Statement of the Matter
The City Council at your September 20, 1977 meeting directed
the City Attorney to prepare documents to amend the Land Use
Element of the General Plan to change the land use designation
of two areas: General Plan Amendment (GPA-48) and General Plan
Amendment (GPA-49) .

Recommendation
If the Council desires to amend the General Plan as indicated,
your action is to adopt Resolution No.-S<£3<$ and No. ^S'&eL'f •
Council action
10-4-77 Resolution #5223 was adopted, amending the Land Use Element of
the General Plan to change the land use designation from TS and
0 to N. (GPA-48)
Resolution #5224 was adopted, amending the Land Use Element of
__the General Plan to change the land use designation from
0-S to G. (GPA-49).

RESOLUTION NO. 5223-,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING THE LAND
USE ELEMENT OF THE GENERAL PLAN TO CHANGE
THE LAND USE DESIGNATION FROM TS(TRAVEL SERVICES
COMMERCIAL) AND O (PROFESSIONAL AND RELATED
COMMERCIAL) TO N (NEIGHBORHOOD COMMERCIAL) ON
PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF
EL CAMINO REAL, SOUTH OF LA COSTA BOULEVARD.
APPLICANT; WILLIAM F. BURNETT - GPA-48.
WHEREAS, the Planning Commission did hold a duly noticed
public hearing as prescribed by lav; to consider amendments to
the Land Use Element of the General Plan on August 24, 1977; and
WHEREAS, the Planning Director has determined that said
amendments will have a nonsignificant impact on the environment
and a Negative Declaration has been prepared and filed in satis-
faction of the requirements of the City of Carlsbad Environmental
Protection Ordinance of 1972 and the California Environmental
Quality Act; and
WHEREAS, the City Council, on September 20, 1977, held a
duly advertised public hearing to consider said amendment and all
other proposed amendments and at said time received the
recommendations, objections, protests and comments of all
interested persons desiring to be heard; and
WHEREAS, the City Council, after considering all proposed
amendments to the Land Use Element in terms of making one single
General Plan amendment, directed the City Attorney to return with
appropriate resolutions, separately dealing with each proposed
amendment, to allow the Council to record individual votes, all as
a part of a single amendment to the Land Use Element.
NOW, THEREFORE, BE IT RESOLVED by £he City Council of the

A. That the above recitations are true and correct.
B. That this resolution, and Resolution No. 5224 / are all
part of a single amendment to the Land Use Element of the General
Plan.
C. That the findings of the Planning Commission as set
forth in Planning Commission Resolution No. 1399 constitute the
findings of the City Council.
D. That the Land Use Element of the General Plan is amended
to approve GPA-48 to change the TS (Travel Services Commercial)
and O (Professional and Related Commercial) designations to N
(Neighborhood Commercial) on approximately a 12-acre portion of
the land generally located on the east side of El Camino Heal,
south of La Costa Boulevard, as shown on map marked Exhibit A,
attached hereto and made a part hereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 4th day of October , 1977
by the following vote, to wit:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING THE LAND
USE ELEMENT OF THE GENERAL PLAN TO CHANGE
THE LAND USE DESIGNATION FROM O-S ( OPEN
SPACE) TO G (GOVERNMENTAL FACILITIES) ON
PROPERTY GENERALLY LOCATED ON THE NORTH
SIDE OF EL CAMINO REAL BETWEEN SUNNY CREEK
ROAD AND PALOMAR AIRPORT ROAD. APPLICANT:
COUNTY OF SAN DIEGO - GPA-49 .
WHEREAS, the Planning Commission did hold a duly noticed
public hearing as prescribed by law to consider amendments to
the Land Use Element of the General Plan on August 24, 1977; and
WHEREAS, an Environmental Impact Report has been prepared by
the County, the "lead agency" for the project, and the City, as
a "responsible agency", has considered the certified EIR and found
it to be in full compliance with the City of Carlsbad Environmental
Protection Ordinance of 1972; and
WHEREAS, The City Council, on September 20, 1977, held a
duly advertised public hearing to consider said amendment and all
other proposed amendments and at said time received the
recommendations, objections, protects and comments of all
interested persons desiring to be heard; and
WHEREAS, the City Council, after considering all proposed
amendments to the Land Use Element in terms of making one single
General Plan amendment, directed the City Attorney to return with
appropriate resolutions, separately dealing with each proposed
amendment, to allow the Council to record individual votes, all as
a part of a single amendment to the Land Use Element.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:

B. That this resolution, and Resolution No. 5223 , are
all part of a single amendment to the Land Use Element of the
General Plan.
C. That the findings of the Planning Commission as set
forth in Planning Commission Resolution No. 1396 constitute the
findings of the City Council.
D. That the Land Use Element of the General Plan is amended
to approve GPA-49, to change the O-S (Open Space) designation to
G (Governmental Facilities), to allow construction of a solid
waste shredder and transfer station, on approximately a 58-acre
portion of the land generally located on the north side of El Camino
Real between Sunny Creek Road and Palomar Airport Road, as shown
on map marked Exhibit A, attached hereto and made a part hereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 4th day of October / 1977
