FEDERAL AID FOR SAFER OFF -SYSTEM ROADS ACT (SOS)
Statement of the Matter
See attached Exhibit 1. Carlsbad's share of SOS funds is $8,146.06
based on population distribution. The County is responsible for
distributing these funds. Because of the various administrative
steps in making application to the State for both program and
project approvals on these SOS Funds, the County is agreeable to
exc�han ee SOS Funds for Road Funds (Gas Tax). This action would
relieve the City from the administrative burden of the SOS program
and allow the City to spend the funds as Gas Tax Funds.

RECOMMENDATION:
That the Council adopt Resolution No.S' l and direct staff to
request the County to prepare an agreement to exchange SOS -Funds
for an equal amount of Road Funds..
Council action
8-2-77 Resolution #5163 was adopted, approving method of distribution
for funds apportioned Council, and staff was directed to request
County to prepare an agreement.

Dear Mr. Bussey:
The California Department of Transportation by letter, dated June 17, 1977,
(attached) notified the County that under California's Federal Aid for Safer
Off -System Roads Act, $646,248 has been apportioned to the San Diego region
for the fiscal year ending September 30, 1977. These funds are for the con-
struction, reconstruction, and improvement of any toll free road, not on any
federal aid system, which is under the jurisdiction of and maintained by a
public authority and open to public travel.
Role of County Board of Supervisors
In accordance with this Act, on July 12, 1977 the Board of Supervisors
claimed these funds for the San Diego region and directed the Federal Aid
Urban Advisory Committee to develop a cooperative program to distribute
these funds among the cities and the County as required by Section 2530 of
the Streets and Highways Code.
City=County Agreement Required
Section 2530 requires that the distribution of funds among the cities and
the County be determined by agreement between the County and a majority of
the cities, which cities shall include a majority of the municipal population
within the County.
The attached sample draft resolution for your City Council's approval con-
stitutes the required agreement under Section 2530. Your City Council's
approval of such a resolution would approve the FAU Advisory Committee as
the authorized body to develop the region's SOS Program and distribute the
funds among the cities and the County. The FAU Advisory Committee is a
regional body consisting of individual representatives of the cities,
County, CALTRANS, and transit agencies within the San Diego urbanized area
who are familiar with the transportation needs of the region.
Safer Off -System Road Projects cannot be funded until the agreement between
the County and its cities is filed with CALTRANS District 11 Director of
Transportation.

Proposed Distribution of Funds
The FAU Advisory Committee at its May meeting agreed to recommend distributing
the SOS Funds on a jurisdictional population basis. The committee further
agreed to use the most recent County -wide population (as certified by the
State Department of Finance) at the time the Federal Government makes the
funds available, as the basis of distribution. The funds for FY 1976-77 were
available on Tune 17, 1977 and the MuSL recent County -wide population cer-
tified at that time was dated January 1, 1977.
Attached is a table showing the State Department of Finance January 1, 1977
Certified Population data and the resulting apportionment of funds by juris-
diction. Also shown in the amount of local matching funds required for each
jurisdiction to fully claim its apportionment. The City of Lemon Grove was
not incorporated at the time the federal government made the funds available
therefore, its population and apportionment are included with the County of
San Diego's amounts.
Future Safer Off -System Program
This resolution also would authorize the Federal Aid Urban Advisory Committee
to develop programs for distributing funds apportioned for the SOS Program
in future years. This authorization now will serve to expedite the distri-
bution of future funds and guarantee they will be distributed in a consistent
manner.
Exchange of SOS Funds
Upon request by a city having a population less than 500,000, the County
will prepare an agreement to exchange SOS Funds for an equal amount of Road
Funds. This action would relieve the city from the various administrative
steps in making application to the state for both program and project
approvals.
Action Requested
Please present this proposed _esoluticn to your City Council for approval.
Approved resolutions should be forwarded to the Chairman of the FAU Advisory
Committee before September 1, 1977. Timely receipt of your City's resolution
will enable the FAU Advisory Committee to expedite this program.

RESOLUTION OF THL CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVI"IG METHOD OF DISTRI-
BUTION FOR FUNDS APPORTIONED COUNTY UNDER THE
FEDERAL AID FOR SAFER OFF -SYSTEM ROADS (SOS)
PROGRAM.
The City Council of the City of Carlsbad does hereby
resolve as follows:
WHEREAS, on June 17, 1977 the California Department of
Transportation forwarded to the Co,.nty Board of Supervisors offinia
notice of apportioned amounts due San Diego County and its in-
cluded Cities under the Federal Aid for Safer Off -System Rands
Program in accordance with Section 2530 of the Streets and Highways
Code; and
WHEREAS, Section 2530 (c) of the Streets and Highways Code
requires that an•agreement be entered into between the Counq and a
majority of the Cities, which Cities shall include a majority of
to.. municipal population within the County for the o.stribution of
the Federal funds under the Federal Aid for Safer Off -System Roads
(Program; and
WHEREAS, the County Board of Supervisors, ,n accordance
with Section 2532 of the Streets and Highways Code, by resolution
of July 12, 1977 claimed said apportionment on behalf of the County
and its included Cities; and

WHEREAS, there currently exists a Federal Aid Urban (FAV)
Committee consisting of representatives of the County and the
Cities within the County;
NOW, THEREFORE, BE IT RESOLVED that the City Council dces
approve the fAU Advisory Committee as the authorized body to
develop the region's Safer Off -System Roads Program and to distri-
bute those Federal funds apportioned;
HOW, THEREFORE, BL IT FURTHER RESOLVED that the City
Council approves the distribution of SOS funds for the fiscal year
ending September 30, 1977 on th of the ratio of this City's

1 population to that of the entire County as determined utilizing the
2 most recent available County -wide population data certified by the
3 State Department of Finance;
4 NOW, THEREFORE, BE IT FURTHER RESOLVED that the City
g Council does hereby agree that the annual method of distributing
G Federal funds apportioned in accordance with the SOS Program shall
7 be accomplished on the basis of the ratio of this City's population
8ito that of the entire County as determined by utilizing the most
9 !recent available County -wide population data certified by the State

11� NON, THEREFORE, BE IT FURTHER RESOLVED that the City
12 Council recognizes that this City may elect to enter into an agree-
13 ment with the County of San Diego to exchange the City's share of
14 SOS funds for an'equal amount of Road Fund monies, subject to
:L5 applicable provisions of law.
