STREET LIGHTING MAINTENANCE DISTRICT 1
Statement of the Matter
Presently there are three Street Light Maintenance Districts within
the City which expire on June 30, 1977. It is necessary to reform
the districts effective July 1, 1977 if the Council wishes to
continue the practice of assessing the lighting maintenance costs
to the benefiting properties.
The law firm of F. MacKenzie Brown, Inc., was retained to review the
City's Lighting Maintenance Districts and, after consultation, it was
decided that the following action should be taken:
1. Consolidate the three lighting districts into one district using
zones to reflect different levels of service;
2. Use the Street Lighting Act of 1919 for legal "procedures since it
provides for a five (5) year duration with a proviso for annex-
ations as development occurs.

To initiate the proceedings it is required that Council take action
to approve plans and specifications, cost estimate diagram and'
assessment, and adopt the Resolution- of Intention.

RESOLUTION OF THE CITY COUNCIL ORDERING THE ' .
CITY ENGINEER TO PREPARE PLANS, SPECIFICATIONS,
COST ESTIMATE, DIAGRAM, ASSESSMENT AND REPORT
PURSUANT TO THE PROVISIONS OF DIVISION 14,
PART 1, OF THE STREETS AND HIGHWAYS CODE OF THE
STATE OF CALIFORNIA FOR PROCEEDINGS FOR FORMA-
TION OF A STREET LIGHTING DISTRICT WITHIN SAID
CITY.
STREET LIGHTING DISTRICT NO. 1
WHEREAS, the public convenience and necessity requires
and it is the intention of this City Council to initiate proceed-
ings for the furnishing of energy and the maintenance of street
lights in the City limits in a street lighting district known
and designated as
STREET LIGHTING DISTRICT NO. 1
(hereinafter referred to as the "Street Lighting District"); and,
WHEREAS, said proceedings for the Street Lighting District
shall be for continual maintenance for a period of FIVE (5)
years, beginning on the 1st day of JULY. 1977 and ending
on the 30th day of JUNE, 1982 ; and,
WHEREAS, proceedings for. the proposed maintenance work
will be taken pursuant to the provisions of Division 14, Part 1
of the Streets and Highways Code of the State of California, "The
Street Lighting Act of 1919; and,
WHEREAS, there has been, at this time, submitted to
this City Council for its consideration a "Map" showing the
boundaries of the area proposed to be included in said Street
Lighting District and said Map further shows and describes,
in general, a description of the works of improvement to be main-
tained under these proceedings and said description is general
in its nature and sufficient to identify the works of improvement
and the areas proposed to be assessed; and,
WHEREAS, the provisions of said Division 14, Part 1,

require a written Report concerning the proposed improvements and
maintenance and service. Said Report shall consist of the
following:
: ' 1. Plans and Specifications of the area of the
works of improvement;
2. An estimate of the costs for maintaining the
improvements for the period as proposed;
3. A diagram of the area within the Street
Lighting District;
4. An assessment of the total amount of costs and
expenses for the maintenance work, service, or improve-
ment.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL
OF THE
CITY OF CARLSBAD
AS FOLLOWS:
SECTION 1. That the above recitals are all true and
correct.
SECTION 2. That a map entitled "Street Lighting District
No. 1" , as submitted by the City Engineer, showing the boundaries of
the proposed area and showing the works of improvements to be main-
tained is hereby approved and adopted by this City Council and a
copy shall be on file in the Office of the City Clerk and open for
public inspection. The proposed parcels and properties as shown
on said map are those proposed to be assessed to pay certain of the
costs and expenses for said maintenance.
SECTION 3. That the proposed maintenance work within the
area proposed to be assessed shall be for street lighting improvements
as said maintenance work is set forth and shown in the Engineer's
Report to be presented to this City Council for consideration.

• SECTION 4. That the City Engineer is ordered to prepare
and file with this City Council a Report relating to said Street
Lighting District in accordance with Chapter 3., Part 1; Division 14
commencing with Section 18040 of the Streets and Highways Code.
SECTION 5. That upon completion, the City Engineer shall
file said Report with the City Clerk who shall then submit the same to
the City Council for its consideration pursuant to Section 18042 of
said Streets and Highways Code.

RESOLUTION OF THE CITY COUNCIL APPROVING THE
ENGINEER'S REPORT FOR CERTAIN STREET LIGHTING
MAINTENANCE IN A STREET LIGHTING DISTRICT WITH-
IN SAID CITY.
STREET LIGHTING .DISTRICT NO. 1
WHEREAS, pursuant to the provisioh's of Division 14,
Part 1, of the Streets and Highways Code of the State of California,
being known as the "Street Lighting Act of 1919", this City Council
did, by previous resolution, order the preparation of an Engineer's
Report consisting of plans and specifications, an estimate of
the cost, a diagram of the street lighting district and an assess-
ment for certain street lighting maintenance and service in what
is known and designated as
STREET LIGHTING DISTRICT NO. 1
(hereinafter referred to as the "Street Lighting District"); and,
WHEREAS, there has been presented to this City Council,
the Report, as required by Division 14 of the Streets and Highways
Code and as previously directed by Resolution; and,
WHEREAS, this City Council has now carefully examined
and reviewed the Report as presented and is satisfied with each
and all of the items and documents as set forth therein and is
satisfied that the assessments, on a preliminary basis, have
been spread in accordance with the benefits received from the
maintenance to be performed as set forth in said Report.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY
COUNCIL OF THE
CITY OF CARLSBAD
AS FOLLOWS:
SECTION 1. That the above recitals are all true and
correct.

