STREET VACATION OF A PORTION OF PUEBLO STREET (FORMERLY VELERO COURT)

Statement of the Matter
The City Council, on October 4, 1977, adopted Resolution No. of Intention for vacating a portion of Pueblo Street. A pub persons interested in or objecting to said proposed vacation the City Council Chambers, 1200 Elm Avenue, November 1 , 1977

All utilities were notified of the proposed vacation, necessary easements have
been reserved as delineated on Exhibit 3, and posting and publication of the
street vacation was completed per the Street Vacation Act of 1941.
In conjunction with the street vacation, granting of a Quitclaim Deed of
existing 10 foot utility and tree planting easements adjacent to Pueblo Street,
dedicated on CT 72-20 Unit No. 2 over Lots 261, 262, 263, and 264 should be
considered.

Recommenda ti on :
If the Council concurs, adopt Resolution !lo.$ ~9,z a resolution of the City of Carlsbad vacating a portion of Pueblo Street subject to certain reservations and exceptions.
Adopt a motion authorizing the Mayor to execute the above mentioned Quitclaim Deed.
Council action
11-1-77 Resolution #5247 was adopted, vacating a portion of Pueblo Street,
and the Mayor was authorized to execute a quitclaim deed.

The City Council of the City of Carlsbad does hereby resolve as
follows:
1. That all publication and posting of notices regarding the proposed
vacation of a portion of Pueblo Street pursuant to Resolution of Intention No.
5214 have been given as required by law.
2. That the City Council did hear the evidence offered by all persons
interested in said proposed street vacation and does find from all the evidence
submitted that a portion of Pueblo Street, located in the City of Carlsbdd,
:ounty of San Dieoo, State of California, and particularly described on Exhibit
4, attached hereto and by this reference incorporated herein, is unnecessary for
Dresent or prospective street purposes and does hereby make this order vacatinc
said portion of Pueblo Street provided, however, that the City Council does
hereby determine that the pub1 ic convenience and necessity 'require the resep-
vation
reservations particularly described on the aforementioned Exhibit A, attached
hereto.

That portion of Valero Court, Carlsbad Tract 72-20 (La Costa Vale) Unit No. 2, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 7779, filed in the Office of the County Recorder of San Diego County, October 26, 1973, described as follows:

Commencing at the Westerly terminus of that certain course in the centerline of said Velero Court shown as North 76'30'00" West 60.00 feet, on said Map No. 7779; thence leaving said centerline South 23'22'12" East 50.00 feet to the TRUE POINT OF BEGINNING, said point being in the sideline of said Velero Court and a point in the arc of a 50.00 foot radius curve concave Northerly, a radial line to said point bears South 23'22'12" East; thence along said sideline Southwesterly, Westerly and Northwesterly along the arc of said curve through a central angle of 38"11'03" a distance of 33.32 feet to an intersection with a 170.00 foot radius curve concave Southerly, a radial line to said"inter- section from said 50.00 foot radius curve bears South 14"48'51" West and a radial line from said 170.00 foot radius curve bears
