STATEMENT OF THE MATTER
REQUEST:
The area covers approximately 187 acres of relatively flat land on two mesas.
The two mesas will be intersected by a public street which will lead to a res-
idential area to the North.
This subdivision was originally approved as CT -7^-21 in January 1975- The
last extension of this subdivision will expire on January 7, 1978, therefore
a new subdivision map is required to keep the project alive.
The request for this application was submitted prior to the application mora-
torium being in effect. The reason it has taken so long to reach the City
Council was a misunderstanding between the staff and the applicant on whether
it was a new application or a revision of the original. After this question
was resolved, the applicant resubmitted plans to the Planning Commission which
then heard the matter.

Planning Commission Resolution No. 1388.

REQUEST: APPROVAL OF A TENTATIVE TRACT MAP FOR A 3^-LOT
INDUSTRIAL SUBDIVISION.
SECTION 1: RECOMMENDATION
Staff recommends APPROVAL of CT 77~12 based on the following findings and subject
to the following conditions:
FINDINGS:
1. The proposed map is consistent with the General Plan because:
a) The Land Use Plan Map designates the subject site for Planned Industrial
(PI) land use.
2. The design and improvement of the proposed subdivision is consistent' with the
General Plan because:
a) The project will provide orderly industrial development.
3. The site is physically suitable for the type of development because:
a) The proposed development will not affect any unusual topographic or
geologic features on the site;
b) No significant natural vegetation will be eliminated by the project.
A. The site is physically suitable for the proposed density of development because:
a) There are no significant physical features on the site that would hinder
development as planned.
5. The design of the subdivision or the imposed improvements are not likely to
cause substantial environmental damage or substantially and unavoidably injure
fish or wildlife or their habitat because:
a) An EIR has been certified for a previous similar action on the site.
6. The design of the subdivision or the type of improvements are not likely to
cause serious public health problems because:

a) The subdivision does not front on any of the above.
9. The subject application has complied with the requirements of the Carlsbad
Environmental Protection Ordinance of 1972 because:
a) An Environmental Impact Report (EIR-23^) was approved for subject location
in May of 197^ as part of a General Plan Amendment.
b) Supplemental information was supplied to the satisfaction of the City for
a previously approved industrial subdivision on the site (CT 7^~2]).
10. The proposed tentative tract map is consistent with applicable City Public
Facilities Policies and Ordinances because:
a) The Planning Commission finds that sewer service is not available for this
development as of the date of this approval. However, sewer service may
be available in the future. The Planning Commission will by inclusion of
an appropriate condition to this Tentative Subdivision Map approval, insure
that the final map will not be approved unless the City Council finds that
sewer service is available to serve the project. In addition, the Planning
Commission will add a condition that a note be placed on the final map
providing that building permit may not issue for lots in the subdivision
unless the City Engineer determines that sewer service is available. Since
the final map cannot be approved unless sewer service is available and
building cannot occur within the subdivision unless sewer service remains
available, the Planning Commission is satisfied that the requirements of
the Public Facilities element of the General Plan have been met insofar as
they apply to this Tentative Subdivision Map approval.
b) All other public facilities are available or will be required by conditions
of approval.
CONDITIONS:
]. The approval is granted for the land described in the application and any
attachments thereto and as shown on the plot plan submitted labeled Exhibit "A",
dated July 11, 1977.
2. The applicant shall submit a landscaping and irrigation plan to the Parks &
Recreation Director for his approval covering all denuded natural and constructed
slope areas prior to approval of the final subdivision grading plan. Said ' ..
plan shall include a statement of installation phasing and shall include land-
scaping that will satisfy erosion and fire hazard control. A final landscaping
and irrigation plan shall be submitted prior to the issuance of building permits-.
All final landscaping shall be installed prior to final occupancy.
3. The "Street A" in Unit 1 and "Street B" in Unit 3 shall be constructed with
temporary turnarounds at the unit boundaries.

