Statement of the Matter
As a result of Carlsbad Tract 75-2, Unit No. 2, construction
slope rights granted to'the City of Carlsbad August 11, 1976
are no longer required.
EXHIBITS:

RECOMMENDATIONS;
That the City Council adopt Resolution No.s52> ^^authorizing the
Mayor and City Clerk to execute a quitclaim deed of said construction
slope rights. • . '

6-7-77 Resolution #5099 was adopted, authorizing the Mayor and City Clerk
to execute a quitclaim deed of an .easement for construction slope
rights.

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE MAYOR AND
3 CITY CLERK TO EXECUTE A QUITCLAIM DEED OF AN
EASEMENT FOR CONSTRUCTION SLOPE RIGHTS.

5 WHEREAS, on or about August 11, 1976 the City of Carlsbad
6 acquired an easement for construction slope rights, more particu-
7 larly described in Exhibit "A", attached hereto and made a part
8 hereof; and
9 WHEREAS, this easement is no longer required by the City of
10 Carlsbad;
11 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
12 City of Carlsbad, as follows:
13 1. That the above recitations are true and correct.
14 2. That the Mayor and City Clerk are hereby authorized to
15 execute a Quitclaim Deed in the form shown on Exhibit "A" in favor
16 of Sommers Development Corporation.
17 PASSED, APPROVED, AND ADOPTED at a regular meeting of the
18 Carlsbad City Council held on the 7th day of June , 1977 by
19 the following vote, to wit:
20 AYES: Councilmen Frazee, Lewis, Packard, Skotnicki and
Councilwoman Casler
21 NOES: None
22 ABSENT: None
