The subdivider has" requested that the subject tentative map be extended for a period of one year to May 18, 1978. The City Engineer advises that the Engineering, Planning, Building, and Fire Departments have reviewed the request. Having received no objection, it is recommended that the City Council approve the extension of the tentative map subject to the execution and/or fulfillment of all the conditions of Resolution No. 3786 and Resolution No.^73/7 which includes a requirement that the Final Map cannot be approved by City Council until sewer service is available to serve the project. APPLICANT: REGAN CONSTRUCTION, WHEREAS, on October'15, 1975, The Carlsbad City Planning Commission adopted Resolution No. 1197 recommending to the City Council that Tentative Map (CT 75-8) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on November 4, 1975, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That said Tentative Map, together with the provisions •t for its design and improvement and subject to the, conditions of this resolution, is consistent with all applicable general and specific plans of the City of Carlsbad. C. That Tentative Map (CT 75-8) is hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. The approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated August 25, 1975 on file in the Planning Department and incorporated by reference herein. The location of all buildings, fences, signs, roadway, parking areas, landscaping and other facilities or features shall be located substantially as shown on Exhibit A, except or unless indicated otherwise herein. All buildings and structures shall be of the design as shown on the elevation plans labeled Exhibit A. 2. The Final Map shall be submitted for approval within 18 months from the final action by the City Council on the tentative subdivision map. The Final Map shall be in substantial conformance with the Tentative Subdivision Map. 3. In order to provide for reasonable fire protection - during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 4. Ornamental street lighting shall be provided for as required by Municipal Ordinance. The developer shall deposit cash in the amount necessary to energize said street lights for an eighteen month period after con- • struction, to permit the incorporation of the subdivision into a maintenance district. 5. All land and/or easements required shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the final map unless approved by the City Engineer. 6. Half street frontage improvements shall be installed in Pine Avenue, based on a 30 foot half street section. The sidewalk shall be installed as to minimize the removal of existing trees, as approved by the City Engineer. 7. Washington Avenue shall be dedicatd and improved on the basis of a 30 foot half street width along the property frontage. Dedication shall include a 20 foot radius property line return at the intersection of Washington Avenue and Pine Street. Improvements shall include a complete cross gutter across Pine Street, 2. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 designed to conform with future improvement of Pine Street and Washington Avenue. 8. Park-in-lieu fees shall be granted to the City prior to City Council approval of the Final Map. 9. The CC&R's for this development shall be submitted to the Planning Director for review and approval prior to the approval of the Final Map. 10.No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Carlsbad. 11.Prior to the issuance of any building permits,, a study of the noise levels on the project site shall be made by an acoustical engineer experienced in noise attenuation. Said study shall determine if attenuation measures are necessary to bring noise levels within 65 db(A) outdoors and 45 db(A) indoors. Said study shall recommend such attenuation measures as deemed necessary, and shall be consistent with applicable provisions contained in the Noise Element of the General Plan and consistent with appropriate sections of the Uniform Building Code. APPLICANT; REGAN CONSTRUCTION 6 WHEREAS, the City Council of the City of Carlsbad on the n 7 18th day of November, 1975 adopted Resolution No. 3786 approving 8 with conditions tentative map CT 75-8; and 9 WHEREAS, the findings of the Planning Commission in 10 Resolution No. 1197 constitute the findings of the City Council in 11 this matter except as they relate to the public facilities element 12 of the General Plan regarding the availability of sewer service. 13 The City Council finds that sewer service is not available for 14 this development as of the date of this approval. However, sewer 15 service may be available in the future. The City Council will, by 16 inclusion of an appropriate condition to this Tentative Subdivisio 17 Map approval, insure that the final map will not be approved un- 18 less the City Council finds that sewer service is available to 19 serve the project. In addition, the City Council will add a con- 20 dition that a note be placed on the final map providing that 21 building permits may not be issued for lots in the subdivision 22 unless the City Engineer determines that sewer service is avail- 23 able. 24 Since the final map cannot be approved unless sewer 25 service is available, and building cannot occur within the sub- 26 division unless sewer service remains available, the City Council 27 is satisfied that the requirements of the public facilities 28 element of the General Plan have been met insofar as they apply 29 to this Tentative Subdivision Map approval. 30 WHEREAS, the subdivider has requested a one-year extensio 31 of such map, from May 18, 1977 to May 18, 1978; and 32 WHEREAS, the City Council has determined to extend such 7 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 map; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map CT 75-8 is hereby extended, subject to the execution and/or fulfillment of all the conditions of Resolution No. 3786 and the following conditions: 1. This subdivision is approved upon the express con- dition that the final map shall not be approved unless the City Council finds, as of the time of such approval, that sewer service is available to serve the subdivision. 2. This subdivision is approved upon the express con- dition that building permits will not be issued for development on the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such permit and will continue to be available until time of occupancy. If the City Engineer determines that sewer facilities are not available, building permits will not be issued until arrangements satisfactory to the City Council can be made to guarantee that all necessary sewer facilities will be available prior to occupancy. This condition shall be noted on the final map. 3. This Tentative Subdivision Map shall be subject to any further approvals as may be necessary in connection with such plan for the allocation of sewer service among competing uses as the City Council may adopt. If an allocation plan is adopted prior to final map approval, the- applicant shall satisfy the requirements of such plan as a further condition of this Tentative Subdivision Map approval. C.
