Statement of the Natter
At the time Section 2.48.030 (7) of the Carlsbad Municipal Code
was initially adopted the intent was to conduct periodic reviews
for the purpose of recommending changes. As a result of a ricent
review changes contained in Exhibit No, 1 and No. 2 are
recommended.
The changes are for the purpose of including in Section 2.48.030 (7)
the positions of ne „ty ��*��, Principal Civil Engineer,
Senior Building Inspector and Departmental Administrative Assistant.

and informed the Council the matter would be returned at a
later date.
5-2-78 Resolution 95267 was adopted, with the deletion of the position of
Deputy City Clerk.
Ordinance #1206 was given a first reading, adding positions as
Management employees, with the deletion t of Deputy City Clerk. {

SUBJECT: DESIGNATION OF ADDITIONAL MANAGEMENT PERSONNEL
Agenda Bill 5264 proposes designation of additional management
personnel. This recommendation serves two purposes. First, it serves
an organizational purpose and second an employee relations purpose.
It should be noted that the positions recommended for management
designation are not necessarily those with the highest level of
compensation. Many positions in the city require a high degree of
technical skill but, do not have a significant responsibility for
the administration of policies or programs. Management responsibility
and technical ability are distinctly differ_nt.
Organizationally, the positions will provide greater management depth
in each major area of public service. The positions of Principal Civil
Engineer, Senior Building Inspector, and Deputy City Clerk require
close cooperation with and support of the department heads in maintain-
ing the public service provided by the department. Additionally, these
positions are required to act for the department heads in their absence
in carrying out the mission of the department. Departmental
Administrative Assistants, as implied by title, are charged with assist-
ing major department heads in administering the public service function
of their departments. In each case there is a significant responsibility
for participating in the formulation and administration of city policies
and programs.
An equally important need is met by these designations in the area of
employee relations. As the environment of employee relations changes
from one of meet and confer to one of collective bargaining -there must
be a delineation between management and employees. Collective bargain-
ing is a bilateral relationship between management and employees.
Frequently this bilateral relationship is obscurred bs,,ause of poorll
articulated designations. Personnel charged with day to day management
responsibilities become employees once the conditions of employment
are discussed. By distinctly identifying management employees and
providing an adequate number of management employees, the bilateral
relationship is sustained as well as the probability of the continui.y
of the delivery of public services.

CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 2, CHAPTER 2.48 OF. THE CARLSBAD
MUNICIPAL CODE BY THE AMENDMENT OF SECTIdN
4 2.48.030 (7), TO ADD THREE•POSITIONS AS
MANAGEMENT EMPLOYEES.
6 The City Council of the City of Carlsbad, California, does
7 ordain as follows:
8 "Section I That Title 2, Chapter 2.48 of the Carlsbad
9 Municipal Code is hereby amended by the amendment of Section
10 2.48.030 (7) to read as follows:
11 (7) "Employee, management" means any employee having
12 significant responsibility for formulating and adminis-•
13 tering city policies and programs, including but not
14 limited to the following positions:

EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal Newspaper within fifteen days after
its adoption.

CITY OF CARLSBAD, CALIFORNIA, AMENDING
RESOLUTION NO. 4062, APENDICES A and B.
4 WHEREAS, the City Manager recommends and the City Council
5 concurs that the addition of: the positions PRINCIPAL CIVIL
6 ENGINEER, SENIOR BUILDING INSPECTOR and DEPARTMENTAL ADMINISTRATIVE
7 ASSISTANT to Appendix A and to Appendix B Resolution No. 4062, is
8 necessary to implement changes to the Carlsbad Municipal Code,
9 Section 2.48.030 (7).
10 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
11 City of Carlsbad as follows:
12 1. That the above recitations are true and correct.
13 2. That amended Appendices A and B of Exhibit A of Resolution',
14 No• 4062, attached hereto, shall supersede those previausly
15 adopted.
