SEWER PERMIT REQUEST
PALOMAR AIRPORT BUSINESS PARK (KNAUF)
Statement of the Matter
The City Council at your August 2, 1977 meeting instructed
the City Attorney to prepare an amendment to Chapter 18.05
of the Carlsbad Municipal Code to add an exception to the
building permit moratorium. The exception was to provide
for the issuance of building permits upon City Council approval,
for work within an existing structure as necessary to accom-
modate occupancy by a first user. An ordinance adding that
exception is attached.
Your action was taken in connection with a request made by the
Palomar Airport Business Park for relief from the moratorium.
The majority of the Council was satisfied that relief should
be granted. In order to obviate the necessity for rehearing
the matter after the ordinance is effective, I recommend that you
by motion make the findings contemplated by the ordinance and
indicate that the permits should be granted upon the effective
date of the ordinance.

Recommendation
If the Council wishes to grant this exception to the Sewer
Moratorium Ordinance, your action is to introduce Ordinance
If the Council wishes to approve building permits for certain
buildings within the Palomar Airport Business Park, your action
is to find, by motion, that the findings required by Subsection 10,
of Section 18.05.020, have been met and that effective on or after
the effective date of Ordinance No . £0 7rf * building permits
may be issued in accord with said subsection for work involving
not more than two equivalent dwelling units each in Buildings 4
and 7 and four equivalent dwelling units in Building 5, all
located in the Palomar Airport Business Park.
Council action
8-16-77 Ordinance #8074 was introduced for' a first reading, to provide
an exception from the Building Permit Moratorium for work inside
existing structures, which have never been occupied.

ORDINANCE NO. 8074
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 18,
CHAPTER 1.8.05 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTION 18.05.020 TO PROVIDE
AN EXCEPTION FROM THE BUILDING PERMIT MORATORIUM
FOR WORK INSIDE EXISTING STRUCTURES, WHICH HAVE
NEVER BEEN OCCUPIED, NECESSARY TO ACCOMMODATE
THE FIRST USER OF SPACE THEREIN. :-'•
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION 1: That Title 18, Chapter 18.05 of the Carlsbad
Municipal Code is amended by the addition o f Subsection (10) to
Section 18.05.020 to read as follows:
"10. The City Council may grant exceptions for certain
private projects involving-building permits for work within existing
structures where the Council in its sole discretion finds that:
1) The- building permit is for work to be performed
within the exterior walls and roof of an existing
structure;
2) Said structure was constructed pursuant to a
building permit issued prior to April 19, 1977;
3) Those portions of the structure for which the
building permit would be issued pursuant to this
subsection have not been previously occupied;
4) That the purpose of the .building permit is'to
make internal modifications to the structure
as necessary to accommodate occupancy by a first
user of the space."
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least

once in the Carlsbad Journal within fifteen days after its
adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 16th day of August •
1977 and thereafter
