Statement of the Matter
The City Council, at your September 13, 1977 meeting, directed
the City Attorney to return with a draft of an ordinance
amending Section 18.05.020 and the Building Permit Moratorium
imposed thereby, to provide an exception for CT 74-6. An
ordinance in that regard is attached.

If the Council is satisfied that the draft reflects the
Council's intentions in the matter, your action is to
introduce Ordinance No. ^Q7,5"
Council Action:
10-18-77 Council continued the matter to the meeting of October 25, 1977.
10-25-77 Council returned the proposed Ordinance to the City Attorney
for revision, expanding the first paragraph to incorporate
language indicating uniqueness because of diligent pursuit of
construction and necessity of completion of public improvements
involved.
11-1-77 Ordinance #8075 was introduced for a first reading, providing an
exception from the Building Permit Moratorium for development
within the boundaries of CT 74-6.
11-15-77 Ordinance #8075, providing exception from the Building Permit
Moratorium for development within the boundaries of CT 74-6,
was adopted.

ORDINANCE NO. 8075
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 18, CHAPTER 18.05, OF THE CARLSBAD
MUNICIPAL CODE BY THE AMENDMENT OF
SECTION 18.05.020 TO PROVIDE AN EXCEPTION
FROM THE BUILDING PERMIT MORATORIUM FOR
DEVELOPMENT WITHIN THE BOUNDARIES OF
CT 74-6.
WHEREAS, the City Council is satisfied that: the circum-
stances of CT 74-6 are unique; the project was commenced prior
to the moratorium and was diligently pursued by the developer;
the City required the construction of certain public improvements
as a part of the development and the construction of such improve-
ments was underway prior to the moratorium; the developer will
experience extreme hardship unless the subdivision is exempted
from the moratorium and that such an exemption is also necessary
to facilitate completion by the developer of certain public
improvements which is necessary to prevent environmental damage;
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Carlsbad, California,as follows:
SECTION 1: That Title 18, Chapter 18,05, Section 18.05.020
of the Carlsbad Municipal Code is amended by the amendment of
Subsection 9 to read as follows:
"9. Building permits may be processed and issued for
development within the boundaries of subdivision CT 74-6."
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption. x"

INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 1st day of November , 1977,
and thereafter
PASSED AND ADOPTED at a regular meeting of said City
Council held on the 15th day of November , 1977, by the
following vote, to wit:
AYES: Councilmen Frazee, Packard, Skotnicki and
CounciIwoman Casler
NOES: Councilman Lewis
ABSENT: None
