B. Release of Cash Deposit _
Statement of the Matter
1. Engineering Staff has completed checking the Final Map of Carlsbad
Tract 76-17 (Canon Park) for conformance with the State Subdivision
Map Act and applicable local ordinances of the City of Carlsbad. The
Final Map conforms substantially with the conditions of the Tentative
Map approved by the City Council on February 1, 1977 by Resolution
No. *t080.
2. In order to comply with Condition No. 13 of Resolution No. k08] ap-
proving the planned unit development, the developer posted $99,000
as an improvement security for erosion control and maintenance cost
prior to issuance of a grading permit. Due to the timing, they
posted the above-mentroned cash with the understanding that it will
be released upon submittal of the applicable bonds. The developer
has submitted a faithful performance bond and labor and material bond
in the total amount set forth above and is requesting the release of
$99,000.

Recommendation
Adopt a motion approving the Final Map of CT 76-17 (Canton Park) and
direct the Finance Director to release the amount of $99,000 (Ac-
count No. 65-83A-0519) and, due to Leucadia County Water District's
declaration of sewer moratorium, direct the City Engineer to add an
appropriate note on the final map to state that, "This map has been
approved upon the express condition that building permits shall not
be issued for any development within this final map until the City
Manager determines that sewer service is available for such develop-
. ment."

7-5-77 The final map for C/T 76-17 (Canon Park) was approved and the
Finance Director directed to release ttie amount of $99,000.
The City Engineer was directed to add an appropriate note on

Gentlemen: Engineering Department
On or about February 17, 1977, La Costa Land Company delivered to the
City of Carlsbad an executed Improvement Agreement for the installation
and maintenance of the erosion control system. Along with that agree-
ment, the City of Carlsbad was delivered a check in the amount of
$15,000.00.
On or about May 12, 1977, the City of Carlsbad was delivered Improve-
ment Agreement duly executed by La Costa Land Company for erosion con-
trol and maintenance cost. Along with that agreement, the City of
Carlsbad was delivered a check in the amount of $84,000.00.
At that time, it was our joint understanding that at the time we pre-
sented Faithful Performance Bonds and Labor and Material Bonds in the
total amounts set forth above, the City of Carlsbad would return to
La Costa Land Company its cash deposit.
It is further understood that you have received the necessary bonds
along with all other fees due to the City of Carlsbad.
We respectfully request that at the time of the approval by the City
Council of the City of Carlsbad of the recordation of the map for
Carlsbad Tract No. 76-17, that the City Council of the City of
Carlsbad authorize you to release cash deposits in the amount