**. The future streetoetween Unit 2 and Unit 3 shalTbe graded and reserved as
a standard 8V wide right of way plus additional width at Palomar Airport,
Road to allow for turning movements as a condition of Units 2 and 3 Final
Map approval.
5. a) This subdivision is approved on the express condition that the final map
shall not be approved unless the City Council finds as of the time of
such approval that sewer service is available to serve the subdivision.
b) This subdivision is approved upon the express condition that building
permits or grading permits will not be issued for development on the
subject property unless the City Engineer determines that sewer facilities
are available at the time of applications for such permit and will continue
to be available until time of occupancy. If the City Engineer determines
that sewer facilities are not applicable, building permits will not be
issued until arrangements satisfactory to the City Council can be made to
guarantee that all necessary sewer facilities will be available prior to
occupancy. This condition shall be noted on the final map.
c) This Tentative Subdivision Map shall be subject to any further approvals
as may be necessary in connection with such plan for the allocation of
sewer service amoung competing uses as the City Council may adopt. If
an allocation plan is adopted prior to final map approval, the applicant
shall satisfy the requirements of such plan as a further condition of this
Tentative Subdivision Map approval.
6. All public improvements as shown on Exhibit A, dated July 11, 1977, shall be
made in conformity to the City of Carlsbad Engineering Design Criteria and
Standard Plan, the Subdivision Ordinance and other City standards, to the
satisfaction of the City Engineer without cost to the City of Carlsbad and free
of all liens and encumbrances. Improvement plans for water and sewer systems
shall meet the requirements of the respective service districts.
7. All land and/or easements required by this ordinance shall be granted to the
City of Carlsbad without cost to the City and free of all liens and encumbrances.
No easements shall be recorded prior to approval of the final map unless approved
by the City Engineer.
8. Ornamental street lighting shall be provided for as required by Municipal Code.
The developer shall post a bond and/or cash in the amount necessary to energize
said street lights for an 18-month period after construction to permit the in-
corporation of the subdivision into a maintenance district. This shall be done
prior ;to approval of the final map.
9. All slopes created as a result of this development shall not exceed a 2:1 slope.
10. The developer shall work with the Carlsbad Municipal Water District and the City
Fire Department in preparing a water master plan for the project. Minimum flow
for fire and commercial purposes shall be 6,000 gallons per minute.
11. The applicant shall grant to the City a 10-foot-wide Open Space easement for
pedestrian and bicycle purposes adjacent to the future C Street which is within
the project boundaries. The applicant shall improve the easement with asphaltic
concrete to the satisfaction of the City'Engineer.

12. The applicant shall submit a revised tentative map to the City Engineer which
shall show the following:

a. Interior lot slopes.
b. Correct slopes and/or daylight lanes at rear of lots 1, 2, 26, 27, 28 and
29.
c. Footage of offsite sewer.
d. Grading of future C Street from Palomar Airport Road and future C Street,
except at utility easement access points.
e. Amount of proposed earthwork.
]3- Access rights shall be dedicated where lots border Palomar Airport Road
and future C Street, except at utility easement access points.
14. A future C Street grade from Palomar Airport Road to a reasonable distance
beyond the property boundary shall be shown on the improvement plans for Units
2 and 3- The grade shall be acceptable to the City Engineer.
15- Storm drains shall be installed down proposed slopes to outlet at toe of slope.
Alignment shall be roughly perpendicular to proposed slope contour lines, and
adequate erosion control shall be provided at outlet.
16. The applicant shall supply, the Carlsbad Municipal Water District with a com-
prehensive engineering study for a master plan for public water service for
the entire holdings of the property prior to any final approval of a final
tract map of any portion thereof.
17- The applicant shall construct complete half street improvements along Palomar
Airport Road, including offsite transitions. These improvements shall be -
constructed to the ultimate centerline alignment and grade. Such improvements
shall include a permanent median curb. Construction of these improvements
shall be made concurrent with each unit of development. Modifications to this
construction phasing may be approved by the City Engineer where such construction
conflicts with traffic safety on the existing Palomar Airport Road traveled way.
18. Palomar Airport Road shall have 3 median openings: one at the westerly inter-
section of "A" Street, one at future "C" Street (between Units 2 and 3), and
one at the easterly intersection of "B" Street. The developer shall bond for
the construction of a traffic signal at "A" Street and Palomar Airport Road as
a condition of Unit 1 and a traffic signal at "B" Street and Palomar Airport
Road as condition of Unit 4. Each traffic signal shall include channelization,
safety lighting, interconnect conduit, etc. The requirements for traffic
signals may be modified by any future City Council Policy or City Ordinances
relating to traffic signal participation.
SECTION II: BACKGROUND:
Location and Description of Property:
The site is located on the north side of Palomar Airport Road approximately 1400
feet from the intersection of Palomar Airport Road and El Camino Real. The subject
parcel is approximately 187 acres with about 4600 feet of street frontage on Pal-
omar Ai rport Road.
The most predominate features on the site are two mesa areas separated by a north-
south drainage area. An east-west canyon runs just to the north of the property.
The mesa areas have been graded for agricultural use, and are currently under
agricultural production.

