Statement of the Matter
Exhibit 1 is a request that an exception be granted by Council to allow the
County of San Diego to fulfill previous contractual arrangements (long term
lease) to be issued sewer connection permits for a two-story building
(7500 sq. ft. hangar, 1500 sq. ft. office for 6 employees) on 2.829 acres
at Palomar Airport (County land).
Exhibit 2 is a letter requesting sewer service dated June 24, 1977. The
request is not a "blanket" exception but only to allow for the specific
project as noted.
EXHIBITS:

from the County of San Diego.
2. Letter dated June 24, 1977 requesting sewer service from Department of
Transportation.
RECOMMENDATION:
If the Council finds that the application is that of a government
agency, the moratorium allows the Council to grant an exception.
If.it is determined that it is a private application, it should
be denied.

SUBJECT: Sewer Service to Palomar Airport
We are responding to your letter of 19 July 1977 to David K. Speer,
Chief Administrative Officer of the County, concerning possible lease
of sewage treatment capacity rights from the Buena Sanitation District
to accommodate new development at the County operated Palomar Airport.
The Buena Sanitation District (BSD) has limited capacity rights of 0.62
million gallons per day (MGD) in the Encina WPCF. Wastewater flow for
the past twelve months averaged 0.42 MGD. Phases I and II of the proposed
Shadow Ridge Development plus normal BSD growth over the next two years
is anticipated to use all of the remaining capacity rights.
The Department of Transportation, Airports Division, in their letter of
June 24, 1977 to your office requested that an exception be granted by
your City Council to permit issuance of a sewer connection permit for
Carlsbad Aviation, Inc. Our County contract with Carlsbad Aviation did
pre-date your April 26, 1977 sewer moratorium. Also, a limited amount of
sewer capacity will be required consisting of restroom facilities for the
use of customers and approximately six employees.
In the original drafts of the County /Carlsbad Palomar Airport sewer service
agreement the County was granted a 10,000 GPD capacity and the right to
make additional connections. This capacity, however, was deleted from
the final draft at the request of Carlsbad and a requirement added for
issuance of a sewer permit for new connections. In view of the original
intent of this agreement and the requirement for additional general
aviation service facilities at Palomar we believe the granting of an
exception for Carlsbad Aviation, Inc. is fully justified.

Subject: Carlsbad Sewer Moratorium - Exception for Palomar Airport Project
Dear Mr. Bussey:
On May 6, 1975 the County of San Diego and the City of Carlsbad entered into
an agreement under which the City agreed to provide sewer service to Palomar
Airport.
On May 9, 1976 the County Board of Supervisors approved an aviation lease
agreement at Palomar Airport with Carlsbad Aviation,Inc. (County Contract
#10047-R, copy attached). This lease was negotiated under the County's
ongoing program to improve facilities and develop sufficient revenues to
operate the airport system "in the black". In accordance with lease
terms Carlsbad Aviation, Inc. is required to construct a 7,500 sq. ft.
maintenance hangar, a 1,500 sq. ft. office building, plus paving, land-
scaping and other aircraft service facilities on a 2.829 acre parcel.
Carlsbad Aviation, Inc. has encountered several unanticipated organization
and financing problems which have prevented start of the required construction
to date. County staff and Carlsbad Aviation, Inc. have been working to
resolve these problems and it is anticipated that construction under this
lease contract can begin in the near future. Carlsbad Aviation, Inc. has
paid $9,600 land rent to County to date in anticipation of beneficial use
of the property under this lease.
Carlsbad Aviation is a franchised dealer for North American Rockwell Aero
Commander aircraft. Their development at Palomar will provide additional
employment, tax revenue and badly needed general aviation service facilities.

In view of the circumstances and the fact that this County contract predates
the April 26, 1977 adoption by the Carlsbad City Council of the Sewer Moratorium,
Ordinance #7048, it is requested that an exception be granted by the City
Council to permit issuance of a sewer connection permit under the provisions
of paragraph 7, Section 1, Ordinance #7048.
