1978 MUNICIPAL ELECTION
Statement of the Matter
Oral report and recommendations on items pertaining to the
Municipal Election to be held in March, 1978.
Council action
11-22-77 Resolution #5260 was adopted, adopting regulations for candidates
for elective office, pertaining to materials submitted to the
electorate and the costs thereof.
The Council established the hours the polls would be open on
election day as 7:00 A.M. to 7:00 P.M.
The Council further agreed that the filing fee for nomination
papers remain at $25.00.

2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ADOPTING
3 REGULATIONS FOR CANDIDATES FOR ELECTIVE
OFFICE, PERTAINING TO MATERIALS SUBMITTED
4 TO THE ELECTORATE AND THE COSTS THEREOF.
5 WHEREAS, Section 10012 of the Elections Code of the State of
6 California authorizes the governing body of any local agency to
7 adopt regulations pertaining to materials prepared by any candidate
8 for a municipal election, including costs thereof; and
9 WHEREAS, it is the opinion of the Attorney General of the
10 State of California (No.CV 76/5, May 6, 1976) that a candidate may
11 not be billed for the additional cost of preparing candidates'
12 statements in Spanish if such were not requested by the candidate
13 but were required solely by reason of recent amendments to the
14 Federal Voting Rights Act of 1965 (Public Law 94-73, August 6,
15 1975);
16 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD,
17 CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
18 FOLLOWS:
19 SECTION 1-. That pursuant to Section 10012 of the Elections
20 Code of the State of California, each candidate for elective office
21 to be voted for at the General Municipal Election, may prepare a
22 candidate's statement on an appropriate form provided by the City
23 Clerk. Such statement may include the name, age, and occupation
24 of the candidate and a brief description of no more than two hun-
25 dred (200) words of the candidate's education and qualifications
26 expressed by the candidate himself. Such statement shall not in-
27 elude party affiliation of the candidate, nor membership or acti-
28 vity in partisan political organizations. Such statement shall
1 be filed in the office of the City Clerk at the time the candidate
2 nomination papers are filed. Such statement may be withdrawn, but
3 not changed, during the period for filing nomination papers and
4 until 5:00 p.m. of the next working day after the close of the
5 nomination period.
5 . SECTION 2. That in compliance with the recent amendments to

7 the Federal Voting Rights Act of 1965 (Public Law 94-73, August 6,
8 1975) the City Clerk shall provide a Spanish translation of the
9 candidate's statement to be included in the Voter's Pamphlet and
10 mailed with the sample ballot to each voter in said City.
11 SECTION 3. That the City Clerk shall send to each voter with
12 the sample ballot, a voter's pamphlet which contains the statement
13 of each candidate in English and Spanish pursuant to law.
14 SECTION 4. That each candidate filing a candidate's state-
15 ment shall be billed for the services rendered, a sum not greater
16 than the actual prorated costs of printing and handling and such
17 bill shall be due and payable immediately upon receipt thereof.
18 SECTION 5. That the City Clerk shall provide each candidate
19 or the candidate's representative a copy of this Resolution at the
20 time nominating petitions are issued.
21 SECTION 6. That the City Clerk shall certify to the passage
22 and adoption of this Resolution; shall enter the same in the book
23 of original Resolutions of said City; and shall make a minute of
24 passage and adoption thereof in the records of the proceedings
25 of the City Council of said City, in the minutes of the meeting at
26 which the same is passed and adopted.

PASSED, APPROVED AND ADOPTED at an adjourned regular meeting
of the City Council held on the 22nd day of November
1977, by the following vote, to wit:
