this reference made a part hereof.

AMENDMENT TO CONTRACT BETWEEN THE
BOARD OF ADMINISTRATION
PUBLIC EMPLOYEES' RETIREMENT SYSTEM
AND THE
CITY COUNCIL
OF THE
CITY OF CARLSBAD

The Board of Administration, Public Employees' Retirement
System, hereinafter referred to as Board and the City Council of the
City of Carlsbad, hereinafter referred to as Public Agency, having
entered into a contract under date of December 23, 1955, effective
January 1, 1956, as amended effective July 1, 1957, January 1,

Government Code, shall cease to be an employer"

Retirement Law effective as of the effective date
of this amendment to this contract. Accumulated
contributions of the Public Agency as of the date