The subject site (P-M Zoned), is south of a large Master Planned Area. The Master
Plan includes property (600 acres), north of the subject site, which is zoned P-C
and designated on the Master Plan for single-family and multiple family residential
The total dwel1ing units allowable is 1500.
In February 1977, the applicant began to process an update of the existing Master
Plan to comply with the recently revised Planned-Community Zone. The Master Plan
update does not include the subject property.
Environmental Impact Information
An Environmental Impact Report (EIR-23^) was certified for the subject property
(and northern P-C zoned property) under Zone Change 1^0, City Council Resolution
No. 9399 dated, August 6, 197^.
Supplemental Information was supplied by the applicant as part of the CT 7^-21
application. This information was deemed acceptable through approval of the
subdivi s ion.

Major Planning Considerations
1. How does the proposed map differ from the previously approved Tract Map?
2. Will the phasing proposed allow adequate development of public facilities
(streets and improvements) in each phase?
SECTION III: DISCUSSION:
The requested industrial subdivision is essentially the same as the approved tract
map for the site (CT 7^-21).
The applicant's intent in reapplying for a new subdivision is twofold: One, the
applicant wishes to create a new map which will be valid for an additional period
of time (the old map expires after it's second extension in January 1978); and two,

the provision of additional development phasing (the old map provided only two
phases, one encompassing each loop street). The new map includes four phases and
3*» lots.
Staff has no problems with the requested map as proposed. Initially, the map was
shown with additional phasing which would have created fragmentation of public
facility development. As shown, the phasing will insure a relatively short cul-
de-sac at the first and third phases and the remaining streets and related
facilities at the second and fourth phases. This will provide a complete loop
street system at the finalization of phase two and four.

APPROVAL OF THE TENTATIVE MAP REQUEST FOR A
34-LOT INDUSTRIAL SUBDIVISION ON PROPERTY
LOCATED ON NORTH SIDE OF PALOMAR AIRPORT ROAD
BETWEEN EL CAMINO REAL AND SANTA FE ROAD.

WHEREAS, a verified application for a certain property, to
wit:
That portion of Lot B of Rancho Agua Hedionda in the
City of Carlsbad, County of San Diego, State of
California, according to Map thereof No. 823, on file
in the Office of County Recorder of said County
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said application constitutes a request as provided
by the "Carlsbad Municipal Code;" and
WHEREAS, the Public Hearing to consider the subject request
was held on July 27, 1977, at the time and in the place specified
in the public hearing notice, pursuant to the provisions of the
Carlsbad Municipal Code; and
WHEREAS, at said public hearing, upon hearing and considering
the testimony and arguments, If any, of all persons who desired
to be heard, said Commission considered all factors relating to
the Tentative Tract Map request (CT 77-12) and found the following
facts and reasons to exist:

11, 1977.

on the existing Palomar Airport Road traveled way.
18) Palomar Airport Road shall have 3 median openings: One
at the westerly intersection of "A" Street, one at
future "C" Street (between Units 2 and 3), and one at the
easterly intersection of "B" Street. The developer sliall
bond for the construction of a traffic signal at "A"
Street and Palomar Airport Road as a condition of Unit 1
and a traffic signal at "B" Street and Palomar Airport
Road as condition of Unit 4. Each traffic signal shall
include channelization, safety lighting, interconnect
conduit, etc. The requirements for traffic signals may
be modified by any future City Council Policy or City
Ordinances relating to traffic signal participation.
