Statement of the Matter
Section 18.05.020 (10) of the Municipal Code provides for exceptions to the
sewer moratorium if the Council makes certain findings.
Application has been made on behalf of Hughes Aircraft Company for additional
sewer connections so that they might complete a portion of their present fa-
cility which has never been finished out and occupied. The existing facility
contains approximately 66,000 square feet of industrial and office space with-
in the exterior building shell. The applicant proposes to install the floors,
electrical and mechanical facilities required to provide for occupancy as
workloads demand. The improvements outlined in the applicant's letters would
require an additional eight equivalent dwelling units. All conditions neces-
sary to meet Code requirements for exception appear to have been met.
As outlined in my October 27, 1977 report (with verbal correction) there were
107 EDUs remaining. From that,29 additional EDUs (granted by City Council
on November I, 1977 for Tanglewood,, and the County shredder) must be :
subtracted, leaving 78 EDUs. Granting this request would reduce
that figure to 70 EDUs.

Recommendation
That City Council make the finding required pursuant to Section 18.05.020 (10)
of the Municipal Code and grant eight additional sewer connections to Hughes
Aircraft Company.
Council Action:
11-15-77 Council made the finding pursuant to Section 18.05.020 (10)'
of the Municipal Code and authorized issuance of building
permits, using not more than eight (8) ^additional sewer
connection permits, provided the building permits are applied
for within 60 days.

Dear Mr. Bussey:
As we discussed previously, it is my understanding that the present
moratorium on building permits does in fact apply to the interior com-
pletion of the presently constructed but unoccupied area of the Hughes
Industrial Products Division Facility at 6155 El Camino Real.
The unoccupied area consists of 24,000 square feet of office area and
42,000 square feet of manufacturing area primarily for electronic assembly.
These areas are within the present structure and separated from the occupied
portion by a temporary wall, erected to conserve energy, which will be re-
located or removed entirely. The completion of these areas was delayed
during the initial construction until product requirements could be more
accurately determined and additional funding could be obtained. Had we
anticipated at the time of initial construction that we would be included
under such a moratorium our plans would certainly have been modified to
complete the building interior on the original permit.
We are now in the process of obtaining an architectural firm to complete
the necessary drawings and requirements in preparation of an application
for necessary building permits for this interior construction. Space require-
ments for new programs now require that this construction begin immediately
which necessitates that our permit be granted in an expeditious manner.
For this reason we are appealing to the City Council for an exemption from
the moratorium to enable us to proceed with the design with assurance of
being granted necessary permits for construction.

Dear Mr. Beckman:
With reference to my letter of October 18 to the City Council, and your
phone request of October 25th, the following additional information is
submitted:
The unoccupied manufacturing area presently consists of 42,000 square
feet within the existing perimeter walls and roof with dirt floor and
minimum lighting. The plan is to pour a concrete floor in this area
and add the necessary lighting and services as required for mechanical
and electronic assembly operations.
The present plan for 1978 is to occupy approximately 2000 square feet of
the manufacturing area and the balance will continue to be used as
storage until further programs dictate the need for additional space.
The unoccupied office area now consists of 12,000 square feet within
the existing perimeter walls and roof with dirt floors and minimum
lighting. Existing columns and footings were designed and constructed
to accommodate an additional 12,000 square feet on the second floor.
The plan for 1978 is to complete the downstairs offices in a configu-
ration similar to the present occupied area and pour the floor only for
the second story. The second floor offices will be completed at some
future date depending on program requirements and will be similar to
the existing second floor office arrangement. During this phase of
construction the second floor restrooms may also be completed using
planned extension of the existing lines for a similar restroom
directly below. For the purpose of computing sewage requirements the
additional restrooms will consist of eight water closets, five lava-
tories , and four urinals.
The projected estimate for increasing manpower over the next five years
is shown below:

It should be understood that these manpower projections are based on program
requirements which may vary depending on business environment.

Based on this projection additional parking facilities will be required.
These are to be adjacent to the present parking area which is located
on the South side of the facility. The plan for 1978 is to add 78
additional parking spaces with necessary access lanes.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 18,
CHAPTER 18.05 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTION 18.05.020 TO PROVIDE
AN EXCEPTION FROM THE BUILDING PERMIT MORATORIUM
FOR WORK INSIDE EXISTING STRUCTURES, WHICH HAVE
NEVER BEEN OCCUPIED, NECESSARY TO ACCOMMODATE
-THE FIRST USER OF SPACE THEREIN.
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION 1: That Title 18, Chapter 18.05 of the Carlsbad
Municipal Code is amended by the addition o f Subsection (10) to
Section 18.05.020 to read as follows:

"10. The City Council may grant exceptions for certain
private projects involving building permits for work within existing
structures where the Council in its sole discretion finds that:
1) The building permit is for work to be performed
within the exterior walls : and roof of an existing
structure; ,..
2) Said structure was constructed pursuant to a
building permit issued prior to April 19, 1977;
3) Those portions of the structure for which the/
building permit would be issued pursuant to this
subsection have not been previously occupied;
4'). That the purpose of the building permit is to
make internal modifications to the structure
as necessary to accommodate occupancy by a first
user of the space."
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 16th ^aY of August *'
