STATEMENT OF THE MATTER::
On April 27, 1977, the Planning Commission denied request for
Specific Plan and Conditional Use Permit for a McDonald's fast
food restaurant located on the east side of El Camino Real,
between Haymar Drive and Marron Road. The applicant has appealed
the Planning Commission action.
Agenda Bill 5089 was sent to City Council on June 7, 1977 and continued
to July 5, 1977.

RECOMMENDATION
Distributed to City Council with
Agenda Bill No. 5089.
It is recommended that the City Council deny the applicant's request
for appeal for the reasons contained in the Planning Commission
Resolutions 1360 and 1361. If the City Council does not agree with the
action of the Planning Commission denying this application, it is
recommended that the City Council refer their findings to the Planning
Commission on the matter requesting a further report from the
Planning Commission.

If City Council concurs with the Planning Commission, refer to the
City Attorney for preparation of necessary documents.
