Mgr. t\ Subject: CITY QF CARLSBAD/CARLSBAD UNIFIED SCHOOL DISTRICT AGREEMENT FOR USE OF CHILDREN'S SECTION OF LIBRARY Statement of the Matter The School District and the Library Department are requesting joint use of the Children's Section of the Library to conduct summer school and year round intersession programs from June 15, 1977 to September 3, 1977. The City and the District entered into a similar agreement last year. Bussey Carlsbad City Manager 1200 Elm Avenue Carlsbad, California 92008 Dear Mr. Bussey: On June 15, 1977 the governing board of the school district approved the enclosed agreement and authorized that it be signed by the district superintendent, Mr. R, A. Crawford. We believe you will find that the terms of this agreement for district use of facilities and services of the Children's Section of the City Library are essentially the same as those in the agreement which was in effect last summer. If the agreement meets with your approval, we will appreciate your obtaining the required signature on all four copies. Please return three to us and retain one copy for your files. The district is requesting its insurance agent, Mr. Gerald C. McClellan of McClellan Insurance, to prepare the necessary certificate of insurance as described under item No. 3 on page No. 1 of the agreement . Your cooperation in permitting us to make use of your library facilities and services for the summer school and year-round inter- session programs for the children of our community is greatly appreciated. M.D. MARY A. SCHERR HOPE WRISLEY AGREEMENT This Agreement is made and entered into on the 15th day of June, 1977 by and between the Carlsbad Unified School District and the City of Carlsbad. 1. The City of Carlsbad presently owns and operates a public library, including a Children's Section. The Carlsbad Unified School District is in need of the facilities and services of the Children's Section of the City Library for its summer school and year round intersession program and is* willing to rent proposed facilities of the Carlsbad City Library under an Agreement. Therefore, it is mutually agreed that: 1. Personnel employed by the District in its educational program shall be under the supervision of the District. And further, that the Head of the Children's Section of the Carlsbad City Library will administer the use of the facilities under his jurisdiction. 2. The District agrees to operate within and maintain the assigned areas in good condition. 3. The District shall provide a certificate of insurance coverage which will hold harmless and free from liability the City of Carlsbad, its officers, agents, servants, or : employees while acting as such from all damages, costs or expenses which any of them shall become obligated to pay by reasc of. liability imposed by 1 because of injury i to property or injury to or death of persons, received or suffered by reason of operation of the educational program upon said premises; and, further, the District shall be responsible for any and all damages to all City of Carlsbad Library property caused as a result of any educational activity being conducted on said premises by the District. 4. The Carlsbad Unified School District shall pay to the City of Carlsbad for the use of its facilities and services, the sum of Five Hundred Dollars ($500.00) for the term of this lease. Said sum shall be paid by the Carlsbad Unified School District to the City of Carlsbad in two equal monthly installments of Two Hundred Fifty Dollars ($250.00) each. Such payment shall be made prior to July 15, 1977 and August 15, 1977. In the event the District is prevented from using the facilities during the term of this Agreement, or any part thereof, by reason of cancellation of the Agreement, such sum shall be re- duced or terminated on a daily use basis as applied to the total contract amount. 5. This Agreement may be cancelled by either party by written notice no less than fifteen (15) calendar days prior to the date of cancellation. - 2 - This Agreement and services hereunder s.^all be- effective on the 15th day of June, 1977, and shall thereafter continue to and include the 3rd day of September, 1977. Notwithstanding any other provision of this agreement to the contrary, this Agreement may be terminated at any time by either party. In witness whereof, the parties hereto have caused this Agreement to be executed on their behalf.
