Statement of the Matter
Mr. James Giusto of Estate Equities has requested an opportunity
to address City Council relative to the sewer moratorium on a
hardship basis. Mr. Giusto had received a building permit at
1570 Basswood Avenue prior to the April 19, 1977 moratorium.
After the enactment of the moratorium Mr. Giusto contacted the
city explaining the plan submitted was the model and the same
plan was going to be used for two adjacent lots at 1574 and
1578 Basswood Ave. Staff determined that since only one permit
had been applied for, Mr. Giusto would have to await allocation
on the remaining two lots.

Recommendation
That Mr. Giusto await allocation for the remaining two lots as
applications were not received prior to the enactment of the
sewer moratorium.
Council action
9-20-77 The matter was continued to the next meeting for further report from staff.
9-22-77 The appeal was denied by the Council.

Dear Mr. Bussey:
Due to the mixup in the process of obtaining three building
permits for homes proposed to be built at 1570-74-78 Basswood Ave.,
that I have related to you previously, I have been directed to re-
quest from your office an opportunity to explain my situation to
the City Council in order that I may obtain the necessary sewer
permits on a hardship basis. As you are aware, my draftsman
maintains he submitted three applications with only two sets of
plans which included 3 different elevations. We were also re-
quired to furnish soil reports on the three lots in question
(copy of soil dated 5-20-77 which you have on file). We are
presently in the process of building only one of these homes at
1570 Basswood Ave. But due to the mixup, the lender has funded
on all three lots. This has created a definite financial hardship
and we would appreciate your cooperation in directing us so that
we do not loose additional time.