REPORT OF THE CITY ENGINEER
Pursuant to instructions and a Resolution of the City
Council/ submitted herewith is the Report, consisting of the
following documents pursuant to the provisions of Division 14,
Part 1 of the Streets and Highways Code of the State of California:
1. Plans and Specifications for the improvements
showing and describing the existing and proposed improve-
ments to be maintained. Said plans are sufficient as
they show or describe the general nature, location and
extent of the proposed works of improvements to be main-
tained. Where a street lighting district is divided
into zones, the plans and specifications indicate the
class and type of improvements within each zone.
2. An Estimate of the Costs of the improvements
to be maintained for the period of time during which
it is proposed to be continued.
3. A Diagram of the Street Lighting District.
Said Diagram shall show the exterior boundaries of the
Street Lighting District, the boundaries of any zones
within the Street Lighting District, the lines and
dimensions of each lot or parcel within said Street
Lighting District and each parcel shall be identified
by a distinctive number or letter. The lines and di-
mensions of each lot shall conform to those shown on
the County Assessor's map for the fiscal year to which
the Report applies.

' 4 . An Assessment of the Estimated Costs of the
Improvements. The Assessment shall refer to the fiscal
year to 'which it applies and shall state. the net amount
to be assessed upon the assessable lands within the
District, it shall further describe each assessable
lot and assess the net amount upon all assessable.
lands within the District by apportioning said amount
in proportion to the estimated benefit to be received.
The assessment may refer to the County Assessment Roll
for a description of said parcel.
All lots and parcels of land known as public
property, defined under Section 18014 of Part 1 of
Division 14 of the Streets and Highways Code of the
State of California, as amended, have been omitted
and are exempt from any -assessment under these pro-
ceedings.

WHEREAS, this City Cduncil is considering the formation
of a Street Lighting District, pursuant to the provisions of
Division 14, Part 1, of the Streets and Highways Code of the
State of California, as amended, being the "Street Lighting
Act of 1919", for a street lighting district within said City
to be known and designated as
STREET LIGHTING DISTRICT NO. 1
(hereinafter referred to as the "Street Lighting District"); and,
WHEREAS, at this time, there has been presented and
approved by this City Council, a Report by the City Engineer as
required by law, and at this time, this City Council is desirous
of proceeding with the formation of said Street Lighting District.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL
OF THE
CITY OF CARLSBAD
AS FOLLOWS:
SECTION 1. That the above recitals are all true and .
correct.
SECTION 2. PUBLIC INTEREST; That the public interest
and convenience requires, and it is the intention of this City
Council to order those certain fixtures and appliances on por-
tions of streets, avenues, places, parkways and public ways within
this City, as shown on that certain diagram and plan, all being
a part of the Report of the City Engineer, on file in the Office
'of the City-Clerk/ to be maintained and 'current .to (be furnished
•for lighting'said fixtures and appliances for'a period of FIVE (5)
years, commencing on the 1st . day of JULY, 1977 and
ending on the 3Othday of JUNE, 1982 , all in accordance with
the Report of said City Engineer. Said Report of the City Engineer
is hereby referred, to and by such reference is made a part hereof.
All of the work and approvement as above set forth shall
be done in accordance with the plans and specifications referred
to and for particulars, reference is made to said plans and speci-
fications as on file in the Office of the City Clerk.
SECTION 3. BOUNDARIES OF DISTRICT; That the work and
improvement and maintenance and service contemplated, is of
direct benefit to the properties within the boundaries of the
Street Lighting District and this City Council hereby makes the
expense of said work, maintenance and service and improvement
chargeable upon -a district, which district said City Council
hereby declares to be the district benefited by said work and
improvement, and to be assessed to pay the cost and expense
thereof, which said district is all that portion of the City
as shown on the assessment diagram on file in the Office of
the City Clerk and said Diagram indicates the extent of said
Street Lighting District and the exterior boundaries thereof,
and reference is hereby made to said Diagram and' Plan for a com-
plete and detailed description of said district, excepting there-
from any public street or way, which may be included in said
district. Said Diagram and Plan shall govern for all details
as to the extent of said Street Lighting District.
SECTION 4. PUBLIC PROPERTY; That any lots or parcels
of land known as public property, as the same are defined in
Section 18014 of Division 14, Part 1, of the Streets and Highways

Code, which are included within the boundaries of the'Street
Lighting District, shall'be' omitted and exempt from any assess-

SECTION 7. DESCRIPTION OF MAINTENANCE: That the im-
provements for which said Street Lighting District is to be
formed and the assessments levied and collected shall be for
the maintenance of certain street lighting as set forth on
Exhibit "A" hereto attached, referenced and so incorporated.
SECTION 8. REPORT: That the Report of the Engineer
regarding the formation of the Street Lighting District is as
previously aoproved and is on file in the Office of the City• * .Clerk and open for public inspection.

