' ',>,,' /; / AGENDA BILL NO. 3421 - Supplement #4 DATE: - A"9"st 2> 1977 DEPARTMENT: Engineering Subject: ACCEPTANCE OF PUBLIC IMPROVEMENTS - CT 75-4 (La Costa Estates . North) Statement of the Matter The subdivider, La Costa Land Company, has requested the acceptance of public improvements for subject subdivision. A final inspection was conducted and the improvements are found to be acceptable for maintenance. As-built drawings are on file in the Engineering Department, and final accounting is complete. In order to conform with Condition No. 9 of Resolution No. 3709, stating that "El Fuerte shall have a separate bikeway," an 8 ft. wide asphalt concrete bike path contiguous with the curb was built on the southeast side of El Fuerte at a 15% slope. Because the subdivider is required to move several utility facilities that are obstructing a bikeway prior to our acceptance, they feel that this is very expensive or impractical. La Costa Land Company is requesting that we eliminate Condition No. 9 of Resolution No. 3709 (see letter) due to the following reasons: " 1. The street is too steep to become a regularly used bicycle corridor. The few cyclists that would go up that street would be pushing their bikes. The few that go down that street, I am sure would use the street. " 2. The bicycle path is not part of a network of paths. It begins and ends with the subdivision. A field review of this project would clearly show the impracticality and perhaps the absurdity of the path requirement." The above request was reviewed by Engineering, Planning, and Parks and Recreation Departments and all agree that a 15% grade bike path is not practical nor usable. EXHIBITS: 1. Final Accounting 2. That the City Council find that the asphalt paving along the east parkway area of El Fuerte is an acceptable public improvement in that it is in substantial con- formance with Condition No. 9 of Resolution No. 3709, and any additional expense to relocate utility facilities out of said parkway is not warranted because the steepness of the street grade minimizes the functional acceptability of this asphalt paving as a bike path. B. That the City Council accept the public improvements as completed, direct the Utilities/Maintenance Director to commence their maintenance, the Finance Director to release deposits in the amount of $210.88, and the City Clerk to record the Notice of Completion and release the applicable bonds. Bussey City Manager CITY OF CARLSBAD Carlsbad, Ca. 92008 Subject; Estates North - Bicycle Paths Dear Paul: One of the tentative map conditions for Estates North is the installation of a bicycle path on the southeast side of El Fuerte Street, from the top of the project to the bottom of the project. The "bicycle path" has been build exactly as indi- cated on the improvement plans. However, a look at the path in the field shov/s a large number of public facilities located in the path, which, in simple terms, creates an obstacle-course-like situation. The City Engineer has indicated that in order to make this a usable path, that it would be necessary to move several of the utility facilities. Some of the changes that would be required would not only be expensive, but really quite impractical. This letter is a specific request that you take whatever steps are necessary to elimi- nate the tentative map condition for a bike path in this project. The reason for the request is as follows: 1.
