MODIFICATION OF BUILDING PERMIT PROCEDURES RELATING TO SEWER PERMITS
Statement of the Matter
Due to the volume of activity and backlog of plans in building plan check, the
requirement to obtain a valid sewer permit, as required by Emergency Ordinance
70^7, prior to application for a building permit is creating an administratvie
problem in those areas outside of the City's sewer service area.
Leucadia County Water District has instituted a policy whereby sewer permits
are valid for no more than 30 days unless, within that period of time, a valid
building permit is obtained. If a valid building permit is not obtained within
that period, the sewer permit is revoked and the applicant's fees refunded.
Because of the backlog of plans in plan check in the. Building Department it
takes from seven to ten weeks after application before a building permit can
be issued. This puts an applicant in the position of having his sewer permit
revoked and of having to reapply for a permit if he so desires. The Building
Department has retained additional personnel, but the backlog remains.

On June 2k, 1977 the Board of Directors of the Leucadia County Water District
instituted a moratorium on the issuance of sewer permits. This makes.it
necessary for the City to modify its ordinance to allow for quick action on
our part as the District lifts or reimposes its moratorium.

Recommendation
1. That the existing Emergency Ordinance 70^7 be modified to allow for the
City to accept applications for building permits where sewer service is
provided for other than the City of Carlsbad (Leucadia County Water Dis-
trict and San Marcos County Water District) without the requirement of
having a valid sewer permit;
2. That the Municipal Code be modified to authorize the City Manager to in-
struct staff to accept or refuse to accept applications for building per-
mits,within special district sewer service areas, based on his determina-
tion of the availability of sewer service capacity.
Council action
7-6-77 Ordinance #8072 was introduced for a first reading, establishing
administrative procedures for the issuance of building permits,
in those areas of the City served by Leucadia and San Marcos
County Water Districts.

SUBJECT: Building Permits/Sewer Permits
City Ordinance 70^7, passed by City Council on April 26, 1977, established
a moratorium in the City's sewer service area and provided for the continua-
tion of building permit activity in areas outside of the City's sewer ser-
vice area. With the capacity of these agencies at or approaching zero the
requirement to obtain a valid sewer permit, as required by the emergency
ordinance, prior to application for building permits is causing an admin-
istrative problem due primarily to the volume of activity and the backlog
of plans in the building plan check.
The Leucadia County Water District has instituted a policy whereby sewer
permits are valid for no more than 30 days unless, within that period of
time, a valid building permit is obtained. If an applicant is unable to
obtain a building permit within that time the permit is automatically re-
voked and the applicant's fees refunded. If the applicant wishes he may
reapply for another sewer connection permit.
Because of the backlog of plans in plan check in the Building Department
it takes anywhere from seven to ten weeks after application before a build-
ing permit can be issued. This obviously puts an applicant in the position
of having to reapply for a valid sewer permit. The Building Department has
retained additional personnel to assist in plan checking and building in-
spection but the backlog remains. A proposed course of action that could
resolve the administrative problem while continuing to allow the City to
insure that adequate public facilities are available before the issuance
of building permits would be to:
1. Modify existing Emergency Ordinance 70^7 to allow for the City
to accept applications for building permits where sewer service
is provided for other than the City of Carlsbad (Leucadia County
Water District and San Marcos County Water District) without the
requirement of having a valid sewer permit;
2. Retain the provision of requiring the applicant to have a valid
sewer permit prior to issuance of a building permit;
3. Institute within the Building Department a procedure of checking
daily with the sewer service agencies involved to determine the
number of dwelling units which are still eligible for issuance
of sewer permits;
A. Upon determination that applications for building permits would
exceed the number of valid sewer permits remaining, grant City
Manager authority to administratively order a stop to receipt of
applications for building permits which require additional sewer
capacity.

This procedure has been discussed with Building Department administrative
staff and with the General Manager of the Leucadia County Water District
and appears to be acceptable.
It is anticipated that the Leucadia County Water District will establish a
sewer moratorium effective June 27, 1977. This should not deter us from
taking the recommended action since activity on the part of the Encina
joint owners to lease capacity or intensify operation of the plant or to
start operations of their own reclamation facilities may allow them at some
future date to lift the moratorium for finite periods of time. This will
necessitate the establishment of some administrative procedure which would
allow for the normal handling of business while discouraging applications
on the chance that additional moratoriums may occur in the immediate future.

The Leucadia County Water District has instituted a moratorium within their
service area. While the need for action and basic recommendation remains
the same, the first proposal, as outlined above, should be modified to rec-
comend that the City Manager be given the administrative authority by Coun-
cil to instruct staff to accept or refuse to accept applications for build-
ing permits within those districts' service areas based on his determination
of their availability of sewer service capacity.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING CHAPTER 18.04 OF
THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF
SECTION 18.80.170 TO ESTABLISH ADMINISTRATIVE
PROCEDURES FOR THE ISSUANCE OF BUILDING PERMITS
IN THOSE AREAS OF THE CITY OF CARLSBAD SERVED BY
THE LEUCADIA AND SAN MARCOS COUNTY WATER DISTRICTS
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: That Title 18, Chapter 18.04, Section 18.04.170
of the Carlsbad Municipal Code is amended by the amendment of
subsection (1) to read as follows:
"Building permits for work in that portion of the City of
Carlsbad within the service territory of the San Marcos or
Leucadia County Water Districts shall be processed in accordance
with this subsection.' The City Manager shall monitor the sewage
treatment capacity of said Districts. If the City Manager deter-
mines that capacity is available he may authorize the -Building
Department to accept applications for building permits. If' the
City Manager determines that the amount of sewer capacity necessary
to service the projects in plan check would exceed the available
supply, he shall have authority to order that no additional
applications be accepted. The City Manager shall have authority
to lift or reimpose such order as he determines appropriate based
on the availability of sewer capacity in such districts. Building
permits shall not be issued until the applicant presents a valid
sewer connection permit for the project from said District. The
Director of Building and Housing shall verify that the sewer
permit is valid prior to issuance of the building permit."

EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adoption
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 5th day of July , 1977,
and thereafter

held on the 19th day of July , 1977, by the following