Public Hearing and further, said publication shall be by two
(2) successive insertions in a daily or weekly newspaper.
SECTION 10. POSTING; That the City Clerk shall cause
to be conspicuously posted along all streets in the Street Lighting
District, where the improvement is proposed to be maintained, at
not more than three hundred (300) feet apart, but not less than
three (3) in all. Notices of the passage of the Resolution of
Intention; said posting of Notices shall be completed at least
ten (10) days prior to the date set for Public Hearing.
SECTION 11. EFFECTIVE DATE; That upon its adoption,
this Resolution shall take effect immediately.
SECTION 12. TAX COLLECTOR; That a certified copy of
the assessment roll and diagram, upon its confirmation, is to be
recorded in the Office of the Tax Collector and for the proceed-
ings herein

The following is a general description of the lighting
systems to be maintained in the street lighting district in the
City of Carlsbad, California, pursuant to the terms and provisions
of the "Street Lighting Act of 1919", being Division 14, Part 1
of the Streets and Highways Code of the State of California;
said street lighting district is known and designated as STREET
LIGHTING DISTRICT NO. 1:
The Street Light System to be maintained consists of
1067 City owned lights on ornamental standards, 333
utility owned lights on wood poles, and 323 utility
owned lights on ornamental standards. The lights
are located as shown on map entitled, "Map of Lighting
District 1977-1982".
The maintenance of the system shall consist of cleaning
lenses and standards, replacing bulbs, photoelectric
cells, ballasts, and wire, as necessary.

MEMORANDUM

SUBJECT: Contract for Energy - High Pressure Sodium Vapor Lights
The City currently has executed agreements for electrical energy with
SDG&E. These agreements are generally described as the LS-1 and LS-4
rate schedules and originally covered only mercury vapor lights.
We have had several high pressure sodium vapor lights installed and
have paid the current rates. When these were installed SDG&E forwarded
a contract covering them; however, this was never executed. (I believe
it must have been misplaced during one of the several personnel changes
in Engineering). SDG&E has once again asked to have the agreement
executed and it is being forwarded as an agenda bill and resolution in
order that the Mayor can execute the agreement. It is similar to ones
executed by Mayor Frazee in 1977 when the District was formed.
Currently, the rate for the 250 watt high pressure sodium vapor light
is $14.85 per month per light. These rates are approved by the PUC.
The cost of these lights is spread to those who benefit, on the basis
of our Lighting District proceedings.

6 WHEREAS, this City Council has conducted proceedings for the formation of
7 a Street Lighting District pursuant to the provisions of Division 14, Part 1,
8 of the Streets and Highways Code of the State of California, as amended,
9 being the "Street Lighting Act of 1919", for Street Lighting District within
10 said City known and designated as

12 (hereinafter referred to as the "Street Lighting District"); and
13 WHEREAS, it is necessary for the City at this time to contract for the
14 energy to power said system and for other necessary items for the continual
15 operation and maintenance of said system as required for the "Street Lighting

17 WHEREAS, Section 18171 of the Streets and Highways Code of the State of
18 California authorizes the City Council to determine that there is only one
19 contractor practically capable of serving the street lighting system as set
20 forth in the Engineer's Report and, further, to find that such contractor is
21 subject to the jurisdiction of the Public Utilities Commission of the State of
22 California and thus that said contract should be authorized at this time
23 without further competitive bidding;
24 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
25 Carlsbad as follows:
26 SECTION 1. That the above recitals are all true and correct.
27 SECTION 2. That this City Council hereby finds and determines that San
28 Diego Gas & Electric Company is the only contractor capable of serving and

maintaining the street lighting system in the manner provided as set forth in
the plans and specifications and as set forth in the report as approved
pursuant to Division 4 of the Streets and Highways Code, the "Street Lighting
Act of 1919" and, further, that said contractor is subject to the jurisdiction
of the Public Utilities Commission of the State of California. That said
contractor has submitted a contract for the providing of energy and the con-
tinual maintenance of the system and street lighting improvements for the
Street Lighting District and said contract is hereby approved and execution is
hereby authorized by the Mayor and City Clerk.
That the term of said contract shall be for a period of five (5) years,
commencing on the 1st day of January 1978 and ending on the 31st day of
December 1982, all in accordance with the report as previously submitted by
the City Engineer and approved by this City Council.
SECTION 3. That the contract above referred to and herein approved and
all proceedings relating to the providing of energy for high pressure sodium
vapor and the continual maintenance thereof shall be performed and carried out
in accordance with the terms and provisions of Division 14 of the Streets and
Highways Code of the State of California, the "Street Lighting Act of 1919".
SECTION 4. That a copy of the contract for supplying of energy for high
pressure sodium vapor and continual maintenance as herein approved shall be
kept on file in the Office of the City Clerk and remain open at all times for
public inspection.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 3rd day of june » 1980, by the
