Subject:TENTATIVE MAP APPROVAL, CT 77-11, APPLICANT: LACUNA PROPERTIES

Statement of the Matter
The City Council at your July 19, 1977 meeting directed
the City Attorney to prepare the necessary documents
denying Tentative Subdivision Map (CT 77-11). The resolution
denying the Tentative Subdivision .Map is attached.

Council action
8-2-77 Resolution #5162 was adopted, denying without prejudice tentative

RESOLUTION NO. 5162
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, DENYING WITHOUT
PREJUDICE TENTATIVE SUBDIVISION MAP (CT 77-11)
FOR A 1-LOT 45-UNIT CONDOMINIUM CONVERSION OF
45 EXISTING APARTMENT UNITS GENERALLY LOCATED
ON THE SOUTH SIDE OF LACUNA DRIVE BETWEEN
JEFFERSON STREET AND 1-5 FREEWAY. APPLICANT:
LACUNA PROPERTIES.
WHEREAS, on June 22, 1977 the Carlsbad City Planning
Commission adopted Resolution No. 1379 recommending to the City
Council that Tentative Subdivision Map (CT 77-11) be denied; and
WHEREAS, the City Council of the City of Carlsbad on July 19,
1977 considered the recommendations of the Planning Commission; and
WHEREAS, Said Tentative Map has been declared to be
categorically exempt from the provisions of the City of Carlsbad
Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows: •
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
Resolution No. 1379 constitute the findings of the City Council
in this matter.
C. That the City Council hereby denies without prejudice
the above-referenced subdivision for the reasons contained in
Planning Commission Resolution No. 1379. The denial without
prejudice is to allow the application to be refiled without the
paying of additional fees after adoption by the City Council of
a condominium conversion ordinance.
