ON AUGUST 16, 1977, THE CITY COUNCIL ADOPTED RESOLUTION NO. 5180, ADOPT- ING THE OPERATING BUDGET FOR FISCAL YEAR 1977-78, AND ESTABLISHING CONTROLS ON CHARGES. SECTION FOUR OF THIS RESOLUTION STATES THAT THE CITY MANAGER MAY AUTHORIZE ANY EXPENDITURE FO-R BUDGETED CAPITAL ITEMS OF $3.500.00 OR LESS. ANY EXPENDITURE OF MORE THAN $3.500 .00 SHALL REQUIRE CITY COUNCIL APPROVAL. ACCORDING TO SECTION 3.28.160, OF THE CITY CODE, THE CITY MANAGER MAY AUTHORIZE ANY EXPENDITURE FOR BUDGET ITEMS OF $5,000 .00 OR LESS- ANY EXPENDITURE OF MORE THAN $5.000.00 SHALL REQUIRE CITY COUNCIL APPROVAL. ON CHARGES IN APPRO- PRIATIONS FOR THE VARIOUS DEPARTMENTS AND FUNDS . : « BE IT RESOLVED by the City Council of the City' of Carlsbad, California, as follows: SECTION 1. That certain document now on file in the office of the City Clerk of the City of Carlsbad entitled, "City of Carlsbad Preliminary Budget Fiscal Year 1977-78," as amended in accord with Exhibits A,B,C,D andE,attached hereto and incor- porated by reference herein shall be and the same is hereby adopted as the final .operating budget for the City of Carlsbad for the fiscal year 1977-78. Said document is hereby referred to and by this reference made a part hereof. SECTION 2. That the amount designated as Department Total for each department and each fund in said document is hereby • appropriated to the department or fund for which it is designated, and such appropriation shall be neither increased nor decreased except as provided herein without approval of the City Council. All amounts designated as Personnel Services, Material, Supply, Services, and Capital Outlay in said document are hereby appro- priated for such uses to the department or fund under which they are listed subject to the controls herein. SECTION 3. That the City Manager may approve the transfer of amounts designated as Personnel Services, Material, Supply, and Services from account to account within any particular fund or Department total. The City Manager may approve the transfer of 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 25 26 27 28 funds from amounts designated as Personnel Services, Material, Supply, and Services to a capital account within any particular' fund or department total in an amount up to $500.00. SECTION k. That the City Manager is authorized to approve capital expenditures for particular budgeted items* of $3,500.00 or less. Any such expenditure of more than $3,500.00 shall irequire the approval of the City Council. The City Manager may approve transfer of funds from item to item or account to account within the total of any Department's Capital Outlay accounts in an amount up to $500.00. The City Manager may approve capital expenditures for a nonbudgeted capital item in an amount of $500.00 or less in connection with a fund transfer within the total of any . department's Capital Outlay account. ADAMS/ City Clerk (SEAL) 2. 28.140 — 3.28.170 least three bids and shall be awarded to the lowest respon- sible bidder who submits a responsive bid which, based on total cost, is most advantageous to the city. (Ord. 1197 §l(part), 1976: Ord. 1098 §13). 3.28.140 Competitive negotiation. The city council may authorize the purchase of highly technical supplies, services and equipment by competitive negotiations when: (1) The service involves a specialized knowledge or personal skill, such as attorneys, architects, accountants and specialized consultants; or (2) The supplies or equipment are such that suitable technical or performance specifications are not readily available, the city is not able to develop descriptive speci- fications, and proposals for the purchase would be more ad- vantageous to the city. When the purchases are made by com- petitive negotiations the best offer, as judged against pro- posal evaluation criteria, shall be accepted. The use of competitive negotiations is not intended to be used for the purpose of avoiding the bidding procedures as set forth in this chapter. (Ord. 1197 §1(part), 1976). 3.28.150 Cooperative purchasing. Purchase of supplies, services and equipment by contract, arrangement and agree- ment for cooperative purchasing programs with the state, the county, or any other public or municipal corporation of the state may be made by the purchasing officer when the adminis- tering agency has made their purchases in a competitive man- ner. (Ord. 1197 §l(part), 1976). 3.28.160 Award and execution of contracts. Except in emergency situations, pursuant to subsection 1 of Section 3.28.090, all contracts for supplies, services and equipment in an estimated amount of five thousand dollars, or more, shall be awarded by the city council. Contracts for sup- plies, services and equipment in an estimated amount of less than five thousand dollars shall be executed by the city manager. (Ord. 1197 §1(part), 1976). 3.28.170 Exemptions from centralized purchasing. The purchasing officer, with approval of the city manager, may authorize in writing any department to purchase specified supplies, services and equipment of estimated amounts of less than five thousand dollars independently of the pur- chasing department. Such purchases shall be made in con- formity with the procedures established by this chapter, and shall further require periodic reports from the agency on the purchases made under such written authorization. (Ord. 1197 §l(part), 1976). 56 (Carlsbad 1/15/77) 1 RESOLUTION NO. 5215 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING 3 SECTION FOUR OF RESOLUTION NO. 5180 TO BE CONSISTENT WITH THE CITY CODE SECTION 4 3.28.160, SETTING A LIMIT ON THE PURCHASE OF BUDGETED ITEMS THAT WILL REQUIRE CITY 5 COUNCIL APPROVAL. 6 WHEREAS, the City Council adopted Resolution No. 5180 adopting the final operating budget for fiscal year 1977~?8. 8 WHEREAS, it is necessary that Resolution No. 5180 be 9 consistent with Section 3.28.160 of the City Code. 10 NOW, THEREFORE, BE IT RESOLVED that section four of 11 Resolution No. 5180 be amended to read: "That the City Manager 12 is authorized to approve any expenditures for budgeted items of 13 $5,000.00 or less. Any such expenditures of more than $5,000.00 shall require the approval of the City Council. The City Manager may approve transfer of funds from item to item or account to 16 account within the total of any Department's Capital Outlay ,. 17 accounts in an amount up to $500.00.
